Vice-Chairman Goldberg moved that the minutes of the regular meeting of the South San Francisco Planning Commission of May 24, 1977 be approved. The motion was seconded by Commissioner Campredon and was passed by the following roll call vote: AYES: Vice-Chairman Goldberg, Commissioners Bertucelli, Campredon Mullin and Chairman Teglia NOES: None ABSENT: Commissioner Mathewson ABSTAINED: Commissioner Slade ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Teglia announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission to be heard, but who objected to having his or her voice recorded in this manner, could request the Chairman to order the tape recorder turned "off" for the duration of the time that he or she is speaking or is heard. - 3777 - June 14, 1977 UP-77-393, UP-77-388, V-77-199 & PM-77-145 UP-77-393, an application of Oyster Point Associates to establish a live-in security quarters at #1 Oyster Point Boulevard. UP-77-388, an application of Foster & Kleiser to relocate two off-site adver- tising structures located east of and adjacent to the Bayshore Freeway, approxi- mately 2600 feet north of Oyster Point Boulevard. V-77-199, an application of Oyster Point Associates for a reduction of the required minimum lot width for the parcel located at #1 Oyster Point Boulevard. PM-77-145, an application of Oyster Point Associates to create one parcel from two existing parcels on property located at #1 Oyster Point Boulevard. Secretary Costanzo presented the staff report for the above mentioned applica- tions, noting that Cal Trans has indicated the construction of the road adjacent to this area, if possible, thus, a continuation of these matters would not be necessary. Proponents: Mr. Robert Smith representing Oyster Point Associates Mr. Walt Moreno representing Foster & Kleiser Opponents: None Vice-Chairman Goldberg asked if Cal Trans had commttted themselves to this road. Secretary Costanzo indicated that they have deemed this right-of-way feasible, therefore, they are willing to dedicate this right~of-way to South San Francisco. He indicated that their policy is that. they participate with local jurisdictions in the construction of the road, but since they do not have funds for this, they will provide services in lieu of the funds. He also noted that the two off-ramps are under study, but that more study is needed on the specific impacts and that something should be forthcoming within the next 30 to 45 days. Commissioner Mullin asked if there possibly would be no direct access from Oyster point Boulevard to Sierra Point. Secretary Costanzo said that just the opposite is the case. He stated that the right-of-way is about 40 feet, curb to curb, which is enough for two lanes in each direction, or a left turn stack- ing lane. He stated that Oyster Point would be willing to dedicate 10 feet to the City, making the right-of-way 50 feet instead of 40. Commissioner Bertucelli asked for a time frame on the completion of the right- of-way. Secretary Costanzo said improvements are not paid for by the City, but by the developers. He stated that access to this property would be from the new frontage road which would possibly take two years to complete. He further noted that the frontage road would run parallel to Highway 101 but that there had been a question as to who would pay for it. He noted this would be the responsibility of the developers. Mr. Bob Smith stated that he is not concerned if the road is constructed or not, but that if it is, he would pay his fair share. - 3778 - UP-77-393, UP-77-388, V-77-199 & PM-77-145, continued June 14, 1977 Commissioner Mullin noted that this type of development would not lend itself to a substantial increase in traffic. He asked what type of traffic would be generated with this type of warehouse. Secretary Costanzo said traffic would be very minimal as there would be long term storage which would not generate a constant flow of traffic. Commissioner Mullin asked how closely tied the Foster & Kleiser application for the signs was to the other applications. Secretary Costanzo indicated that there are two signs on Highway 101 adjacent to Southern Pacific lines. Now Foster & Kleiser was building two new permanent steel billboards that would go up 55 feet into the air and cantilever over the S.P. lines which signs would have an amortization of 55 to 65 years. He noted that if the City adopts a strong sign ordinance or if Cal Trans landscapes the freeway or street, then the City might have to buy the billboards under California state law. He felt that the location of the billboards under the S.P. right-of-way is inconsistent with what the City is trying to achieve. Mr. Walt Moreno noted that'they had a 30 day lease with the Southern Pacific Railroad Company which can be terminated with 30 days:notice, however, he noted that they have good public relations with S.P. and he did not see this happening. He further