Report f'om Closed Session: City Attorney Mattas reported that Judge Mittlesteadt issued
a decisicn in the case today, the City's arguments were appropriate and the actions of the
City Council were upheld; absence of an appeal this case is completed.

Police Chie: Mark Raffaelli presented certificates of recognition to citizens Judith
Henkle, Bor .s Kreysa, Rebecca Vergara, and Holly Fulghum-Nutters (not present);
certificates ¢.f commendation to Police Officers Mike Brennen, Adam Plank, and Joanne
Wojciecho'a ski; and certificate of meritorious conduct to Corporal Mike Riordan.
Assistant Fi: e Chief John Lucia presented certificates of commendation to citizens Rob
Oblicgacion (not present), Garth Barrett, Craig Cosko (not present), Tom McKinley (not
present), ant. Matt Hayes; and certificate of excellence to Paramedic/Firefighter Paule
Medeiros.
South San ~ancisco Youth Baseball Team, Fog City, second place winners in the
Cooperstow ~ Baseball Tournament of Champions - Head Coach Jim Mercurio introduced
assistant covches and recounted the events at Cooperstown; team players introduced
themselves. On behalf of the City Council, Councilman Fernekes accepted the second place
trophy and t :am photo for display at City Hall. Autograph baseballs were presented to each
Councilmen .ber.

Lights! Acti )n! Read! Summer in the Library - Ann Mahon, Library Program Manager
and Meg Cc ?man, Librarian II, gave a visual presentation highlighting summer reading
clubs and talent show programs.
Day in the 1; ark Update - Ms. Judy Bush, committee member, gave a visual presentation
of last year' ~ event, and highlighted activities planned for this year's community fair to
be held Sep'ember 20, 2003.
Request for Consideration of AB 1546 - Mr. Rich Napier, C/CAG Executive Director
and San Cm los Councilmember Michael King provided an update on the assembly bill's
proposed pilot program. He reported that it has passed through the State Assembly and
is currently )eing considered by the Senate. Messrs. Napier and King responded to
Council's q :estions regarding the proposed funding structure. Mayor Pro Tem
Matsumoto ;tated her support for submitting the letter of support to the State legislature.
Mayor Gonxalez stated his concern regarding the lack of public outreach and requested
more time. Souncil agreed to reconsider the item at the next meeting.
FY 2003-04 State Budget Update - Finance Director Jim Steele gave a visual
presentation on the status of the State budget and the impact it has had on the City. He
reviewed the different sources of losses, totaling $3.9 million in revenue for this fiscal
year. He st~ed that the League of California Cities is considering a ballot measure for
November 2904 that would protect local government revenues from further takings by
the State.

PUBLIC COMMENTS
Mr. Vince and Mrs. Louise Senatore, 322 Valencia Drive, sought Council's assistance for the
abatement ofprope: ty located at 381 Ponderosa Drive. Mrs. Senatore read from a prepared
letter submitted to Council. Staff was directed to investigate the matter.

Mr. Paul Formosa, South San Francisco Scavenger Co., reported on the new automated garbage
and recycling collec :ion system for residential customers that will begin in the next five to six
weeks. Council suggested flyers be multi-language and include visual instructions. (Garbage
and recycling toters were on display and a newsletter was distributed to Council.)

Councilmembers re' >orted on attendance at community events, announced upcoming events and
fundraisers, and acknowledged members of the community for their contributions.
Councilman Fernek :s reported that the Day in the Park subcommittee (Fernekes/Matsumoto)
met to finalize the September 20 event. He stated that his term is nearing its end as president of
the Peninsula Divisl~on of the League of California Cities and reported that at the recent annual
conference League: nembers addressed constitutional protections for local revenues. He also
attended a biotechnology conference and sat on a panel with the Mayor and Assistant City
Manager Van Duyn to discuss the industry's continued growth in South San Francisco.

Councilman Green reported attending the SFO Airport/Community Roundtable and Land Use
Committee, and th~_: the Blue Angels will be stationed at SFO during fleet week. He reported
that the budget subcommittee (Fernekes/Green) has had several meetings and that information
will be presented at the September 17 study session.
Mayor Pro Tem ME tsumoto stated she represented the City at C/MAC and C/CAG meetings.
Mayor Gonzalez re' >orted attending a Water Transit Authority meeting and offered to speak to
any organizations u ishing to learn more about the proposed project. He also attended the
annual public policy meeting hosted by the Archdioceses of San Francisco.

Staff report ~resented by Chief Planner Tom Sparks.
Council rev:ewed the proposed DEIR alternative routes and concurred with staff's
comments a ~d recommendation as outlined in the letter to Aspen Environmental Group,
prepared fo~ the Mayor's signature.
City Attorm y Mattas advised Council on the CEQA process and necessity to have the
comments on record for any subsequent actions to be taken by the City. He further
reminded Council that staff has already requested intervener status on behalf of the City.
Council reit ,~rated their support for the Mayor to sign the comment letter.
LEGISLATIVE BL,SINESS

Motion to u, aive reading and introduce an ordinance to amend the contract between the
Board of ACgninistration, California Public Employees' Retirement System (PERS), and
the City Col .ncil, City of South San Francisco, to provide Section 21354.5 (2.7% at 55
full and mocified formula) for local miscellaneous members
Staff report >resented by City Manager Wilson.
Mayor Pro ~ 'em Matsumoto questioned the impact on the City's general fund and asked
that the info 'mation be provided to Council. She also asked for clarification on whose
obligation is greater--the City or the employee and what the long term costs will be for
the City.
Motion-Gre m/Second-Fernekes: To waive reading and introduce an ordinance
approving a:l amendment to the contract between the Board of Administration,
California P ~blic Employees' Retirement System, and the City Council of the City of
South San l~?ancisco. Unanimously approved by voice vote.
ADJOURNMENT
Motion-Garbarino/Second-Fernekes: To adjourn the meeting at 10:(}6 p.m. in memory of the
police, fire, and oth ,~r safety officers and civilians who lost their lives on September 11, 2001
and victims of the Oklahoma bombing (April 19, 1995). Unanimously approved by voice vote.
