As used in this o~inance the following wor~s an~ phrases shall mean: "Air rai5 warning signal" shall mean a sisal, by siren, whistle:, horn or other audible device, of two minutes ~uration consisting of either a fluctuating or warbling signal of ~arying pitch or a succession of intermittent blasts of about five seconds Suration separate~ by a silent perio~ of about three seconds. "All clear signalw shall mean a continuous signal, by siren, horn or other audible ~e~ice, of ~vo minutes Suration at a stea~y pitch. "~erio~ of air rai8 alarm~ shall ·mean the interval of time between the giving of the air rai~ warning signal an~ the giv- ing of the next succeeding all clear signal. ~Blackout structurew shall mean any space so en- c!ose~ that any iil~ination maintaine~ or existing therein is no~ visible from any point outsi~e such enclosure. Section ~. The Chief of Police is hereby authorize~' an~ ~irecte~ to cause the sounding of an air rai~ warning signal an~' an all clear signal when, an~ only when, the Sistrict in which the city is locate8 is notifie~ so to ~o by the United States Aircraf~ ~arning Service. .Section ~. ~y person who effects or maintains ~y illumina- tion, or permits any i!l~ination ~er his control to be effecte8 or maintaine~ at any. place within the City of South San Francisco ~uring any period of air rai~ alarm in the hours of ~arkness, except within a blackout structure~ shall be guilty of a misdemeanor. Section ~. The maintenance or lea~ing of any ill~ination, except within a blackout structure, without provision for its ex- tinguishment, within one minute after the co~:~encement of a perio~ of air rai~ alarm by a competent person over the age of eighteen --1-- · years attendant at the place where such illumination is controlled, is hereby prohibited. Section 5. In oz~er to enable the Chief of Police to con- form to the request of the United States Aircraft ;'faming Service for the obscuration, ~iminution or extinguishment of any illumina- tion, whether in or out of 5cots, which increases the vulnerability of the City of South San Francisco, or any portion thereof, to air attack, or for the regulation of traffic ~uring the period of air rai~. alarm, the Chief of Police may a~opt an~ promulgate reasonable rules an~ regulations for such purposes, an~ any rules or regula- tions so a~opted by him shall be an~ remain in effect for thirty (30) ~ays thereafter, but no longer unless approve~ within saig time by resolution of the City Council; provi~e~, however, that any rule or regulation so a~opte~' by the Chief of Police may at any time be rescin~e~ by resolution of the City Council. Violation of any such rule or regulation so a~opte~ an~ promulgate5 is hereby ~e- clare~ to be a misdemeanor. Section 6o It shall be unlawful to 5isobey any lawful ~irection or or~'er of a peace officer, highway patrolman, or fire- man given ~uring a perio~ of air rai~ alarm, whic:h or.~er is reason- ably necessary for the maintenance of public orSer or safety or to effect the extinguishn~ent or obscuration of light. Section 7. Any illumination coi~trary to the provisions of this ordinance, or to any rule or regulation a~opte~ an~ promuigate~ in accordance with section 5 hereof, constitutes a public nuisance, an~ the same may be su~marily abate~ by any peace officer, highway patrolman, or fireman. A~ny structure may be entere~ by any peace officer, highway patrolman, or fireman, using reasonable force if necessary, for the purpose of abating such a nuisance by extinguish- ing such illumination. Section 8. At the co~mencement of a period, of air raif~ alarm, the operator of any motor vehicle shall forthwith bring such vehicle -2- as far as possible to the side of the street, roa~ or highway off the main traveled portion thereof, an~ the operator of such motor vehicle, an~ the operator of any street car, shall bring such motor vehicle or street car to a stop clear of any crossing, intersection, fire house, fire plug, hospital or other emergency depot or area, an~ during the hours of ~arkness shall extinguish all lights therein or thereon and sai,~ motor vehicle or street car shall remain so situated ~uring the period of air rai~ alarm, unless directe~ or or~ere~ to move by a peace officer, highway patrolman, or fireman. Section 9. The provisions of this ordinance shall not apply to blackout emergency vehicles, which shall include the following: l) All Army an~ Navy vehicles; ~) All vehicles with Unite~ States Government credentials inSicating the necessity of emergency movement; 3) All authorize~ emergency vehicles as define~ in sections 44 and 44.1 of th~ Vehicle Co~e of California; 4) All vehicles being operate~" by members of the California State Guar~ while actually on ~uty; 5) All vehicles of volunteer personnel engaged in the opera- tion of the Aircraft Warning Service of the Fourth Interceptor Com- mand while ~uch personnel are actually going to or from their posts of ~uty. 6) All vehicles certifie~ by sheriffs, district attorneys, the California State Highway Patrol, police chiefs, an~ fire chiefs, when within the respective territorial jurisdictions of the certify- ing office, as being essential to the preservation of the public peace and safety or to the ~issemination of public information or to the national defense; provi~e~', however, that such vehicles shall conform to the uniform lighting regulations approve~ by the Depart- ment of Motor Vehicles and the California State Highway Patrol for blackout emergency vehicles. No certificate shall be issue~ which -3- conflicts v~ith any regulation or or, er of the United States Army applicable in the area for which the certificate is issued. Section 10. It shall be unlawful for any person without authority, ~uring any air raid alarm, to use, wear, exhibit or possess any uniform, insignia, credential, or other indication of authority, or any imitation thereof, a~opted ann issued by any of- ficial civilian defense organization. Section ll. Any person who shall operate a siren, whistle or other audible ~evice in such a ~anner as to simulate an air raid warning signal or an all clear signal, except upon order of the Chief of Police, or other proper authority, shall be guilty of a misdemeanor° Section 12. The provisions of every orainance of this city an~ every a~ministrative order made pursuant thereto, requiring any illumination to be maintaine~ in conflict with this ora inance or with any rule or regulation made pursuant to section 5 of this orS. inance, shall be deemed suspen~e~ during the period between any air rai~ warning signal ane the next succeeding all clear signal. Section 13. Any person who shall violate any provision of this ordinance shall be guilty of a mi sd er~.anor and, upon convic- tion thereof, shall be punished by a fine of not exceeding three hundre~ ~ollars ($300.00) or by imprisonment in the city jail or in the county Jail not exceeding three months:, or by both such fine and imprisonment. Section 14. Section 15. If any provision of this orSinance or the appli- cation thereof to any person or circumstances is hel5 invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invati~ provision or application, an~ to this end the provisions of this ordinance are declared to be severable. Section 18.
