Hale Director of Public Services Frank Addiego Zoning Administrator William Costanzo City Engineer Robert Yee Chairman Slade called the meeting to order, announcing that this was a con- tinuation of the adjourned regular meeting held on May 11, 1976, at the West Orange Library Auditorium. MINUTES OF PREVIOUS MEETING Minutes of the Planning Commission meeting of May 11,1976 Commissioner Mathewson moved that the minutes of the regular meeting of the South San Francisco Planning Commission of May 11, 1976, be approved. The Motion was seconded by Vice-Chairman Teglia and was passed by the following roll call vote: AYES: Vice-Chairman Teglia, Commissioners Bertucelli, Goldberg, Hale, Mathewson, Mullin and Chairman Slade NOES: None ABSENT: None ABSTAINED: None ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Slade announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission to be heard, but who objected to having his or her voice recorded in this manner, could request the Chairman to order the tape record,Jt;:! turned "off" for the duration of the time that he or she is speaking or is heard. - 3554 - May 17, 1976 UP-76-340 UP-76-340, a request of Eri1iljiano L. Chavez for the constructi on of a room addition at 3960 Chatham Court in the P.C. Zone. Because the applicant was not present at the beginning of the public hearing, possibly due to the change in location of the meeting, this agenda item was held over until his arrival. The public hearing on this matter was actually held fourth on the agenda. Secretary Hale presented the staff report. Proponent: Emiliano Chavez 3960 Chatham Court South San Francisco, CA Opponents: Barbara Byrd 3966 Chatham Court South San Francisco, CA James B~rd 3966 Chatham Court South San Francisco, CA Robert O. Johns 3954 Chatham Court South San Francisco, CA Ms. Byrd noted to the Commission that she opposed this application because it would directly affect the amount of sunlight they get onto their patio and into their living room. She noted that their living room is dark now, and if any amount of sunlight were cut off, it would be even darker. Mr. Byrd asked if Mr. Chavez had obtained a permit from the Architectural Control Committee to allow him to put in this room addition. Mr. Chavez said that he had not. Secretary Hale noted that it was a condition of this Use Permit application that the applicant obtain this permit from the Homeowners' Association. Mr. Byrd noted that he was a member of the Homeowners I Association and that he had never been notified of the proposed room addition. Mr. Byrd also expressed his concern over sunlight being cut off from his patio and living room. Dr. Johns, a neighbor of Mr. Chavez and Mr. and Mrs. Byrd, expressed his concern with aesthetics of the area if this room addition were allowed to be built. He further expressed his concern with fire hazards being created if a building were put up between the house and garage. Secretary Hale stated that the applicant would be required to use one-hour fire wall in the construction of the proposed room addition. The Commission generally expressed their concerns also with the shadow patterns and with the aesthetics of the area. Commissioner Mathewson noted that Finding #1 should possibly be deleted, because it would be locking the Commission into a definition of what the intent of the Planned Community Zone District is. Secretary Hale agreed and Finding #1 was deleted. UP-76-340, ~ont'~ May 1 7, 1 976 Commissioner Mathewson also requested that the wording in Findings #2 and #3 be changed to read II... may not have... II ins tead of II... wi 11 not have... II Secretary Hale explained the reasoning behind the wording of these two findings. Commissioner Goldberg noted that he would be abstaining from voting in this matter, since he was a property owner within 300 feet of the proposed room addition. Commissioner Mullin moved that UP-76-340 be denied because the proposed room addition would: 1. Infringe upon the rights, health and welfare of the adjacent property owners immediately to the north; 2. Reduce the sunlight and, therefore, the livability O:f the adjacent property; and 3. Cause a significant adverse impact on the adjoining property owners. Commissioner Mathewson seconded the motion and UP-76-340 was denied by the following roll call vote: AYES: Vice-Cha"irman Teglia, Commissioners Mathewson, Mullin and Chairman Slade NOES: Commissioners Bertucelli and Hale ABSTAINED: Commissioner Goldberg UP-76-34l UP-76-34l, a request of the City of South San Francisco for the establish- ment of a temporary trailer to be used as office space for the San Mateo County C.A.P.T.U.R.E. Program on Miller Avenue adjacent to the Police Department building in the Civic Center at 400 Grand Avenue, located in the R-3 Zone. Secretary Hale presented the staff report. Proponent: James Cooper, Police Officer City of South San Francisco Opponents: None Officer Cooper presented slides to the Commission showing the trailer itself and the proposed location, as well as alternative locations. - 3556 - UP-76-34l, cont1d May 17, 1976 