Amin MINUTES OF PREVIOUS MEETING Minutes of the Planning Commission meeting of May 29, 1973 Commissioner Hale moved that the minutes of the regular meeting of the South San Francisco Planning Commission of May 29, 1973 be approved The motion was seconded by Commissioner Mathewson and was passed by the follow- ing roll call vote: AYES: Vice Chairman Gamma, Commissioners Hale, Lazzari, Mathewson, Mullin, Slade and Chairman Raffaelli NOES: None ABSENT: None ANNOUNCEMENT CONCERNING TAPE RECORD[NG OF MEETING Chairman Raffaelli announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission in order to be heard, but objected to having his or her voice recorded in this manner, could request the Chairman to order the tape recorder turned "off" for the duration of the time that he or she is speaking or is heard. - 3137 - May 29, 1973 V-157 V-157, variance request of J. & H. Properties to construct an' industrial building within the required, rear-yard setback of a building site located on the easterly side of Littlefield Avenue, about l83! northerly of the projection of East Harris Avenue, in the M-2-H District. Secretary Pass read the following report and letter into the record. Report and recommendation of City Planner Daniel~1. Pass "The Office of the City Planner respectfully recommends that the Planning Commission adopt the "findings" and action indicated in the attached preliminary Official Action Report." FINDINGS: "1. There are exceptions or extraordinary circumstances or con- ditions applying to the land or building referred to in the application, which circumstances or conditions do not apply generally to land or buildings in the same district. 2. The granting of the application is necessary for the preserva- tion and enjoyment of substantial property rights of the petitioner. 3. That the granting of the application will not, under the circum- stances of the particular case, materially affect adversely the health or safety of persons residing or working in the neighborhood of the property of the applicant, and will not, under the circum- stances of the particular case, be materially detrimental to the public welfare or injurious to property or improvements in said neighborhood. 4. The granting of the requested variance will be in harmony with the general purpose of the Zoning Ordinance. 5. The requested variance is necessary to prevent practical diffi- culties, unnecessary hardships, and results inconsistent with the general purpose of the Zoning Ordinance. 6. The 15' rear-yard requirement in the M-2 District is designed to encourage the establishment of alleys, where such establishment would be desirable and practicable. In the instant case, the estab- lishment of an alley along the rear property line of the subj ect building site would be neither desirable nor practicable. 7. The Planning Commission has granted many, similar variances. 8. The Planning Commission, on February 10, 1969, and on March 23, 1970, granted V-62 and V-79, respectively. These variance requests were similar to the variance application under consideration, and involved the same parcel of land V-62 and V-79 automatically expired, due to nonuse." CONDITIONS: "The applicant shall comply with the submitted require- ments of the City's officials, the subsequent requirements of the Planning Commission>> s Architectural Committee, and the standards and specifications administered by the Director of the Department of Ecological Development." - 3138 - V-157 Contd. May 29, 1973 Interoffice Memorandum~ dated May 17, 1973~ from William A. Fox, Fire Marshall "We have no objection to a variance to a minimum five foot (5') rear setback, but before approval of the building a fire hydrant will have to be placed on the premises. Location of hydrant and size of main to be determined by the Fire Marshal II. Names and addresses of Proponents and Opponents Proponents: George Avanessian~ AlA 914 Linden Avenue, South San Francisco Agent of the applicant Opponents: None George Avanessian stated that the requirement of Fire Marshal Fox to install a fire hydrant should be waived since the building is approxi- mately 275' in depth. The Commission suggested that Mr. Avanessian work out the fire hydrant requirements with the Fire Marshal. Commissioner Lazzari moved that the Planning Commission adopt the findings and conditions as set forth in the preliminary Official Action Report, and approve V-157 upon the condition that the applicant comply with the sub- mitted requirements of the City's reporting department heads, including the Fire Marshal. The motion was seconded by Vice Chairman Gamma, and was passed by the following roll call vote: AYES: Vice Chairman Gamma, Commissioners