HomeMy WebLinkAboutOB Reso 06-2016File Number: 16-678 Enactment Number: RES 06-201111 WHEREAS, on June 29, 2011, the Legislature of the State of California (the "State ") adopted Assembly Bill xl 26 ( "AB 26 "), which amended provisions of the State's Community Redevelopment Law (Health and Safety Code sections 33000 et seq.); and WHEREAS, pursuant to AB 26 and the California Supreme Court decision in California Redevelopment Association, et al. v Ana Matosantos, et al., which upheld AB 26 (together with AB 1484, the "Dissolution Law "), the former Redevelopment Agency of the City of South San Francisco was dissolved on February 1, 2012; and WHEREAS, the City of South San Francisco became the Successor Agency to the Redevelopment Agency of the City of South San Francisco ( "Successor Agency"); and WHEREAS, pursuant to Health and Safety Code Section 34191.5(c)(2)(C), property shall not be transferred to a successor agency, city, county or city and county, unless a Long Range Property Management Plan ( LRPMP) has been approved by the Oversight Board and the California Department of Finance ( "DOF "), and WHEREAS, pursuant to the Dissolution Law, the Successor Agency prepared an LRPMP, which was approved by a resolution of the Oversight Board for the Successor Agency to the Redevelopment Agency of the City of South San Francisco ( "Oversight Board ") on May 21, 2015, and was approved by the DOF on October 1, 2015; and WHEREAS, pursuant to the Dissolution Law and the LRPMP, certain real property located in the City of South San Francisco was transferred to the Successor Agency ( "Agency Properties "); and WHEREAS, the LRPMP establishes a plan for transferring or selling the Agency Properties that were owned by the former Redevelopment Agency; and WHEREAS, the LRPMP identifies seven (7) parcels to be transferred from the Successor Agency to the City for governmental uses pursuant to Health and Safety Code section 34191.5(c); and WHEREAS, the LRPMP also identifies two (2) parcels to be conditionally transferred from the Successor Agency to the County of San Mateo for governmental uses pursuant to Health and Safety Code section 34191.5(c); and Page 1 File Number. 16-678 Enactment Number. RES 06-2016 non-governmental/public purpose, the City or County shall enter into a compensation agreement with the San Mateo County Auditor-Controller or other appropriate entity or entities, providing that all net revenue from such non-governmental/ public use shall be distributed in the same manner as property tax, subject to then-current law respecting such distribution. (7) Following the approval of this Resolution, or as soon thereafter as reasonably permissible, all revenues and expenses associated with the Agency Properties identified in the LRPMP, and as described in Exhibit A, that were identified as revenues and expenses of the Agency, shall become the responsibility of the receiving entity (i.e City or the County). At a meeting of the Oversight Board to the Successor Agency to the former Redevelopment Agency on 8/16/2016, a motion was made by Michael Krause, seconded by Mark Addiego, that this Resolution be approved.
