Box 711 (City Hall, 400 Grand Avenue) South San Francisco, California 94083 Meeting to be held at: MITNICIPAL SERVICFS BUILDING Council Chambers 33 ARROYO DRIVE SOUTH SAN FRANCISCO, CA WEDNESDAY, FEBRUARY 24, 2016 7:01 P.M. 1. Call to Order. TIME: 7:54 P.M. 2. Roll Call. PRESENT: Councilmembers Normandy, Matsumoto and Garbarino, Vice Mayor Gupta and Mayor Addiego. ABSENT: None. 3. Agenda Review. No Changes. 4. Public Comments. None. 5. Consideration of Oversight Board request to reallocate a portion or all of the $2,272,000 in community benefits payments to be made by Sares Regis to other taxing entities. Mayor Addiego introduced the topic to Council. He advised that at its Special Meeting on February 23, 2016, the South San Francisco Oversight Board moved to recommend that the City Council consider allocating a portion of the Sares Regis Development community benefits payment to the South San Francisco Unified School District ( "SSFUSD "). He explained that Oversight Board Member Krause, representing the SSFUSD, had voiced the District's concern over its loss of roughly $3,000,000 due to the impact of the community benefits payment on the overall land valuation and ultimate sale price of the property. Mayor Addiego advised that the Board did not reject the resolution authorizing the sale of the land as it did not want to delay the project; however the Mayor strongly recommended consideration of an allocation to the SSFUSD to maintain goodwill with the Board on similar property sales moving forward. Before concluding, he read a letter to the Council from SSFUSED Superintendent Dr. Shawnterra Moore regarding the issue. Councilmembers expressed an understanding of the SSFUSD's perceived loss, while noting the financial benefits would be realized by all taxing entities over the long run. Nonetheless, fleshing out the community benefits payment in a more defined manner on future projects might assist the sale approval process. Given that the park fee in this instance was negotiated as opposed to predefined by ordinance, Councilmembers were comfortable with an allocation to the SSFUSD in this instance. The allocation would be limited to designated project or projects consistent with the City's community benefits ordinance. Motion - Councilman Garbarino /Second - Councilwoman Matsumoto: to allocate $1,000,000 to the SSFUSD to be utilized for a specified project or project(s) that are consistent with the City's Municipal Code provisions related to Community Benefits, and to be worked out in agreement with the SSFUSD.
