PRESENTATIONS Introduction of new and promoted employees - Fire Chief Lee introduced new employees: Paramedic/Firefighters Jason Bezemer, Alex Mengell, and Brad Setterlund; and promoted employees: Fire Captain Travis Nuckolls and Fire Marshal Maurice Dong. Police Chief Raffaelli introduced new employees: Police Records Specialists Rose Meere and Corinne Hoenisch, and Communications Dispatcher Elizabeth Baros; and promoted employees: Corporals Danny Gil, Bruce McPhillips and David Kennan, Lieutenant Mike Newell, and Sergeant Paul Ritter. Caltrain construction update - Mr. Joe Siino, Caltrain Construction Manager, provided information on the current status of the project to be completed November, 2003. He responded to Council questions regarding the recent flooding along the Colma Creek Canal caused by pumps being accidentally turned off. He explained that corrective work has been implemented; crews monitor the water flow 24 hours a day and a back-up system is in place. Ms. Denise Donovan, Caltrain Public Outreach, stated appreciation for the cooperation and responsiveness she has received from City staff. · Proclamation - Emergency Medical Services Week, May 18-24, 2003. Mayor Gonzalez presented the proclamation to EMS Coordinator Rich Porcelli. Lawndale Drive construction and adjacent preferential permit parking area update, Public Works Director John Gibbs and Police Lieutenant Mike Newell - Director Gibbs reported that Lawndale Drive will be open to traffic on June 3, and traffic surveys will be conducted before and after the opening. Lieutenant Newell gave a visual presentation that included information on neighborhood meetings that were conducted in the past year, details on the preferential parking permit process, neighborhood parking signage, upcoming distribution dates for the permits, parking enforcement and a reminder that BART revenue service will begin on June 22. Report on Terrabay Development slide area and soundwall design - Public Works Director John Gibbs reported that Western Pacific Construction and Terrabay Development have responded proactively to the slippage area that was aggravated by irrigation. He stated that corrective work will begin in approximately two weeks and will take one to two weeks to complete. Director Gibbs gave a visual presentation on the proposed soundwall to be built along Sister Cities Boulevard above Randolph Avenue and the negative impact it will produce. Council stated their dissatisfaction with the unattractive design of the proposed fence, that vegetation can be more effective as a soundwall and be more aesthetically pleasing. Council discussed safety issues, including the current barrier railing, noisy trucks, and high wind. With the consensus of Council, Mayor Gonzalez requested that the neighborhood be notified of Council's recommendation to install landscaping as a soundwall and to include information on the reverse effect a wooden fence will have. ITEMS FROM COUNCIL · Community Forum · Subcommittee Reports Councilman Garbarino reported on his personal effort to gather reading materials and athletic equipment for disadvantaged children who live on Christmas Island. He asked that anyone wishing to contribute could reach him at City Hall. Councilman Fernekes reported attending many City events and fundraisers during the past month and also participated in a police ride-along. He reported that the Investment Subcommittee (Fernekes/Matsumoto) met with staff and City Treasurer Ford. The subcommittee requested that the City Treasurer and staff meet with a financial advisor and come back with recommendations to the subcommittee. Councilman Green reported attending several City volunteer recognition events and the annual firefighters' golf toumament/fundraiser for the Alisa Ann Ruch Bum Foundation. Mayor Pro Tem Matsumoto reported on City events and the regional committee meetings she attended. She asked staff for an update on the Junipero Serra restoration project. Maintenance Services Director Terry White reported that work was delayed due to recent rains, a schedule is being worked out with the contractor, and the plastic sheeting is scheduled to be removed from the slope during the week of May 19. Mayor Gonzalez reported on City events he attended and upcoming community fundraisers. CONSENT CALENDAR 1. Motion to confirm expense claims of May 14, 2003 in the amount of $2,663,311.50 o Resolution No. 38-2003, authorizing acceptance of grant funds from the Peninsula Community Foundation in the amount of $43,954 Resolution No. 39-2003, amending FY 2002-03 Capital Improvement Program budget to include the Gull Drive/Forbes Boulevard traffic signal project and transfer $50,000 from the Eccles Avenue/Forbes Boulevard traffic signal project o Resolution No. 40-2003, authorizing utility relocation agreements with PG&E for the Oyster Point Grade Separation