Hale, Lazzari, Mathewson, Mullin, Slade and Chairman Raffaelli NOES: _ Non e ABSENT: None PM-l08 May 29, 1973 PM-108, tentative parcel map of Cabot, Cabot & Forbes, representing the resubdivision of 34.33 acres of land, located at the southeasterly corner of Forbes Boulevard and Kauffmann Court, and on the westerly side of Point San Bruno Boulevard, in the M-2-H District, into eleven lots Secretary Pass read the following report and letters into the record Report and recommendation of City Planner Daniel M. Pass liThe proposed resubdivision meets the requirements of the State Sub- division Map Act, and the regulatory standards of the Subdivision Ordinance of the City of South San Francisco. The said resubdivision would improve the funct ional des ign of several of the involved, parent lots, in Units No.2 & 3 of the Cabot, Cabot & Forbes Industrial Park, as well as create two additional, well~designed building sites therein. - 3139 - PM-108 Contd May 29, 1973 IlThe proposed resubdivision would also reduce the cost of the force- main sewer which the City of South San Francisco is currently con- structing across Point San Bruno. In light of the above factors, the Office of the City Planner res,pectfully recommends that the Planning Commiss ion approve the instant tentative parcel map upon the condition that the sub- divider comply with the requirements submitted by the City's Officials, and the 'standards candspecifictatiOJ:1.s administered by the Director of Ecological Development." GENERAL PLAN AMENDMENT The Identification of Areas of Special Flood Hazard in the Text, and on the Plan Diagram of the Working-Living Areas Element of the General Plan Secretary Pass read the following report and letter into the record. Urban Planning Analysis No. 80, dated May 14, 1973 "Section 65302 (a), as amended, of the State Planning and Zoning Law requires that the Land Use Elements of local general plans identify areas which are subject to flooding. This section also requires that the said areas be reviewed annually by the Planning Commission The proposed amendments which are embodied in. attached Exhibits "A" & liB", are designed to bring the Working-Living Areas General Plan Element of this municipality into a state of compliance with the Government Code. The Planning Office therefore respectfully recommends that the Planning Commission approve the attached, pre- liminary resolution and thereby recommend that the Honorable City Council adopt the proposed amendments," The Flood Plain of the Colma Creek* "Pursuant to Section 65302 (a)" as amended, of the State Planning and Zoning Law, the Plan Diagram identifies areas which are subject to flooding. These areas should be reviewed annually by the Planning Commission. - 3140 - General Plan Amendment Contd. May 29, 1973 "It is the intent of the City Council of the City of South San Francisco to cause the substantial improvement in the flood- control system of the Colma Creek Basin This improvement would render South San Francisco's "Special Flood Hazard Area" safe for residential, commercial, and industrial land users and uses. The "Special Flood Hazard Areal! indicated on the Plan Diagram is based upon the Federal Insurance Administration's "Official Flood Hazard Map," No. H 06081373006, effective on June 27, 1970 *(Proposed addendum to Page 30 of the General Plan of the City of South San Francisco, entitled Orderly Growth)" Considerable discussion ensued regarding the above subject. At the conclusion of its deliberation the Planning Commission recommended the following Resolution, No. 2127, be adopted and recommended to the City Council that the Working-Living Areas Element of the General Plan be amended to identify areas of special flood hazard. "RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING TO THE CITY COUNCIL THEREOF THAT THE WORKING-LIVING AREAS GENERAL PLAl'J ELEMENT BE AMENDED TO IDENTIFY AREAS OF SPECIAL FLOOD HAZARD. "WHEREAS, the South San Francisco Planning Commission, meeting in regular session on Tuesday May 29, 1973, conducted a public hearing on the City Planner's proposal that the Working-Living Areas General Plan Element be amended to identify "Areas of Special Flood I-Iazard", and WHEREAS, notice of the said public hearing was published in the Enterprise-Journal at least ten days prior thereto; and, WHEREAS, notice of the said public hearing was also transmitted to the Town of Colma, the cities of Brisbane, Daly City, Pacifica, and San Bruno, the County of San Mateo, the County of Alameda, the State Council on Intergovernmental Relations, the State Department of Housing and Community Development, the State Division of Highways, the Association of Bay Area Governments, the Regional Planning Committee of the County of San Mateo, the Bay Conservation and Development Commission, the San Francisco International Airport, the City and County of San Francisco, and the California Public Utilities Commission; and, WHEREAS, the Planning Commission considered the proposed amendment at length, and questioned the division head. of the Office of the City Planner on the contents thereof; and; lVHEREAS, the Commission, after the conclusion of the public hearing, adopted the following findings; 1. Section 65302(a), as amended, of the State Planning and Zoning Law requires that the Land Use Elements of local general plans identify areas which are subject to flooding. 