HomeMy WebLinkAboutOrd 260-1947 CENTRAL FILE ~0 The City Coui~cil of the City of South San Francisco does hereby ordain as follows: Section 1. It shall be unlawful for any person, persons, firm or corporation to tral~sport, by means of any vehicle, any earth excavated from any lct or parcel of land in the City of South San Fra~cisco, without first haviz~g obtai~-~ed a permiz from the City Council of said city for the purpose of transportation of such earth. The word "vehicle", as used herein, is a device in, upon or by which any person or property is or may be propelled, reaved or drawn upon a higi~way, excepting a device moved by human power or used exclusively upon stationary rails or tracks. Section 2. Sefore any permit, which may be granted by said City Council for the transportation of earth upon any oublic street or highway in said city, shall become effective, the grantee or grantees of such permit shall f~i~".in the office of the City Clerk of said city a bored to indemz~ify said city for any injury or injuries, -~hich such grar~tee or grantees may do to sidewalk or pave- me~t or to sewers in saia city, in such amotmt as said City Council, on consideration of the application for such permit, may deem to be adequate for the protection of saia city. in no event shall the bond be less than Five Hundred Dollars (~500) in amount. It shall be the obligation of any grantee or grantees to fully remove from any sidewalk or street all such earth as such grantee, or grantees ~/~y have permitted to fall on such sidewalk or pavement. The bond herein required shall be in such form as to indemnify said city for the cost of removing from such sidewalk or paveme~t all such earth as may have been permitted to fall there- on by such grantee or grantees. Such bond shall inure to the benefit of said city al~d shall, by its terms, give said city a ri~ht of action thereon, in the event of failure of such grantee or grantees, , ! Section 3. Every person or corporatioz~, who or which shall violate any provision of this ordinance, shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than One Hundred Dollars (~100) and not more than Five Hundred Dollars ($500), or by imprisonment for not more than three (3) months, or by both such fine and imprisonment. The movement of each load of earth, which may be transported over pave- ment in said city in violation of the terms of this ordinance, shall constitute a separate offense. Section 4. No Sente~ce, which may be impose~ for a viola- tion of this ordinance, may be suspended. Section 5. This ordinance shall be published once in "The Enterprise", a ~ewspaper of general circula~tion published and circulated in said City of South San Francisco and shall take effect end be in force on the expiration of thirty (30) days after its adoption.