There was some discussion on the proposed location for the trailer. The Commission expressed its concerns with the aesthetics of the trailer if the flower bed were removed and the trailer were put in that location. They further expressed their views that possibly a better location would be alongside the retaining wall which would act as a screen from public view. Officer Cooper stated that this would be no problem, other than they would lose two parking spaces to accommodate the trailer and the steps leading to the trailer. Vice-Chairman Teglia moved that UP-76-341 be approved with the added Con- dition #4 that the trailer be located alongside the retaining wall, screening it from public view. Commissioner Bertucelli seconded the motion and it was passed unanimously. V-76-192 V-76-l92, a request of Kaiser Foundation Hospitals for a Variance Permit to provide for the continuation of the nonconforming status of parking require- ments for property located at 500, 512, and 514 Grand Avenue and 306 Spruce Avenue, in the C-2 and R-3 Zones. Secretary Hale presented the staff report, noting to the Commission that the Variance process is not justified in this case and noted that at the time this property is sold, the new owners come before the Commission under the Use Permit process. He stated that the applicant had been advised of this, yet decided to proceed under the Variance Permit process. Proponent: David Van Noy Kaiser Foundation Hospitals 500 Grand Avenue South San Francisco, CA Opponent: None Mr. Van Noy stated to the Commission that there must have been some misunder- standing because he felt he had not been apprised of this situation. He asked that this matter be tabled until such time as a future use was established in this area at which time the matter could be brought back to the Planning Commission. Secretary Hale stated that this was not appropriate because the Variance Permit process would still not be the correct process. After this discussion, Mr. Van Noy withdrew the application. V-76-l93 V-76-l93, a request of Donald Eschelbach for a Variance Permit for the construction of two single-family houses, with each house having two tandem parking garage spaces, to be constructed on the two vacant parcels located on Palm Avenue, southeast of its intersection with Park Way, in tee R-l Zone. - 3557 - V-76-l93L cont'd May 17. 1976 Secretary Hale presented the staff report, noting to the Comml?sion that the slope of the land made tandem parking the only feasible method for these two houses. Proponent: Mr. Donald Eschelbach 791 Park Way South San Francisco, CA Opponents: Andrea Toscano 544 Park Way South San Francisco, CA Mr. Carnesecca 536 Park Way South San Francisco, CA Ms. Toscano expressed her concerns with two houses being built so high that her view would be cut off. Mr. 6schelbach indicated that the house along Park Way would appear to be a one-story house, and that views should not be affected by it. She requested to know if the garages would face onto Palm Avenue. Mr. Eschelbach said they both would face onto Palm. Mr. Carnesecca requested to know if the lots would meet all City codes and requirements. Secretary Hale stated that the lots do meet all City codes. Claire Tachy, a resident on Park Way, requested to know what the side yard setbacks would be. Secretary Hale said there would be 10 feet on Park Way and five feet each on the sides between tRe two structures. Commissioner ~1ullin noted that Penna Realty had a sign located on the site and asked Mr. Eschelbach if this sign were authorized by him. Mr. Eschelbach stated that he is the owner of the property and that Penna Realty was not authorized to have a sign on that site. There was some discussion on the necessity of bringing such matters before the Planning Commission. Mr. Eschelbach noted that he felt this could be decided at staff level. Commissioner Mullin explained that there were very few such lots left and each one should be examined by the Planning Commission for their decision, and the Commission concurred. A gentleman from the audience expressed his concerns over this application opening the door for others to come before the Commission with applications for higher buildings, etcetera. Secretary Hale explained that this could happen, but that each application would be reviewed by the Planning Com- mission for conformity with City ordinances and codes and the effect on surrounding properties. Commissioner Bertucelli moved that V-76-l93 be approved subject to all of the conditions of the staff report. Vice-Chairman Teglia seconded the motion and it was passed unanimously. - 3558 - May 1 7, 1 976 PM-76-l30 PM-76-l30, a request of Alfred Callegari to create one parcel from three existing parcels located at 835 Olive Avenue in the R-3 Zone. Secretary Hale presented the staff report. Proponent: Mr. Alfred Callegari 541 Grand Avenue South San Francisco, CA 94080 Opponent: None Commissioner Bertucelli asked Mr. Callegari what his building plans were. Mr. Callegari stated that he was planning on building on the whole parcel, depending