2. The said section also requires that the Planning Commission annually review the areas which are so subj ect. - 3141 - General Plan Amendment Contd. May 29, 1973 "3. "NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of South San Francisco recommend to the City Council thereof that the Working-Living Areas General Plan Element be amended, as proposed by the City Planner, to identify areas which are subject to flooding." Vice Chairman Gamma moved that the Planning Commission adopt Resolution No. 2127 and recommend to the City Council that the Working-Living Areas General Plan Element be amended to identify areas of special flood hazards The motion was seconded by Commissioner Mathewson and passed unanimously. AMENDMENT TO ZONING ORDINANCE NO.. $53 Proposed Open Space Zoning Addendum to Ordinance No 353, as amended. Secretary Pass read the following report and letters into the record Urban Planning Analysis No. 83, dated December 1, 1972 "The Office of the City Planner respectfully recommends that the Planning Commission adopt the attached, preliminary resolution, and thereby recommend that the Honorable City Council enact the attached, proposed amendments to the General Provision of the Zoning Ordinance of the City of South San Francisco. This recommendation is founded upon the following factors. 1. The proposed amendments are designed to effectuate the Open Space Element of the General Plan, subsequent to said Element's adoption by the City Council. 2. The proposed amendments would invest the responsibility of the orderly implementation of the Open Space Element.in the Planning Commission and the Office of the City Planner. 3. Proposed Section5.leg) provides, through the use-permit process, procedural safeguards of the interests of the general public and the private citizen. 4. The amendments are also designed to meet the open-space zoning requirements of Section 65910 of the State Planning and Zoning Law 11 "SECTION 5. GENERAL PROVISIONS AND EXCEPTIONS 5.l(g) No lands or waters which are slated for public or private use as a park, recreational facility, scenic or wildlife preserve, or open space, or are slated for inclusion therein, under the Open Space Element of the General Plan of the City of South San Francisco shall be developed with residential, commercial, or industrial land uses prior to the obtaining of a use permit therefor. The Planning Commis- sion, or upon appeal, the City Council shall not grant a use permit, - 3142 - Amendment to Zoning Ordinance No. 353 Contd. May 29, 1973 Ifunder the purview of this section, unless it finds that the proposed use would be substantially congruous with the Open Space Element, and would not adversely affect the public interest and convenience. 5.l(h) The City Planner of the City of South San Francisco is hereby charged with the duty of administering the Open Space, Conservation, and Public Facilities Elements of the General Plan, and the enforce- ment of the open-space zoning provisions of the foregoing subsection" Interoffice Memorandum from Fred W. Hull, Director of Ecological Development, dated December 1, 1972 llThe Department of Ecological Development has reviewed the proposed open space zoning amendment to Ordinance 353. It is the understand- ing of this Department that the purpose for the amendment is to effectuate the Open Space Element of the General Plan, and that it also establishes responsibili ty for the implementation of the Plan, provides for use permit procedures, and is generally designed to meet the requirements of Section 65910 of the State Planning and Zoning Law. It is also the understanding of this Department that the overall concern of this element is to provide for sufficient and reasonable open space for the use of the citizens of South San Francisco, and that the Open Space Element, which was approved in concept only by the City Council, provides for large amounts of acreage with vary- ing types of zoning and land value. It was understood at the time that the concept