Absent: None. PLEDGE OF ALLEGIANCE Led by Mayor Gupta AGENDA REVIEW City Manager Futrell recommended moving Item 9 to the first item of Administrative Business in deference to the members of the public in attendance. The Council concurred. PRESENTATIONS 1. Presentation and Proclamation of City activities promoting Healthy City/Healthy Living for the months of March through May. (Leslie Arroyo, Communications Director) Communications Director Arroyo provided an overview of the activities planned for Healthy City/Healthy Living, encouraging residents to keep the City clean and live a healthy life. She discussed the Adopt a Storm Drain Program, Water Quality Control Plant Tours, March 25 Citywide Spring Clean Up Day, Poster Contest, and May 6 Celebration of Healthy Living/Healthy City. Mayor Gupta read the proclamation recognizing March 2017, as Healthy City/Healthy Living Month and encouraging residents to join the campaign to help keep the City clean and healthy. 2. Certificate of Commendation presented to Officer Phillip Nielsen, Officer Marc Nuti, Dispatcher Alma Alvarado, Dispatcher Brittney Chapman, and Dispatcher Marianne Tuakoi; Certificate of Recognition presented to Battalion Chief Matt Samson, Fire Captain Todd Rael, Fire Engineer Jason Bezemer, Firefighter/Paramedic Layne Filbrun, Firefighter/Paramedic Anthony Fisicaro, Firefighter/Paramedic Manny Lara, Paramedic Intern Carlos Aguas, South San Francisco Fire Department & the South San Francisco Professional Firefighters IAFF Local 1507. (Jeff Azzopardi, Police Chief) Police Chief Azzopardi thanked and honored the individuals that assisted during the officer attack on Thanksgiving 2016, including Dispatchers Alvarado, Chapman and Tuakoi for remaining calm and provide adequate dispatch; Officer Nielsen for his foot pursuit of the suspect; Officer Nuti for rendering first aide; and members of the South San Francisco Fire Department for their response time, professionalism, empathy and care. Police Sergeant Sean Curmi commended the South San Francisco Fire Department and South San Francisco Professional Firefighters IAFF Local 1507 and presented a certificate of recognition. Mayor Gupta commended the Fire and Police Department for working together. 3. Presentation on the Succession Development Initiative and LEAP launch for City-wide career development and training. (LaTanya Bellow, HR Director) Human Resources Director Bellow presented the Succession Development Initiative including a workforce analysis. Dr. Bennis, Consultant, explained the process including emphasis of succession development rather than position replacement; two prong approach to develop existing talent and attract new talent; implementation process including workforce analysis, kickoff meeting, creation of succession development committee, survey of employees, management training, and initiative launch. He complemented the committee for developing and carrying out the plan and thanked the City Manager for his leadership and support of the Human Resources Director and Department Heads. Erin O'Brien, Parks and Recreation, presented the LEAP (Leadership Education and Advancement Planning) Brand, and intranet site. Angela Dudolau, Parks and Recreation, discussed upcoming programs including the All-Star Recognition Program, expansion of internship program, Lunch N Learns, Leadership Academy,job shadowing and cross training and career development month. She thanked her fellow LEAP Committee members. Councilmember Matsumoto stated her intent was not related to employee replacement. She discussed the importance of management objectives. She requested entry level employees be able to participate. Dr. Bennis discussed efforts to include all employees. Councilmember Matsumoto suggested a path of growth for employees to improve retention. Human Resources Director Bellow stated there were employees from Streets and Maintenance on the committee. Vice Mayor Normandy expressed appreciation for the plan of action. She suggested monitoring the intranet to determine usage. Councilmember Garbarino stated he was a proponent of promoting from within and he hoped the program would be beneficial. REGULAR CITY COUNCIL MEETING FEBRUARY 22,2017 MINUTES PAGE 2 Mayor Gupta thanked staff for the presentation and requested an annual review to determine success. PUBLIC COMMENTS Robert Cardenas discussed his efforts to establish a medical marijuana dispensary. He urged the Council to repeal Ordinance No. 1442-2011. He stated he would control the voucher. Aristel De La Cruz, teacher at South San Francisco High School, indicated support and urged South City to become a sanctuary City. Matthew Ledesma, for North County Coalition, former South San Francisco counselor, discussed stress of youth due to uncertainty of immigration status. COUNCIL COMMENTS/REQUESTS Councilmember Garbarino asked what happened to the wells when water tables rose. City Manager Futrell introduced Public Works Director Kim. Public Works Director Kim stated the water table rise recharged the ground water for the wells. Councilmember Matsumoto requested adjourning in memory of Eda Patuki. She discussed the need to update the General Plan. She provided an overview of the General Plan since its adoption in 1999 and discussed the need for housing east of 101 which was currently prohibited in the General Plan. She stated it was necessary