indicated that in San Francisco in 1965 many of the signs along 101 were grandfathered for life and some of theirs they had fought for to be grand- fathered also. He did indicate that they removed around 137 signs at that time. Vice-Chairman Goldberg asked what the cost of relocating the signs would be. Mr. Moreno said about 35,000 to 40,000 dollars for each sign. Mr. Moreno stated that if the billboards interfere in ,any way with a potential project, the billboards would come down. Commissioner Goldberg noted that he is more concerned with the signs being a sore thumb to the City sometime down the road. Chairman Teglia said she does not object to these signs because of what is there now. She asked why a use permit could not be worked up giving a temporary stand- ing to these signs. Secretary Costanzo said that that seems reasonable. He noted that whenever a development of this magnitude is being proposed, there should be overriding public benefits that come to the City besides the revenue and if the Commission agrees, he would request that the copy of those billboards be restricted to advertising services and businesses located within South San Francisco. Mr. Moreno said he would be happy to put up anything the City wished. He noted that they have other billboards in the City for public services and noted that they have done many signs free of charge for any worthwhile cause. Vice-Chairman Goldberg asked if the clause about removing the signs if they get in the way applies also to these two existing signs. Mr. Moreno said it does not, but that the two existing signs must be removed and that the purpose of this use permit is to relocate them. Vice-Chairman Goldberg asked if the other permits are contingent upon the approval of this permit, as he would like to restrict the usage of these signs and would like staff to check with the City Attorney on the legality of doing this. He further noted that he would like strong conditions imposed on this permit, assuring the City can remove the signs if they become a nuisance. - 3779 - UP-77-393, UP-77-388, V-77-199 & PM-77-145, continued June 14, 1977 Chairman Teglia noted her agreement to check with the City Attorney on the legality of restricting the usage of these signs. Secretary Costanzo said the City would possibly have to contend with a restraining order if the City tried to go onto the property to remove these signs, even with written per- mission from the property owner. Commissioner Mullin indicated that he had driven through this area and had noted that the City is swamped with signs. He indicated that the Commission would eventually have to vote "yes" or "no" on this permit and he would like to do it at this meeting. Commissioner Slade indicated that he felt a vote would be in order, but that he could not see where the signs would adversely affect this area now or in the future. He stated that when development of that area is discussed, it could be 10 or 20 years down the road. Chairman Teglia asked Mr. Moreno if he would object to a couple of weeks delay in order to look at possible legal wording. Mr. Moreno said he would not. Vice-Chairman Goldberg moved that UP-77-388 be continued to the Planning Com- mission meeting of June 28 to allow enough time for staff to meet with the City Attorney for legal counsel. Commissioner Bertucelli seconded the motion and it was passed by the following roll call vote: AYES: Vice-Chairman Goldberg, Commissioners Bertucelli, Campredon, Slade and Chairman Teglia NOES: Commissioner Mullin ABSENT: Commissioner Mathewson Vice-Chairman Goldberg moved that the Negative Declaration for PM-77-145 had been 'reviewed and considered by the Planning Commission. Commissioner Campre- don seconded the motion and it was passed unanimously. Vice-Chairman Goldberg moved that UP-77-393 for the live-in security quarters be approved with the addition of Special Condition #2: "That this use permit shall stand approved upon the completion of construction of the development approved by the Architectural Committee under DP-76-112 and the removal of the two off-site advertising structures." Commissioner Mullin seconded the motion and it was approved unanimously. Commissioner Campredon moved that V-77-199 for the reduction of the minimum lot width be approved. Commissioner Bertucelli seconded the motion and it was passed unanimously. Vice-Chairman Goldberg moved that PM-77-145 to create one parcel from two be approved with the addition of two special conditions: "That the property owner shall dedicate up to 10 feet along the entire length of the westerly property line when a future frontage road is developed between Oyster Point Boulevard to that area known as "Sierra Point" adjacent to Highway 101"; and "That the property owner shall pay his fair share of any road costs for said frontage road and shall deposit with the City Engineer a cash depositor security bond or other surety to guarantee