plan was approved by Council, that a more detailed set of provisions were required for the purposes of implementing this plan, procedures that would specifically describe the limita- tions to be placed on such properties with regards to zoning and density, land coverage, and also procedures which would allow for the acquisition of lands where necessary and required. For that purpose, I request that the Planning Commission continue this item until such time that a committee can be established for the purposes of formulating these procedures. Such a committee could consist of members of the Planning Commission, members of the City Council, members of City staff, and local taxpayers," Considerable discussion ensued among the Commissioners regarding the proposed Open Space Zoning Addendum to Ordinance No. 353, as amended~ At th_e conclusion of its consideration the Planning Commission recom- mended the following resolution No 2126 be adopted and recommended. to the City Council that the proposed Open Space Zoning Addendum to Ordinance No, 353, as amended, be adopted. "RESOLUTION OF THE PLANNING COW~ISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING TO THE CITY COUNCIL THEREOF THAT THE ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO, ORDINANCE NO. 353, AS AMENDED, BE FURTHER AMENDED BY THE ADDENDUM OF SECTION 5.l(g) and 5.l(h)--THE PROPOSED "0PENSPACE ZONING ORDINANCE," THERETO "WHEREAS, the South San Francisco Planning Commission, meeting in regular session on Tuesday, May 29, 1973, conducted a public hearing - 3143 - Amendment to Zoning Ordinance No. 353 May 29" 1973 "on the City Planner's proposed amendments to Section 5.1 of the Zoning Ordinance of the City of South San Francisco, to wit: "The Proposed Open Space Zoning Ordinance," and, WHEREAS, notice of the said public hearing was published in the Enterprise-Journal at least ten days prior thereto; and, WHEREAS, Planning Commission, after the closure of the public h-earing, considered the advocacies for and against the propos ed amendments, and discussed the proposed legislation at length; and, WHEREAS, the Commission then adopted the following findings: 1. The proposed amendments are designed to effectuate the Open Space General Plan Element, subsequent to the City Council's adoption thereof. 2. Th_e proposed amendments would invest the responsibility of the orderly implementation of the Open Space Element in the Planning Commission and the Office of the City Planner. 3. The proposed Section 5.l(g) provides, through the use- permit process, procedural safeguards of the interests of the general public and the private citizen. 4. The proposed amendments are also designed to meet the open-space zoning requirements of Section 65910 of the State Planning and Zoning Law. NOW, THEREFORE" BE IT RESOLVED that the Planning Commission of the City of South San Francisco recommend to the City Council thereof that the proposed amendments to Section 5.1 of the Zoning Ordinance be enacted into ordinance." Vice Chairman Gamma moved that the Planning Commission adopt the proposed Open Space Zoning Addendum to Ordinance No. 353, as amended, and recommend to the City Council that the proposed Open Space Zoning Addendum to Ordinance No. 353, as amended, be enacted into ordinance. The motion was seconded by Commissioner Mullin and passed unanimously. ANNUAL MEETING The South San Francisco Planning Commission's Annual Meeting, and Election of Officer". (Continued from May 14, 1973) Chairman Raffaelli called the annual meeting of the South San Francisco Planning Commission to order and asked theF Commissioners for nominations for the Office of Chairman. Commissioner Mullin nominated Vice Chairman Gamma for "Chairman". This nomination was seconded by Commissioner Hale. Vice Chairman Gamma was then elected "Chairman" unanimously. Chairman Raffaelli then asked the Commissioners for nominations for the Office of "Vice Chairman". Ch-airman Raffaelli nominated Commissioner Mullin for the Office of Vice Chairman. This nomination was seconded by Commissioner Mathewson. Commissioner ~1ullin was el ected "Vice Chairman" unanimously. The Commissioners expressed their appreciation to Cbmmiss:TIoner Raffaelli for his outstanding service while Chairman - 3144 - GOOD AND WELFARE, OTHER AND COMMUNICATIONS May 29, 1973 There being nothing further to be considered under Good and Welfare, and there being no further communications or other matters of interest for the Planning Commission, Chairman Gamma announced that the next regular meeting of the South San Francisco Planning Commission would be held on June 11, 1973 at 8:00 p.m. in the Council Chambers of City Hall, South San Francisco, California.
