San Francisco Planning COll@ission of July 24, 1979 be approved. TIle motion was

The Commission discussed the compliance with Planning COll@ission Condominium Conver-
sion Policies. Cormnission concurred to delete Special Condition #1 -, ,to keep parking
space #8.
COll@issioner Hoyer moved that UP-79-492, BA-79-55 and Negative Declaration #210 be
approved subject to all conditions and limitatioIls, deletion of Special Condition #1
included.
Secretary Christians recoll@ended that since the Planning Commission deemed appropriate
to approve this application, it be based on the 6 (six) findings noted in the staff's
report.
COll@issioner Bertucelli seconded the motion, witlt Secretary Christians' recoll@endation,
and was passed with a unanimous roll call vote.

Mr. Rodine read into the record a letter from Southern Pacific Railroad in regards
to their policies on their lease.
Mr. Ferrario came before the Commission and noted theparwing problems that exist
in this area.

Conversion Policies.
The COll@ission, staff and applicant commented on'pros and cons with regards to the
parking spaces.
Vice-Chairman Mantegani moved that SA-79-56 and Negative Declaration #213 be denied
based on the recommended findings and the motion was seconded by Commissioner Getz.
Secretary Christians read into the record that the following findings are based on
the testimony and evidence submitted in this public hearing and in previous public
hearings on this case:
1. That this proposed condominium conversion is not consistent with the intent
and purpose of Ordinance #692-75 of the City of South San Francisco.
2. That this proposed condominium conversion project is inconsistent with the
General Plan and Housing Element of the City of South San Francisco adopted
January 1969, and subsequently amended.
3. That the amount of permanent parking spaces on this site is not consistent
with the minimum parking standards of the Residential Planned Development
Ordinance #770-78 adopted on August 2, 1978, and designed to regulate the
standards and design criteria of planned developments within South San
Francisco.
The denial was passediby the following roll call vote:

Getz, Grimes and Martin.
NOES:

The permittee was advised that an appeal to this decision may be filed on or before
August 24, 1979, and that this matter would then be heard by the City Council of

Mr. Rodine indicated to the COil@ission the feasibility that the existing apartment
building had to be converted into condominiums.
Mr. Ferrario indicated the similar parking problems existing in this area.
Vice-Chairman Mantegani and COll@issioner Getz advised this project did not meet the
25 unit minimum requirement in the Condominium Conversion Policy.
Vice-Chairman Mantegani moved that SA-79-57 and Negative Declaration #213 be denied
basedilon the recommended findings as SA-79- 56. The motion was seconded by Commis-
sioner Getz.
COll@issioner Getz recoll@ended that additional findings #4 be added to read:
"4. That the proposed project does not comply with the 25 unit minimum which
is part of the Condominium Conversion Resolution No. 2258 after consider-
ing, but not limited to standards and suggestions set by the Executive
Council of Homeowner's Association of San Jose."
The denial was passed with a unanimous roll call vote.
The permittee was advised that an appeal to this decision may be filed on or before

Mr. Rodine referred the Commission to Jack Doty Company, they are experts in the
field of setting up condominium homeowners associations, budgets and establishing
the functional mechanisms inwhich to run those associations. He also referred
them to Mr. Harry Browning who is a prominent CC&R's writer.
Commissioner Getz and Vice-Chairman Mantegani noted this project did not meet the
25 unit minimum required in the Condominium Conversion Policy.
Vice-Chairman Mantegani move that SA-79-58 and Negative Declaration #214 be denied
based on the recoll@ended findings as SA-79-56 and SA-79-57. The motion was seconded
by COll@issioner Grimes. The denial was passed by a unanimous roll call vote.
The permittee was advised that an appeal to this decision may be filed on or before
August 24, 1979, and that this matter would then be heard by the City Council of the
City of South San Francisco.

scaping, fencing and other related concerns.
Staff presented report.
Staff and COll@ission discussed the damaged trees per the photographs presented. Staff
report included a letter to Mr. Bob Gooyer from Acting City Planner dated 6/29/79;
letter to Assistant Planner from Mr. Kenneth D. ~fuyer of Leslie S. Mayne Associates
dated 7/6/79; and Inter-Office memorandum to Assistant Planner from Mr. Glen Runge,
Park Supervisor of Parks and Recreation Department, dated 7/27/79.