the future installation of this road." Commissioner - 3780 - UP-77-393, UP-77-388, V-77-199 & PM-77-145, continued June 14, 1977 Slade seconded the motion and it was approved unanimously. UP-77-394 An application of San Francisco Neon for a Use Permit to install 160 square feet of new sign copy to an existing freestanding sign and the addition of 30 square feet of sign copy to an existing pole structure at 264 South Airport Boulevard. Secretary Costanzo presented the staff report, reading into the record the special conditions. Proponent: Mr. Burton Lauderson representing San Francisco Neon Opponent: None Mr. Lauderson noted that he agreed and accepted all of the conditions with the exception of Special Condition #3 relating to the monument sign. He noted that it would block the driveway to the pumps. It was agreed to strike the second sentence ofSp~cial Condition #3, leaving the condition to read that this sign shall not be permitted. Commissioner Slade moved that the Planning Commission had reviewed and con- sidered the Negative Declaration to UP-77-394. Commissioner Campredon seconded the motion and it was passed unanimously. Commissioner Slade moved that UP-77-394 be approved subject to the conditions and limitations of the staff report, with the above noted change in Special Condition #3. Commissioner Bertucelli seconded the motion and it was passed uanimously. RESOLUTION NO. 2213 UP-77-395, SA-77-39 & RZ-77-40 UP-77-395, an app'lication by Albert Seyranian to construct eight single family homes and a 42 unit apartment complex on property located on Holly Avenue at the terminus of Westview Drive, approximately 250 feet north of Mission Road. SA-77-39, an application by Albert Seyranian to create eight R-l single family parcels and three R-3 multiple family parcels on the same property as noted above. RZ-77-40, an application of Albert Seyranian to rezone one-half of the above noted property from R-l single family residential to R-3 restricted multiple family residential in the R-l single family zone district. Secretary Costanzo presented the staff report, noting that the applicant has elected to come in under a pun and that they could actually develop this with - 3781 - UP-77-395, SA-77-39 & RZ-77-40, cont'd June 14, 1977 just the approval of the Subdivision Map and rezoning application. He read into the record the special conditions for the use permit. Proponents: Mr. Albert Seyranian San Francisco, CA Donald Seyranian Daly City, CA Leon Seyranian Oakland, CA Opponents: David Jerief 217 Westview Drive South San Francisco, CA Wayne Hess 1113 Sunnyside Drive South San Francisco, CA John Falsarella 282 Westview Drive South San Francisco, CA Douglas Butler 133 Adrian Avenue South San Francisco, CA James Keegan 1244 Crestwood Drive South San Francisco, CA Audrey Craig 230 Westview Drive South San Francisco, CA Mr. Jerief stated his opposition to these applications and presented a petition to the Commission which had been circulated through the homeowners of Sunshine Gardens opposing these applications. The basis for their objections was that traffic congestion on Holly Avenue was already heavy and this development would generate even more, as well as generating more on-street parking on Holly Avenue. Mr. Jerief stated that apartments should not be allowed in an R-l Zone. He noted that he felt the project would not blend with the existing neigh- borhood. Mr. Hess stated three objections to the proposed development: 1) that this would generate additional congestion, both with traffic and people; 2) that architecturally, it does not blend in with the community; and 3) that crime would be a problem as in every apartment complex. He stated that Sunshine Gardens does not want these units and they are not needed. Mr. Butler stated that every vacant plot is subject to down grading as far as zoning changes are concerned. He feels these apartments are proposed only because of the existing apartments there now. He stated that an R~l neighbor- hood should be kept R~l for those people who have put their savings and lives - 3782 - UP-77-395, SA-77-39 & RZ-77-40, cont'd June 14, 1977 into tha t nei ghborhood. Mr. Falsarella stated that there are a lot of apartment buildings being con- structed and that somehow Sunshine Gardens has been picked as the area for apartments. He stated that building codes in this City are not as tough as in other cities. He stated that there are a number of property owners who did not receive notices of the hearing and that he had not seen a posting on the site. He felt the residents of Sunshine Gardens were being "sold down the river." He felt absolutely nothing other than single family homes should be put into that area. He stated that someday some developer will be able to find a design for these single family units. R-3 would be a down- Mr. Keegan felt with so many apartment building being built in South San Fran- cisco that