HomeMy WebLinkAboutMinutes 2004-09-08 MINUTES CITY COUNCIL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING WEDNESDAY, SEPTEMBER 8, 2004 MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE CALL TO ORDER: 7:35 p.m. (Cassette Tape No. 1) ROLL CALL: Present: Councilmembers Femekes and Gonzalez, Vice Mayor Green and Mayor Matsumoto Absent: Councilman Garbarino PLEDGE OF ALLEGIANCE: Led by Mr. Jim Metz INVOCATION: Captain Chris Yaeger, Salvation Army PRESENTATIONS · Day in the Park, September 18, 2004 Update - Committee member Jim Metz gave a visual presentation on the highlights of the annual event. · Annual Beautification Committee Awards - Committee member Saundra Nichols presented awards to the following: Mr. Gino Massoni, Palm Avenue Mr. Guerrero Espinoza, Pisa Court Mr. Stephen Basuel, Pisa Court Chestnut Creek Senior Housing Development, Chestnut Avenue Ron Price Motors, Chestnut Avenue Cell-Genesys, Inc., 500 Forbes Boulevard AGENDA REVIEW City Manager Nagel requested Agenda Item No. 8 be removed from the Agenda. PUBLIC COMMENTS Mr. Carl Rowlands, resident, provided information on the Shriners' Hospital's free orthopedic screening clinic to be held at Magnolia Senior Center on October 9, 2004, for children under 18. (Flyers distributed to Council.) Mr. Frank Greco, resident, reviewed a list of concerns that his neighborhood has regarding the Habitat for Humanity's 440 Commercial Avenue development. He further commented that his neighborhood is frustrated by Council's decision to approve the project and to not respond to any of their questions or concerns. Mr. Ed Pavlus, business owner, described the parking problems that have been occurring on the 200 block of South Maple Avenue. He submitted photos of trucks blocking the streets and making it difficult for other businesses to operate. Mayor Matsumoto directed staff to look into the matter and report back to Council. Ms. Romanie Rajhboy, resident, stated her frustration regarding the AT&T public hearing process and felt that the neighborhood's concerns were not listened to at the August 11, 2004 meeting. She stated that the speakers' issues were not addressed and residents resented several of the remarks made by staff. Mayor Matsumoto stated that staff will respond in writing to her comments. Ms. Marge Sieux, resident, stated she was confused with the two staff reports that were issued for tonight's AT&T agenda item and wanted clarification. She commented that AT&T should be fined $1000 per day, the neighborhood appellants have been ignored, and requested that Ms. Rajhboy's letter be responded to. Ms. Pamela Sieux, resident, also speaking in reference to AT&T, referred to her September 1, 2004 letter and reviewed its key points (previously submitted to Council). She stated that the neighborhood would like to have the cabinets placed underground without the enhanced landscape. Mr. Jim Heard, AT&T counsel, referred Council to his letter of September 8, 2004 and reviewed its key points. He informed Council that California Water Service, property owner, respectively chooses not to allow the installation of underground equipment on its properties. He requested that the above ground installation be approved, or the matter be continued to allow for further discussions between AT&T and Cal Water. (Copies of letters distributed to Council.) ITEMS FROM COUNCIL · Announcements · Committee Reports Councilman Fernekes reported that there was a recent Day in the Park subcommittee meeting (Femekes/Matsumoto) and a budget subcommittee meeting (Fernekes/Green). Vice Mayor Green reported that he recently attended the Airport Community Roundtable monthly meeting. Mayor Matsumoto announced that tonight's meeting is being adjourned in memory of Police Captain Dave Haskin, who served the City for 32 years, and in honor of the people who are fighting to protect our freedom. She read excerpts of an email received from one of our police officers stationed in Iraq. REGULAR CITY COUNCIL MEETiNG SEPTEMBER 8, 2004 MINUTES PAGE 2 CONSENT CALENDAR 1. Motion to approve the minutes of August 11 and 18, 2004 Item removed from Consent Calendar. 