(Cassette Tape No. 1) 1. Call to Order 5:30 p.m. 2. Roll Call Present: Councilmembers Garbarino, Gonzalez and Matsumoto, Mayor Pro Tem Fernekes and Mayor Green Absent: None Staff present: City Manager Nagel and City Attorney Mattas Others present: Mary Albert, Independent Newspaper 3. Public Comments None. Consideration of a resolution adopting an amendment to the December 1994 agreement with Michael A. Wilson Staff report presented by City Attomey Mattas. He explained the aspects of the transaction that 1) will result in a savings of over $100,000 for the City; 2) will put the former city manager into the PERS Air Time program, and 3) will end the City's participation in the PARS retirement enhancement program. He further explained that the former city manager would have the same level of benefits, less a $51 per month difference in pay. Councilman Gonzalez questioned if there were any other pending issues with the former city manager and City Attorney Mattas confirmed that this would resolve all issues. He further explained the matter of the $51 per month differential, but anticipated the matter to be resolved amicably, if not, there would be a differential of approximately $9,400 (the present net value of $51 per month over a 30 year period) for the City to pay. Mayor Green questioned the percentage that the City would earn on the money that is put in. City Attorney Mattas stated that he could report back to Council on that matter. Mayor Green asked for clarification on what payments had been made to PARS and City Attorney Mattas explained the obligation was funded in September of last year consistent with the contract; he further explained the method for transferring the money to the PERS Air Time program. City Attorney Mattas requested authority to resolve the $51 a month difference without having to come back to Council for approval. Motion-Gonzalez/Second-Fernekes: To approve Resolution No. 120-2004, approving Amendment No. 11 to the agreement between the City of South San Francisco and Michael A. Wilson and providing the City Attorney with authority to resolve the $51 a month differential matter. Unanimously approved by voice vote. Consideration of a resolution withdrawing fi.om the PARS supplemental retirement benefit plan Motion-Garbarino/Second-Fernekes: To approve Resolution No. 121-2004, authorizing the termination of the PARS Retirement Enhancement Plan effective July 1, 2002 and the PARS Excess Benefit Plan effective July 1, 2002.