there would soon be a case of over-building. He felt the building of these apartments would severly impact the single family area in terms of traffic generated and on-street parking. He stated that it would be worse to live across from apartment buildings than to live abutting them. Ms. Craig stated that the apartments already there do not have windows facing on the proposed property, so that any single family home built there would not have people from the apartment building looking down on them. She stated that she does not need nor want these apartments. Mr. Donald Seyranian stated that he believes this project will blend in with the area and will be an improvement. He also stated that the construction will occur in two phases, starting at the one end of the single family homes and including one apartment building. After these are complete, construction will begin on the other two apartment buildings. He stated that construction would be continual, with no break, but that the single family homes would be constructed first. Mr. Costanzo noted that he would not accept this as he did not want single family home purchasers to be unaware that apartment houses were being constructed across the cul-de-sac. Mr. Seyranian stated that there would be a real estate report that each purchaser would have to sign before any monies are collected for deposits stating that this is one project and that the apart- ment buildings will be constructed there. He further stated that they are putting a lot of energy into making these buildings aesthetically pleasing and of quality workmanship. Mr. Leon Seyanian stated that this particular area is designated as medium- high density in the General Plan. He stated that the extreme depth of the property makes a cul-de-sac the only economical approach to developing this area. He further stated that parking has been adequat~ly designed into the project, so that there shou-ld not be any overflow parking onto Holly Avenue. Vice-Chairman Goldberg noted that there is a hole in the back of the property and an eight to ten foot hill in the front. He asked what the developer is planning to do with this. Al Seyranian stated that they are taking some of the grade and spreading it across the property to the back to smooth it out, which will put it below the southwesterly apartment unit. He noted that the cul-de-sac street will drop at an even rate. Vice-Chairman Goldberg asked what the highest height would be. Mr. Seyranian stated about 32 feet. - 3783 - UP-77-395, SA-77-39 & RZ-77-40, cont'd June 14, 1977 Vice-Chairman Goldberg noted that one condition imposed on the use permit is that the developer eliminate five units and increase the parking by one-half for each two-bedroom unit. Mr. Al Seyranian stated that this was acceptable. He further stated that he would like to work with staff to reach a workable solution to the parking. Commissioner Slade requested to know why the idea was abandoned of all single family units for that area. Don Seyranian stated that the cost of the land and installation of the cul-de-sac were very high and that the General Plan did not designate this area for only R-l. Al Seyranian stated that he knew they would have some problems with this type of design, but that they were suffering the impact of the apartments with the single family residences across the cul-de-sac. Chairman Teglia asked if they would consider another kind of mix, such as duplexes or triplexes. Don Seyranian said the property only has a square foot frontage of 50 feet. Al Seyranian said duplex lots would be economically totally infeasible. Secretary Costanzo noted that the yield if triplexes were constructed would only be about 32 units. Commissioner Slade noted that we are starting with a false premise in that this area is zoned R-l and R-3 development is not permitted there. He stated that because there are some there now does not necessarily mean that we have to continue putting apartments there. He indicated that this same configura- tion could be used for single family residences. He noted that there would be additional traffic problems and congestion. He also noted that the exis- ting apartment building in this area would lend itself to satisfying the medium density requirements of the General Plan. Al Seyranian stated that economic- ally they could not construct all single family residences. Commissioner Bertucelli stated that when Sunshine Gardens was developed it was supposed to be a single family area and he further stated that he does not want to see apartment buildings built in an R-l single family area. Don Seyranian stated that this area is zoned R-l, but that the General Plan designation is medium to high density and that they did not intend to come in and eliminate all R-l housing. He noted that their proposal was based on the General Plan designation. Commissioner Mullin asked if they owned the property. Don Seyranian said