Phases II and III project o Acknowledgement of proclamations issued: Police Services Volunteer Appreciation Day and Police Reserve Officer Appreciation Day, April 25, 2003; Library Volunteer Week, April 27-May 3, 2003; and Mosquito and Vector Control and West Nile Virus Awareness Week, April 28-May 4, 2003 Motion-Garbarino/Second-Femekes: To approve the Consent Calendar as presented. (Recess: 8:51 pm- 9:03 pm) PUBLIC HEARINGS Consideration of Zoning Amendment (P03-0007) amending SSFMC Chapter 20.79, Residential Second Unit Regulations, Chapter 20.06, Definitions; Chapter 20.14 R-E, Rural Estates District Use Regulations; Chapter 20.16, R-1 Single-Family Density Residential District Use Regulations; Chapter 20.18, R-2, Medium Residential District Use Regulations; Chapter 20.20, R-3 Multi-Family Residential District Use Regulations; Chapter 20.74, Off-Street Parking and Loading Regulations; and Chapter 20.85, Design Review Procedure, to amend the development standards for residential second units to be consistent with the South San Francisco General Plan Housing Element and State law; motion to waive reading and introduce an ordinance Staff report and visual presentation given by Chief Planner Tom Sparks. Public hearing opened. Mr. Joe D'Angelo, 310 Evergreen Drive, speaking in favor of the item, addressed advantages of the 2nd unit ordinance and that it ads to the city's housing stock. He felt that 2nd units would have less of an impact on the City than the proposed high density Mission Road housing development. He stated his support for more flexibility in the size of the second unit and suggested it be increased from 640 s.f. to 1000 s.f. Mrs. Joy-Ann Wendler, speaking with concern, addressed the negative effects 2nd units can have on a community if the zoning ordinance is not administered with caution. She discussed how 2nd units could change a neighborhood's quality of life and character. She stated support for staff's original recommendation of limiting second units to 400 s.f., addresses be limited to one address or an "A" or "B", owners must live on site, that current lot coverage regulations be complied with, and applications be subject to design review. REGULAR CITY COUNCIL MEETING MAY 14, 2003 MINUTES PAGE 3 1 91 Mr. Rick Gomez, 208 Armour Avenue, president of the Old Town Homeowners and Renters Association, speaking against the item, urged Council to not allow 1000 s.f. 2nd unit additions. He addressed the impact illegal second units have had on his neighborhood, that there is no way to track if the property owners are living on the premises, that units will not be affordable, units can be rented out to large groups of people, and that there are impacts on traffic, parking, noise and garbage. Mr. Alex Ku, 107 Valleyview Way, speaking in favor of the item, stated that the proposal to allow 1000 s.f. 2nd unit additions is reasonable. He rationalized that with the current lot coverage standards few lots will qualify for 2nd units and therefore few applications will be submitted. He stated his home sits on a large site and that a 1000 square foot addition is small. He urged Council to approve the zoning amendment as recommended by the Planning Commission. Mr. John Prouty, 705 Hill Avenue, speaking in favor of the item, addressed numerous problems associated with 2nd units in his experience as a realtor, and urged Council to consider amnesty. He stated that the number of bedrooms in a unit will dictate the impact on the neighborhood, carports work better than covered garages, and owners will eventually move out and leave both units as rentals. Public heating closed. Councilman Femekes discussed with staff AB 1866, the City's current 2nd unit standards, how other cities are addressing the State mandate, the definition of 2nd units, setbackrequirements, the anticipated number of applications, and other State legislation being considered. Councilman Fernekes stated he is not opposed to amnesty and that 2nd unit additions be in proportion to a home so that the home's integrity is maintained. Councilman Garbafino agreed with Councilman Fernekes that a home's integrity be maintained and that a formula be considered that will keep additions in proportion to a home. He suggested that a use permit process be considered if a property owner wishes to exceed the standards. In response to Councilman Green, staff clarified that the Planning Commission did not recommend separate entrances, but they did recommend a minimum size of 400 s.f., and in certain instances tandem parking. In response to Mayor Pro Tem Matsumoto, staff clarified that a process for conditional use permits was not addressed in AB 1866; a city cannot limit the number of occupants per unit; the use of"A" or "B" in the address did not pose a problem; the size of the Chestnut Creek units are 550-~= s.f.; design review guidelines are