2. Motion to confirm expense claims of September 8, 2004 in the amount of $3,910,470.72 3. Resolution No. 80-2004, opposing Propositions 68 and 70, Tribal Gaming Compacts Motion to re-adopt Ordinance No. 1344-2004, amending Chapter 20.125, inclusionary housing requirements o Resolution No. 81-2004, accepting grant from the San Mateo County Health Services Agency to fund Community Partnership's Community Health Initiative in the amount of $23,422 Resolution No. 82-2004, accepting funding for two Library Services and Technology Act (LSTA) grants in the amount of $13,000 Resolution No. 83-2004, awarding construction contract to Northwest Construction of Burlingame, for the Beacon Street Storm Drain Replacement Project in the amount of $154,240 o Motion to accept parcel map dedicating public street (McLellan Drive) and public use easements from Fairfield South San Francisco, LLC Item removed from Agenda. Resolution No. 84-2004, approving the installation of stop signs on Magnolia Avenue at Commercial Avenue 10. Resolution No. 85-2004, awarding construction contract to M. Bumgarner, Inc., for the new metal beam guard railing installation project in an amount not to exceed $50,000 11. Resolution No. 86-2004, amending list of designated positions that are subject to the conflict of interest code 12. Resolution No. 87-2004, approving personnel changes, including classification description and placement on the confidential (Teamsters) salary schedule Mayor Matsumoto requested Item No. 1 be removed from the Consent Calendar on behalf of City Attorney Mattas. City Attorney Mattas requested that a verbatim of the minutes of August 11, page 5, paragraph 3, sentence 4, be prepared and included in the August 11 minutes. Approved by voice vote. Absent: Councilman Garbarino. ADMINISTRATIVE BUSINESS 13. Consideration of appeals of Planning Commission decision to approve a Use Permit Modification (UP-00-025/Mod 1) of a wireless communication facility situated on the California Water Service Co. storage tank property on Avalon Drive near Canyon Court in a Single Family Residential (R-1-C-P) Zoning District in accordance with SSFMC section 20.105; Owner: California Water Service Co.; Applicant: AT&T Wireless a) b) Appeal of approval ofUP-00-025/Mod 1 (Appellant: Marge Sieux, et al) Appeal of conditions of approval pertaining to under grounding the equipment and number of antennas (Appellant: AT&T Wireless/Howard Yee) Continued from August 11, 2004. Public hearing closed. Staff report presented by Chief Planner Sparks. He reported that the appellants were inadvertently overlooked last Friday, September 3, when the staff reports were distributed and that copies were delivered today. He further explained that the revised staff report was subsequently prepared to remove any reference to public art and then distributed at tonight's meeting. Mayor Matsumoto reviewed the three options for Council's consideration. After a brief discussion Councilmembers concurred to deny both appeals, to uphold the Planning Commission's decision, and that AT&T will receive a use permit with the condition requiring undergrounding. Councilmembers further concurred that if AT&T is unable to underground, it could resubmit a use permit modification to the Planning Commission to change the condition of approval. Motion-Femekes/Second-Green: To deny both appeals and uphold the Planning Commission's action to approve UP00-0025/Mod 1 and DR00-0025/Mod 1. On the question: Mayor Matsumoto clarified that the motion includes all the conditions adopted by the Planning Commission, which staff confirmed. Motion continued: Approved by voice vote. Absent: Councilman Garbarino. COUNCIL COMMUNITY FORUM No report. CLOSED SESSION 14. Pursuant to Government Code Section 54957.6 conference with Labor Negotiator Jennifer Bower on negotiations with all labor units Time entered into Closed Session: Time reconvened into Open Session: Report from Closed Session: 8:44 p.m. 9:13 p.m., Councilmembers Femekes and Gonzalez, Vice Mayor Green and Mayor Matsumoto were present.