they have an option on it. Commissioner Mullin asked Secretary Costanzo if legal notices had been sent out. He answered that the legal notice was put in the Enterprise-Journal, posted on the site and mailed to the property owners within 300 feet of the project. He stated that he could not confirm this evening if every property owner had been mailed a notice. Commissioner Mullin asked if the parking requirements were met, if there would still be a spillover into Holly or Westview. Secretary Costanzo said that the density has to be reduced by 5 units which will yield six additional parking spaces and that a guest parking lot would have to be provided for a total of around 90 spaces. He felt there would not be a spillover. Commissioner Mullin stated that he did not feel we were headed for over- building. Proponent: Eugene Rossini 399 Holly Avenue South San Francisco, CA Opponent: None Secretary Costanzo explained that the applicant had been required to move the wall in eight feet and that the area from the new wall to the originally proposed wall would be an open covered patio, encroaching into the rear yard setback. He also explained that the applicant did not feel the size of the room would be sufficient for his needs if he had to move the wall back eight feet to meet the 20 foot setback requirement, thus, the purpose of this variance. Commissioner Mullin asked the Chief Building Inspector if additions were not planned to blend with the existing building Chief Inspector Ghilardi respon- ded that this was encouraged, but was not mandated. Vice-Chairman Goldberg moved to grant V-77-200 subject to all of the condi- tions of the staff report. Commissioner Bertucelli seconded the motion and it was passed unanimously. V-77-201 An application of William Pelster for a reduction in rear yard setback from 20 feet to 15 feet on property located at 517 Del Monte Avenue in the R-l Single Family Zone District. Grand Avenue and Point San Bruno Boulevard in the M-2-H Zone District. Secretary Costanzo presented the staff report. Proponent: Mr. Don Bruzzone Cabot, Cabot & Forbes One Maritime Plaza San Francisco, CA Opponent: None Mr. Bruzzone stated that the Commission has seen this same area before, but that now they have a firm tenant and that development is beginning again. Commissioner Mullin asked if lots of little businesses were going to be the type of use in the future instead of large operations. Mr. Bruzzone explained that they are trying to meet the market place. He stated that some years it is large businesses and other years it is small businesses. He noted that the Hilltop Business Center is finally'filled up. Vice-Chairman Goldberg moved that the Negative Declaration for PM-77-148 had been reviewed and considered by the Planning Commission. Commissioner Bertucelli seconded the motion and it was passed unanimously. Commissioner Mullin moved that PM-77-148 be approved subject to all of the conditions of the staff report. Commissioner Campredon seconded the motion and it was passed unanimously. ZA-77-7 RESOLUTION NO. 2214 An application of the City of South San Francisco to amend the text of the Zoning Ordinance of the City of South San Francisco to include an additional provision to Section 4.131, subsection D, requirements for off-street parking. Secretary Costanzo presented the staff report and read into the record the proposed subsection D to Section 4.131 of the Zoning Ordinance relating to off-street parking. Further, he read into the record the Negative Declara- tion for this text change. Vice-Chairman Goldberg noted that he had done some research into this and had gotten a three year spread of motor vehicles in San Mateo County, licensed drivers and population in San Mateo County. He noted that the basic results of the study were that population was not increasing, but vehicles and drivers have substantially increas~d. - 3787 - ZA-77-7, cont'd dune 14, 1977 Commissioner Mullin asked if possibly this increase in drivers reflects the baby boom which is now ending and that with the population control, there might be a decrease in the future. He also asked if the City Attorney had seen this proposed amendment. Secretary Costanzo said that he had seen it, but that he has no comment from him. Vice-Chairman Goldberg moved that Negative Declaration on this amendment had been reviewed and considered by the Planning Commission. Commissioner Mullin seconded the motion and it was passed unanimously. Vice-Chairman Goldberg introduced Resolution No. 2214 recommending to the City Council that Zoning Ordinance No. 353, as amended, be further amended to include an additional provision in Section 4.131 related to additional park- ing requirements. This Resolution was adopted unanimously. REPORTS PM-76-138 Final Parcel Map by Stonegate Ridge Properties &E. G. Coopman to readjust lot lines in the Stonegate Ridge Planned Community area corresponding with the phase