recommended, but not a DRB heating, and the number of applications anticipated is hard to quantify. Mayor Gonzalez stated his displeasure with the State mandating these types of regulations on cities. He discussed with staff the idea of imposing a mechanism to assure that 2nd units stay affordable and rented to those who are low income. Assistant City Attorney Johnson clarified State law G.C. Section 65852.2, and the standards that will take effect July 1 if the city takes no action. REGULAR CITY COUNCIL MEETING MAY 14, 2003 MINUTES PAGE 4 o Councilman Femekes discussed the timeline for adopting the ordinance and that it is critical that Council passes the ordinance tonight. Council agreed that it would be beneficial to impose restrictions, rather than those being imposed by the State. Council questioned if the number of occupants per unit can be limited and if the Planning Commission needs to review it first. City Attorney Mattas advised Council that it needed to articulate direction to staff to research and provide language related to the number of occupants that can reside in a 640 s.f. unit, and that the language can be considered at the second reading of the ordinance without going back to the Planning Commission. After discussing the matter further, Council reached a consensus to, a) limit 2nd units to a maximum of 640 s.f.; b) no minimum square footage; c) amnesty for illegal units subject to requirements of the 2nd unit ordinance; d) separate addresses will be limited to "A" and "B"; and e) tandem parking is acceptable. Motion-Matsumoto/Second-Garbarino: To waive reading and introduce an ordinance amending Chapter 20.06, Definitions, Chapter 20.16, Single-Family Residential District, Chapter 20.18, Medium Density Residential District, Chapter 20.20, Multi-Family Residential District, Chapter 20.74, Off-Street Parking, and Chapter 20.85, Design Review Procedure, implementing regulations for the residential second unit ordinance, for consistency purposes. Unanimously approved by voice vote. Consideration of Zoning Amendments (ZA-01-021/Mod 1 and ZA-01-041/Mod 1) to adopt revisions to SSFMC Chapter 20.27, Transit Village District; Chapter 20.14 R-E, Rural Estates District Use Regulations; Chapter 20.16, R-1 Single-Family Density Residential District Use Regulations; Chapter 20.18, R-2, Medium Residential District Use Regulations; and Chapter 20.20, R-3 Multi-Family Residential District, to require a use permit for all projects that generate 100 or more vehicle trips per day (ADT); and Chapter 20.120 Transportation Demand Management to include child care as an additional measure not originally listed in the chapter; motion to waive reading and introduce an ordinance Staff report presented by Chief Planner Sparks. Motion-Femekes/Second-Garbarino: An ordinance amending the City of South San Francisco Municipal Code, Chapter 20.27, Transit Village Zoning District to require a use permit for all projects that generate 100 or more average vehicle trips per day (ADT) and Chapter 20.120, Transportation Demand Management to include childcare as an optional TDM measure. Unanimously approved by voice vote. REGULAR CITY COUNCIL MEETING MAY 14, 2003 MINUTES PAGE 5 ADMINISTRATIVE BUSINESS Consideration of a request by the San Mateo County Mosquito Abatement District for annexing South San Francisco, including request for a property tax sharing agreement Staff report presented by Finance Director Steele with the recommendation that Council approve a letter, signed by the Mayor, to the Abatement District outlining the City's concerns and requesting the district place a parcel tax proposal on the November ballot (copies of letter distributed to Council). 10. Motion-Green/Second-Femekes: To forward a letter, as recommended by staff and signed by the Mayor, to the San Mateo County Mosquito Abatement District. Unanimously approved by voice vote. Resolution naming a baseball field at Alta Loma Park in honor of the late Gus Nicolopulos Staff report presented by Recreation and Community Services Director Ranals. Mr. John Prouty, 705 Hill Avenue, speaking in favor of the item, discussed Gus Nicolopulos' involvement and dedication with PAL and the compassion he showed for the children who participated in the program. Councilmembers stated their support for the request. Director Ranals announced that the dedication ceremony will take place June 22, 2003. Motion-Garbarino/Second-Green: To approve Resolution No. 41-2003, naming a baseball field at Alta Loma Park in honor of the late Gus Nicolopulos. Unanimously approved by voice vote. CLOSED SESSION 11. Pursuant to Government Code Section 54956.9(a), existing litigation: California Department of Toxic Substances Control (DTSC) v. City Attorney Mattas reported that Council approved by a 5-0 vote the approval of the Phase II PRP agreement and gave direction to staff.