to formally update the General Plan given the new land uses. She requested addressing the General Plan and CIP at the Council Retreat. City Manager Futrell stated he would add those topics. Mayor Gupta congratulated City Clerk Martinelli on her new baby daughter. He discussed the invitation to the San Mateo Remembrance Evening on the 75th Anniversary of Executive Order 9006, Japanese Internment, on February 18, 2017. ITEMS FROM COUNCIL—COMMITTEE REPORTS AND ANNOUNCEMENTS 9. Resolution affirming the City of South San Francisco's commitment to diversity and inclusion. (Council Member Karyl Matsumoto) Councilmember Matsumoto presented the item indicating it was discussed at the last Council meeting and was before the Council for additional comments and input. City Attorney Rosenberg read the proposed resolution. Luis De Paz addressed the Council as a father and undocumented member of the community. He expressed concern about his safety and fear of deportation. He urged the Council to establish South San Francisco as a sanctuary city. Sal Morales stated he came to South City at the age of two and expressed concern regarding deportation. He encouraged the Council to ensure the City was safe for all. REGULAR CITY COUNCIL MEETING FEBRUARY 22,2017 MINUTES PAGE 3 Emma Gutierrez requested the Council declare the City a sanctuary city. She stated she was undocumented until 2001. She discussed the importance of immigrants in the City and Country. Gretel Berreto, daughter of immigrants, discussed her involvement in the City. She expressed concern for student's safety and requested South City continue to serve and protect all families by becoming a sanctuary city. Alfredo Olivia discussed his family and community members living with fear of deportation. He announced legal assistance at the Dream Center at Sky Land College on Wednesdays from 6:00-8:00 pm. Carlos Rodriguez stated he immigrated in 1978 and discussed his and his families' involvement in South San Francisco. He discussed his business, Mr. Roofing Inc. and stated he was a fully functioning member of the community. He discussed concerns of the immigrant community and urged the City to make sanctuary policies. Caesar Rodriguez introduced his family, all formerly undocumented immigrants. He urged the Council to declare the City as a sanctuary city. He dispelled concerns with sanctuary policies including the false sense of security and threat to cut Federal funding. Christina De Los Santos, South San Francisco resident and immigration attorney, encouraged adoption of concrete sanctuary policies. She stated sanctuary type policies could combat fear of deportation. Gustavo Lopez addressed the Council on behalf of his undocumented students and acknowledged the proposed resolution. He urged the Council adopt a resolution protecting immigrants, enacting a sanctuary city and providing resources to the most vulnerable residents. Nick Occhipiniti stated he was a citizen of a family of immigrants. He read a portion of the Jefferson Union School Board resolution and urged the Council to declare South San Francisco as a sanctuary city. Itzel C. Medin, undocumented resident, expressed concern regarding deportation and urged the Council to declare the City as a sanctuary city and ensure the Police stay separate from ICE agents. Abraham Calvo Medina discussed his fear of immigration. He urged the Council to declare the City as a sanctuary city. Mayor Gupta thanked the speakers for their input. Councilmember Addiego expressed concern that the sanctuary city might divide the city, therefore encouraged the use of"indivisible." He suggested policies imposed on the City's police resources. He expressed concern that San Mateo County Sheriff's worked with Immigration and Customs Enforcement (ICE). He stated he did not have the power to protect the immigrants the way he would like to. REGULAR CITY COUNCIL MEETING FEBRUARY 22,2017 MINUTES PAGE 4 Councilmember Garbarino asked where Councilmember Addiego wanted to insert "indivisible." Councilmember Addiego suggested restricting what the Police could do. Vice Mayor Normandy thanked Councilmember Addiego for his comments. She requested Police Chief Azzopardi readdress his comments. Chief Azzopardi stated the Police Department would continue in its efforts to not enforce immigration status. Councilmember Matsumoto discussed actions taken and next steps in association with the resolution, including meetings with County and elected officials and establishment of a citizen's advisory committee to establish a strategic plan. Carla Marina, Library Department, expressed hope that the community felt safe to come to the City Council. She stated she looked forward to working together with the community to implement the plan. Councilmember Matsumoto discussed her experience of being placed in an American Concentration Camp. She urged all of the City to come together to support each other. Councilmember Garbarino discussed the work of the task force and commitment to gather support for all residents in South San Francisco. He discussed Japanese internment camps and hoped that America did not make the same mistake again. He encouraged residents to continue expressing their concerns. Councilmember Addiego stated the resolution sent a message that South San Francisco was a welcoming city but he was disappointed that he could not do more. He read