lines of the Stonegate Ridge Planned Community Zone District. Secretary Costanzo presented the staff report, noting that this Parcel Map was substantially in compliance with the Tentative Parcel Map previously approved by the Commission. Commissioner Campredon moved that PM-76-138 be approved subject to the'pre- viously approved conditions and limitations. Commissioner Bertucelli seconded the motion and it was passed unanimously. SA-76-36 Final Subdivision Map by Stonegate Ridge Properties & E. G. Coopman creating 13 air space condominium lots on property located on the west side of Stone- gate Drive, approximately 1000 feet south of Hillside Boulevard, in the Planned Community Zone District. Secretary Costanzo presented the staff report, noting that the final map is substantially in compliance with the previously approved tentative map. Commissioner Bertucelli moved that SA-76-36 be approved subject to all of the previously approved conditions and limitations. Commissioner Campredon seconded the motion and it was passed unanimously. - 3788 - June 14, 1 UP-76-370 Request of the applicant and the City Attorney for the Planning Commission to untable and set a date for the continuance of this application to estab- lish an automobile body and fender repair shop in the C-3 Zone District at 619 Airport Boulevard. There was some discussion on untabling this matter and who had tabled it originally. The Commission requested staff to determine which Commissioner tabled this matter. t1r. William Daley, attorney representing the applicant, stated that there was a hearing where Brincat lost and he further requested that this matter be heard as soon as possible. The Commissioners unanimously agreed that this matter should be brought back to the June 28, 1977, study session with a full report on the status of this matter and with knowledge of who tabled this matter originally. COMMUNICATION~ Secretary Costanzo presented a report to the Commission requesting that they take action to abandon a storm sewer easement and readjust the alignment of IIC" Street, and make this recommendation to the City Council. After a brief discussion on this matter, Commissioner Campredon moved that this abandonment and realignment take place and that their recommendation be sent to the City Council. Vice-Chairman Goldberg seconded the motion and it was passed unanimously. Secretary Costanzo presented a report to the Commission requesting that they find that the acquisition of a lot at the corner of Produce Avenue and Colma Creek by the County Flood Control District is in keeping with the General Plan of the City of South San Francisco. Vice-Chairman Goldberg moved that this aGquisition is in keeping withr the City1s General Plan. CommissionerSlade seconded the motion and it was passed unanimously. Secretary Costanzo made reference to a memo distributed to the Planning Com- mission on Planning Fees. He noted that this ma would be on the June 28, 1977, meeting agenda for a recommendation back to the City Council. Secretary Costanzo made reference to a letter from to the Crocker Bank regarding repairing of their building en Grand Avenue. He noted that Crocker will int the building and will stucco a window area. - 3789 - Communicat~?~ contld June 14, 1977 Secretary Costanzo noted to the Commission that there is a possibility of a grant through EDA only for those cities that have lost major manufacturing plants like Bethlehem Steel. He stated that $50,000 may be available and that staff was looking into the poss i bi 1 i ti es ofbbta.irri ng it. Secretary Costanzo presented a brief history on the Snyder construction in the Westborough/West Park #2 area. He stated that the Commission need not take action, but that this would be a case for the Homeowners I Association to alleviate the problems that exist there since they go against the C.C.& R. IS, not the City's codes. Secretary Costanzo gave the Commission an update on the Sphere of Influence Study. He indicated that the County had ascribed the Sphere of Influence to South San Francisco and that annexation would occur before the completion of construction. He noted tha~ otherwise this could cause some problems since the developers could put a lot of pressure on the County for occupancy before the annexation occurred. He noted that if the City chose not to annex, this development would still present a burden to South San Francisco. Secretary Costanzo noted that the Draft Sign Ordinance would be brought to the Commission at the June 28, 1977, study session. He further noted that the General Plan update study was proposed to be brought to the Commission at the June 28 study session. GOOD AND WELFARE Chairman Teglia presented a plaque mounted with the gavel used by the former Chairman, Wesley Slade. The Commission also presented him with a Resolution commending him for his services while Chairman and noted their deep apprecia- t ion to him.
