Amin MINUTES OF PREVIOUS MEETING Minutes of the Planning Commission meeting of September 25, 1973 Commissioner Lazzari mentioned that on page 3215 in the motion for action (UP-2S5) paragraph, Commissioner Slade 'had seconded the motion instead of Commissioner Hale. Commissioner Lazzari moved that the minutes of the regular meeting of the South San Francisco Planning Commission of September 25, 1973 be approved with correction noted in the preceding paragraph. The motion was seconded by Commissioner Slade and was passed by the following roll call vote: AYES: ViceJGhairvnan Mathewson, Commissioners Hale, Lazzari Raffaelli, Slade and Chairman Mullin NOES: None ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Mullin announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission in order to be heard, but objected to having his or her voice recorded in this manner, could request the Chairman to order the tape recorder turned "off" for the duration of the time that he or she is speaking or is heard. - 3220 - UP-257 October 9" 1973 UP-2S7" a use permit request by National Bank to permit the establishmen of a drive-in bank and off-street parking" in the C-2 and R-3 Districts. Commissioner Lazzari moved that the Planning Commission continue its c6nsideration on UP-257 to its next regular meeting on October 23, 1973. The motion was seconded by Vice Chairman Mathewson and was carried by an unanimous vote. OEponents: None After some discussion, Vice Chairman Mathewson moved that the Planning Commission adopt the findings and condition as set forth in the staff , and approve UP-2S8 upon the condition that the applicant restrict the size of the sign to 18" x 8'-0" on the face of the building freestanding) and comply with the submitted requirements of the City's reporting department heads. The motion was seconded by Commissioner Raffaelli and was PM-114 October 9, 1973 TENTATIVE PARCEL MAP - CABOT, CABOT & FORBES CO. PM-114, a request to resubdivide four parcels into one 3.492+ acre parcel, located on the southerly side of Oyster Point Boulevard, about 285' easterly of Eccles Avenue, in the M-2-H District. Secretary Martin read the findings and recommendations of the staff report and letters to the Planning Commission. Opponents: None Commissioner Lazzari moved that the Planning Commission approve the instant tentative parcel map upon the condition that the subdivider comply with the requirements as set forth by the City's reporting department heads. The motion was seconded by Commissioner Hale and was passed unanimously. PM-lIS TENTATIVE PARCEL MAP - CABOT, CABOT & FORBES CO. PM-lIS, a request to resubdivide four lots into three lots totalling 23.59+ acres located on the northerly side of Grandview Drive, starting from Cabot !3ourt, in the M-2-H District. Secretary Martin read the findings and recommendations of the staff report and letters to the Planning Commission. Op:Qonents: None Commissioner Lazzari moved that the Planning Commission approve the instant tentative parcel map upon the condition that the subdivider comply with the requirements as set forth by the City's reporting department heads. The motion was seconded by Commissioner Raffaelli and was passed unanimously. - 3222 - PM-116 October 9, 1973 TENTATIVE PARCEL MAP - GOLDEN GATE MEAT CO. PM-116" a request to resubdivide one 1.96+ acre lot into two parcels measuring 1.09+ and 0.98+ acres" located on the westerly side of Harbor Road, about 640' south of East Grand Avenue, in the M-2-H D~strict. Secretary Martin stated that the agent of the applicant requested to continue the tentative parcel map to October 23, 1973 Plan~ing Commission ,meeting. Commissioner Hale moved that the PM-116 be continued to the next Planning Commission meeting as requested by the applicant. The motion was seconded by Vice Chairman Mathewson and was passed unanimously. COLMA CREEK EIR Secretary Martin read the following report and letters into the record. Report and recommendation of ~~ty Planner Neal J. Martin The Planning Division finds the evaluation of the environmental impact of the Co1ma Creek Flood Control Project totally adequate. The State E.I.R. Guidelines have been followed throughout the Environmental Impact Report. Environmental impact, socioeconomic impact, unavoidable adverse environment impacts, mitigation measures, alternatives, short term-long term impacts, irreversible environmental changes, and growth-inducing impacts have been sufficiently covered. It is suggested that the Planning Commission recommend adoption of the EIR to San Mateo County. It is hoped that the recommendation and findings are adopted by the County of San Mateo. RECOMMENDATION It is recommended that the Planning Commission adopt the Draft Environmental Impact Report for the Colma Creek Flood Control Project, and that the Commission recommend adoption of the Report by San Mateo County. Chairman Mullin stated that recommendation also be made to establish a linear park along the Colma Creek. This would be a great asset to the City. Chairman Mullin further stated that this linear park would unify rather than divide the City. All Commissioners unanimously concurred the Chairman's recommendation and stated that this is an excellent EIR report Chairman Raffaelli moved that the preceding recommendation be adopted by Planning Commission and recommend to the City Council and San Mateo County for adoption. The motion was seconded by Vice Chairman Mathewson and was passed unanimously. Commissioner Slade excused himself from the Planning Commission meeting at 9:25 p.m. - 3223- October 9, 1973 TEXACO INC., V. CITY OF SOUTH SAN FRANCISCO, ET At Secretary Martin read the following memorandum from the City Attorney into the record. Ref. #1: Use Permit #203 The Superior Court in the above-entitled action issued a peremptory writ of mandamus which was filed September 19, 1973, and signed by the Hon. Robert Miller, Judge of the Superior Court. The writ requires that the City set aside the Planning Commission's decision dated March 26, 1973, and the Council's decision dated April 16, 1973. I will draft a resolution for Planning Commission's consideration which will vacate and set aside the minute order adopting the Planner's report and interpretative ruling. Then I will include the resolution in a return to the court showing that the City has complied with the writ of mandamus. Commissioner 11ale moved that the following Resolution No. 2134 be adopted by the Planning Commission as suggested by City Attorney. The motion was moved by Commissioner Lazzari and was passed unanimously. RESOLUTION NO. 2134 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO VACATING AND SETTING ASIDE THE DECISION DATED MARCH 26, 1973, AND THE INTERPRETATIVE RULING THEREBY ADOPTED REGARDING USE PERMIT NO. 203 WHEREAS, the South San Francisco Planning Commission, meeting in regular session on Tuesday, October 9, 1973, duly considered the peremptory writ of mandamus issued by the Superior Court of the State of California in and for the County of San Mateo, Case No. 176292, entitled "lFexaco Inc., et al v. City of South San Francisco, et al" wherein said Court ordered that the Planning Commission's decision dated March 26, 1973, be set aside. - 3224 - Octob er 9, 1973 NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of South San Francisco does hereby order that the Planning Commission's de cis ion d;Sl~ted March 26;) 1973.) and the interpretative ruling thereby adopted which is contained in the document dated March 27, 1973, be vacated and set as ide as of this date. GOOD AND WELFARE Chairman Mullin stated that during the public hearing for RZ-2S, Joseph Haggerty, Mr. Haggerty informed the Commission that Westborough Realty Sign on Callan Boulevard will be removed. Chairman Mullin asked the Secretary to look into the matter for removing the sign. Secretary Martin stated that he will contact Mr. Haggerty in this matter.