a letter from a resident discussing those that needed immigrants for capital game but hating them at the same time. Mayor Gupta stated he was a first-generation immigrant and understood the fears and concerns expressed by the speakers. He stated the Police Chief would not be assisting immigration agents. He stated the resolution indicated the intent and implementation was yet to be spelt out. He stated the resolution captured the spirit of the needs to support the citizens. Councilmember Matsumoto stated it was a first step and work in progress. Motion - Councilmember Matsumoto / Second - Councilmember Garbarino: that this Resolution, RES 17-2017,be adopted. Approved by roll call vote: Yes: 5 - Vice Mayor Normandy, Councilmember Garbarino, Councilmember Matsumoto, Mayor Gupta, and Councilmember Addiego Enactment No: RES 17-2017 RECESS Mayor Gupta called a recess at 9:11 p.m. The meeting reconvened at 9:21 p.m. with all Councilmembers present. ADMINISTRATIVE BUSINESS 4. Report regarding resolution transmitting mid-year financial report and amending the Fiscal Year 2016-17 adopted budget. (Richard Lee, Director of Finance) 4a. Resolution accepting mid-year financial report and amending the Fiscal Year 2016- 17 adopted budget. REGULAR CITY COUNCIL MEETING FEBRUARY 22,2017 MINUTES PAGE 5 Director of Finance Lee presented the Fiscal Year 2016-2017 mid-year budget including staff's recommendation, General Fund Summary, General Fund Revenues, Mid-Year Budget Requests, and Other Funds. Mayor Gupta acknowledged Vice Mayor Normandy for her work on reviewing the mid-year budget items. He stated they ensured that the mid-year items could not wait until the new budget. He requested staff pay attention to increasing PERS payments. He stated he was assured that there was no connection between the high-speed rail and train station modifications. He recommended the Council approved the recommendations. Vice Mayor Normandy agreed with the recommendations presented and stated her questions regarding the expenses for the Oyster Point Phase 2 had been answered. Councilmember Matsumoto thanked the Mayor and Vice Mayor for their work on the Budget Subcommittee. She asked where permit fees were reflected under revenues. Director of Finance Lee stated permit fees were included in the General Fund. Councilmember Matsumoto asked why Oyster Point Phase 2 was taken from the City Manager's budget. City Manager Futrell explained the two items related to Oyster Point. The $300,000 study was for the portion covered by the Harbor District and the $40,000 request was based on staff's recommendation that additional studies over the studies mandated by State law would be prudent. Councilmember Matsumoto discussed the need to update the General Plan. Director of Economic and Community Development Greenwood stated it was time to update the General Plan and staff was working on a plan. He stated, based on Council direction, staff was looking at opportunities to bring residential development into the area east of the 101. He stated the $40,000 would allow additional studies over and above those required under CEQA. Councilmember Matsumoto asked about mutual aid and overtime costs. Fire Chief Kohlmann explained the method of determining the$340,000 reimbursement. In response to Councilmember Matsumoto, Director of Finance Lee explained the proposed $9.8 million in encumbrances to be rolled over to FY 17-18. Councilmember Matsumoto requested a breakdown by department. In response to Councilmember Matsumoto, City Manager Futrell discussed the $20,000 requested for election consolidation. He anticipated the Board of Supervisors would take action in the near future. Councilmember Matsumoto expressed concern with the estimate changing. In response to Councilmember Matsumoto, Director of Finance Lee explained the proposed class and compensation studies. City Manager Futrell stated each MOU offered the right to request the study. In response to Councilmember Matsumoto, Fire Chief Kohlmann explained the portion of the requested $51,800 for Fire Department recruitment. Councilmember Matsumoto requested a person of color be recruited. Fire Chief Kohlmann discussed the diversity of the REGULAR CITY COUNCIL MEETING FEBRUARY 22,2017 MINUTES PAGE 6 firefighters and service regardless of race, culture or means. He stated his first objective was to hire staff that could best support the community. Councilmember Matsumoto stated she did not want a"token" hire but requested diversity in hiring. Fire Chief Kohlmann discussed the testing process for screening applicants and the recruitment process. In response to Councilmember Matsumoto, Finance Director Lee stated the Train Station Enhancement Fund was a separate fund paid by developers. City Manager Futrell explained it was the second phase of enhancements that CalTrain would not pay for but the City would like for a nice-looking plaza. Councilmember Matsumoto discussed MTC efforts to "swap money." Vice Mayor Normandy stated the issues raised by Councilmember Matsumoto were all vetted and she supported the proposed recommendations. Report regarding a resolution approving a purchase agreement with Silverado Avionics Inc. for the purchase of 51 BendixKing portable radios and accessories in an amount not to exceed $129,839.32 and authorizing the City Manager to execute the purchase agreement on behalf of