MINUTES SPECIAL MEETING CITY COUNCIL AND RECREATION AND PARK DISTRICT OF THE CITY OF SOUTH SAN FRANCISCO P.O. ABSENT: None. PUBLIC COMMENTS - comments are limited to items on the Special Meeting Agenda. None. MATTERS FOR CONSIDERATION 1. Report regarding Resolutions Approving the Transfer of Certain South San Francisco Recreation and Park District Property from the South San Francisco Recreation and Park District to the City of South San Francisco (Jason Rosenberg, City Attorney) Recreation and Park District only: Ia. Resolution No. 1 -2018 Approving the Transfer of Certain South San Francisco Recreation and Park District Property from the South San Francisco Recreation and Park District to the City of South San Francisco. City Council only: lb. Resolution No. 42 -2018 approving the Transfer of Certain South San Francisco Recreation and Park District Property from the South San Francisco Recreation and Park District to the City of South San Francisco. City Attorney Rosenberg presented the staff report recommending that the Recreation and Park District and City Council each adopt a resolution approving the transfer of certain South San Francisco Recreation and Park District property from the South San Francisco Recreation and Park District to the City of South San Francisco. He explained that the Recreation and Park District ( "District ") was first created by voters in 1950 and was subsequently reorganized by the City Council. The District's purpose is the maintenance and operation of parks, recreation grounds and parkways. The City Council serves as the District's Board of Directors and acts on its behalf. Pursuant to a Disposition and Development Agreement dated March 23, 2011 between the City, the former Redevelopment Agency -now Successor Agency - and the Oyster Point Development, LLC. ( "Developer "), certain property was to be transferred from the City to the Successor Agency and from the Successor Agency to Developer. To accomplish this, the City prepared and approved a new parcel map that reorganized and divided the Property into six (6) new parcels. On September 29, 2017, the parties transferred title to the Developer. The grant deeds for this conveyance were created, executed and recorded. A new assessor's parcel map for the new six (6) parcels, Parcel Map No. 17 -0002, was also created. Upon review by the County Assessor's Office, staff recently learned prior parcel maps listed a portion of the eastern tip of Oyster Point, identified by assessor's parcel number 015- 010 -810 as owned by the District rather than by the City. To finalize mapping, all parcels within Parcel Map No. 17 -0002 must have commonality of ownership. Accordingly, staff recommended approval of the proposed resolutions to resolve the technicality. In response to a question from Councilman/Boardmember Gupta regarding whether additional parcels might be similarly impacted, City Attorney Rosenberg advised that no parcels in the current parcel map would be similarly impacted after resolution of the technicality. A parcel outside of the parcel map that was currently under Bay water might be similarly impacted; however it did not affect the assessment district presently of concern. Motion — Boardmember Gupta/Second— Boardmember Addiego: to approve Resolution No. 1 -2018 of the Recreation and Park District of the City of South San Francisco. Approved by the following roll call vote: AYES: Boardmembers Garbarino, Addiego and Gupta and Chair Normandy; NAYS: Vice Chair Matsumoto; ABSTAIN: None; ABSENT: None. Motion— Boardmember Addiego /Second— Boardmember Garbarino: to approve Resolution No. 42 -2018 of the Recreation and Park District of the City of South San Francisco. Approved by the following roll call vote: AYES: Boardmembers Garbarino, Addiego and Gupta and Chair Normandy; NAYS: Vice Chair Matsumoto; ABSTAIN: None; ABSENT: None.