upon financial assistance. He stated that if he could not build on the whole parcel immediately, then he would build on half of it and build on the other half later. He also stated that if he built on the whole parcel he would be tearing down the old existing structures. He said he was planning on building 14 units. Commissioner Mullin asked staff if at the time the Use Permit application was brought before the Commission, the Commission could impose a condition stating that all the old existing structures be removed. Secretary Hale said that this could be done at that time. Commissioner Hale moved that PM-76-]30 be approved subject to all the conditions of the staff report. Vice-Chairman Teglia seconded the motion and it was passed unanimously. COMMUNICATIONS Chairman Slade noted to the Commission that he had received an invitation extended to a 11 the Commi ss i oners for theYf\nnua 1 Di nner of the Bay Area Council to be held on Tuesday, June 1, 1976. RESOLUTION NO. 2187 Resolution of the Planning Commission of the City of South San Francisco commending Homer V. Hale for his dedicated services as Chairman of the Planning Commission. "WHEREAS, on May 13, 1975, the Planning Commission of the City of South San Francisco elected Homer Hale to serve as Chair- man of the Commission; and WHEREAS, Chairman Hale has provided dedicated service during his term of office, representing the interests of the citizens of South San Franc~sco in planning matters to promote a more desir- able living environment; and _ ~!:;!:;a _ Resolution No. 2187, cont'd May 1 7, 1 976 WHEREAS, the City of South San Francisco Planning Commission wishes to commend Homer Hale for his professional and dedicated services to the community of South San Francisco; and WHEREAS, the Planning Commission recognizes the abilities and leadership qualities of Homer Hale as demonstrated during the period of August 7, 1972, to May 13, 1975, as a Commissioner and during the period of May 13, 1975, to May 11,1976, as Chair- man of the Planning Commission. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of South San Francisco does hereby express its appre- ciation to Homer Hale for his dedicated and outstanding services to the community as Chairman of the Planning Commission of the City of South San Francisco during 1975 and 1976, and that the Secretary is hereby directed to spread this resolution across the minutes of the Planning Commission." Commissioner Mathewson introduced the resolution and it was adopted by a unanimous roll call vote. GOOD AND WELFARE Commissioner Mullin noted to staff that there is some construction at 878 Olive Avenue and asked if the City was aware of this. Zoning Administrator Costanzo said the City was aware of it and that it met codes. The Commission asked for a progress report on Colina. The Zoning Adminis- trator said Colina had been notified to remove their signs, but tmat they had not gotten in touch with him since. He noted that the $500 bond posted by Graphicom might have to be used to remove these signs. He further stated that there had been additional progress toward development of the project. Commissioner Mullin asked about the bus system. He noted that they seemed to be very dirty and very noisy, and that some of the buses seemed to be old buses. Secretary Hale stated that the buses should always be cleaned before putting them on the route. He further stated that diesel buses are noisier than non-diesel buses, but that there is nothing that can be done about that. He further stated that with the takeover of the system by the San Mateo County Transit District, the City would probably be seeing more of the old type back-up buses. ' Commissioner Goldberg inquired about the Downtown Study and the Sign Ordin- ance study. Secretary Hale stated that a progress report of the Downtown Study would be presented at the next meeting, but that the Sign Ordinance study was backlogged. The Commission expressed quite a bit of concern over the elimination of the Assistant Planner position, noting that it could possibly hamper the func- tioning of the Planning Division and consequently of the Planning Commission. - 3560 - Good and Welfare. cont'd May 17 t 1976 They noted that it is up to Council to make such decisions, but that it is the duty of the Planning Commission to advise the Council of matters relating to planning, which this is. The Planning Commission directed staff to report back to the Commission at the next meeting with a report on the work load of the Planning Division and the impact on that Division if present staff should be reduced. Secretary Hale said he would have that report for the next meeting. There being nothing further under Good and Welfare and no further communi- cations or matters of interest for the Commission, Chairman Slade announced that the next regular meeting of the Planning Commission would be held on May 25, 1976, at the El Camino High School Little Theater, at 8:00 p.m. The meeting was adjourned at 10:40 p.m. Wesley Slade, Chairman Planning Commission City of South San Francisco ~c David C.