the City of South San Francisco. (Jess Magallanes, Deputy Fire Chief) 5a. Resolution approving a purchase agreement with Silverado Avionics Inc. for the purchase of 51 BendixKing portable radios and accessories in the amount of $129,839.32and authorizing the City Manager to execute the purchase agreement on behalf of the City of South San Francisco. Deputy Fire Chief Magallanes discussed the need to purchase new portable radios for emergency communications. He explained the eight important factors considered when evaluating the options for radios. He summarized the recommendation to purchase BendixKing portable radios. In response to Councilmember Garbarino, Deputy Fire Chief Magallanes stated the radios were compatible throughout the County. He discussed chargers in vehicles and battery life. In response to Councilmember Addiego, Fire Chief Kohlmann explained the Public Safety Impact Fee. City Attorney Rosenberg explained the fee adopted in 2012 and nexus study determining 25% allowed for the Public Safety Impact Fee. Vice Mayor Normandy questioned how the other nine radios could be purchased. Deputy Fire Chief Magallanes discussed the purchase of vehicles which included an additional six radios. Mayor Gupta asked about the warranty and service. Deputy Fire Chief Magallanes stated the radios came with a one year manufacturer warranty. Mayor Gupta recommended allocating funds necessary to provide quality service. Report regarding a resolution accepting the Ambulance Service Financial Report for Fiscal Year 2016-17 quarters one and two, and authorizing the write-off of $2,229,642.57 in uncollectable ambulance billing accounts receivable. (Richard Walls, Emergency Medical Services Chief) 6a. Resolution accepting the Ambulance Service Financial Report for Fiscal Year 2016- 17 quarters one and two, and authorizing the write-off of $2,229,642.57 of uncollectable ambulance billing accounts receivable. Emergency Medical Services Chief Walls presented the ambulance financial services report. He explained the process of account review prior to determination that an account was uncollectable. He provided ALS and BLS financial summaries. He described the billing process and reviewed the accounts receivable status. He requested the Council authorize the write-off of uncollectable ambulance accounts. Councilmember Matsumoto requested consideration of discontinuing the City's ambulance service. She suggested conducting a study of the other cities' costs for ambulance service. Councilmember Addiego commended Councilmember Matsumoto and concurred with looking into costs of other cities. Councilmember Garbarino concurred with conducting a study. Fire Chief Kohlmann explained that four positions were augmented by the revenues. He anticipated increasing revenues in the future due to completion of the transition with the billing company. City Manager Futrell stated the report provided transparency which raised questions. He stated he and the Fire Chief would discuss conducting a study. Councilmember Matsumoto stated South San Francisco was the only city with its own ambulance service. She stated she wanted a better understanding of the costs and services. City Manager Futrell stated it was also necessary to consider quality and speed of care. Fire Chief Kohlmann stated the accounts receivable would eventually contain $2-4 million, with one and one half times revenue. Vice Mayor Normandy stated it was necessary to write off the accounts and the transparency provided a process to correct the issue. She stated the larger accounts were prior to Fire Chief Kohlmann's arrival. In response to Councilmember Addiego, Emergency Medical Services Chief Walls stated Resolve collected 30 cents on the dollar of the amount collected. Mayor Gupta agreed with the desire to review the internal versus external ambulance services. Fire Chief Kohlmann explained the secondary billing process and stated payments REGULAR CITY COUNCIL MEETING FEBRUARY 22,2017 MINUTES PAGE 8 could still be received from written off accounts. Director of Finance Lee stated there was no opportunity for fraud. Motion - Vice Mayor Normandy/ Second - Councilmember Addiego: that this Resolution, RES 20- 2017,be adopted. Motion to approve the minutes from the meeting of January 18, 2017. 8. Motion confirming payment register for February 22, 2017. (Richard Lee, Director of Finance) The Acting City Clerk duly read the Consent Calendar, after which Council voted and engaged in discussion of specific items as follows: Item 8: Councilmember Matsumoto stated she did not attend the Santa Cristo event. Director of Finance Lee stated that was an error and the charge was actually for the San Mateo Council of Cities meeting. Councilmember Matsumoto requested additional information on the $150,463 under Safety Program Consultant Services. Motion - Councilmember Matsumoto / Second - Vice Mayor Normandy: to approve the Consent Calendar. Motion was approved by a unanimous roll call vote. COUNCIL COMMENTS/REQUESTS (Continued) Councilmember Addiego requested adjourning in memory of Armando Garcia and Adair Devine. He stated he would provide a complete update on the Airport Roundtable, but they were waiting for information back from the FAA. ADJOURNMENT Being no further business, Mayor Gupta adjourned the meeting at 10:36 p.m. in memory of Eda Patuki, Armando Garcia and Adair Devine.