Mr. Robinson indicated to the Commission his concerns with the wall that was put up,
advised that this wall was to be continued around the church's property and he would
also like to see the calculations on this wall.
Staff responded to all his concerns and advised Mr. Robinson that as soon as calcula-
tions come in for the wall, he would be notified.
Cormnissioner Martin moved that based on the reports submitted and the public testimony,
it is determined that the following course of action shall be taken on UP-78-455:
1. That the developer shall remove the two damaged Monterey Cypress trees.
2. That prior to any occupancy, the developer shall replace the two damaged
trees with two minimum 48" box trees of the same species, i.e. "Cupressus
Mocrocarpa", in the same location.
3.
That any additional money, based on the damage value, $2,035 shall be
used to install the largest possible specimen trees either side of
the entrance driveway on El Camino Real.
COll@issioner Getz seconded the motion and was passed with a unanimous roll call vote.

Mr. Avanessian questioned the Fire Department's Tequest for three fire hydrants,
and asked the COll@ission if it was possible that landscaping in the rear of the
building not be necessary.
The Commission, applicant and staff discussed the landscaping on this project.
Commission concurred to delete the words "and north" from Special Condition #lB
to read: "1. B. Addition of a minimum 6'-0" landscape strip along the east
property line adjacent to the parking and turnaround area."
COll@issioner Getz moved that UP-79-507 and Negative Declaration #226 be approved
subject to all the conditions and limitations including amended condition #lB.
Commissioner Bertucelli seconded the motion and was passed with a unanimous roll
call vote.

Mr. Avanessian indicated to the Commission concerns with Special Condition #2 and
asked it be revised to have trash kept inside the building.
Staff recommended Special Condition #2 be reworded to read:
"2. That the applicant shall provide sufficient enclosed trash areas or guaran-
tee, through lease agreement, that all trash be kept inside the buildings."
Cormnissioner Martin moved that UP-79-508 and Negative Declaration #227 be approved
subject to all the conditions and limitations including amended Special Condition #2.
Commissioner Grimes seconded the motion and was passed with a unanimous roll call vote.

COll@issioner Hoyer moved that UP-79-509 and Negative Declaration #228 be continued
off-calendar to allow applicant more time to revise elevation plans. COll@issioner
Getz seconded the motion and was continued off-calendar with a unanimous roll call
vote.
NOTE: Cormnissioner Getz advised during the 10:30 break that he would
have to be leaving at that time.

Mr. O'Brien reviewed staff's seven concerns noted in the staff report. Asked the
COll@ission for occupancy if approved prior to the completion of the access road
along the property line.
Mr. Stagnaro commented on the improvement this project will be to the property.
Commissioner Grimes commented on the landscape conditions and asked if this could
be included in the Special Conditions as to type of plant life to be installed.
Staff recoll@ended that the COll@ission review the Use Permit in two years and a
detailed environmental mitigation program be prepared for review. These points
were further discussed with tIle conclusion to amend the following Special Condi-
tions:
"1. This Use Permit shall expire three (3) years, with review after one (1)
year, from the date of approval. The Planning [email protected].

2. A detailed landscape plan shall be submitted for review and approval by
the Design Review Board and all landscaping shall be completely installed
to staff's satisfaction within 90 days of tIle d(lte of approval.
3. That any adverse effects caused by this use including, but not limited to
dust, noise, or effects on animal or plm1t life shall be adequately miti-
gated by the applicant.
9. An access road, as shown, shall be installed to the satisfaction of the
City Engineer and Fire Department prior to initiation of this use."

Mr. Scopesi asked if the landscaping could be provided in the front instead of the
rear of the property to meet the requirements of the Planning COll@ission?
The COll@ission, staff and applicant further discussed the landscaping, pros and cons
with regards to redwood slats in the chain link fence, and whether or not parking
was sufficient for the proposed use.
Officer Moran of the Police Department recoll@ended other alternatives to the redwood
slats for protection purposes.
Staff recoll@ended that Special Condition #4 be reworded to read:
"4. If there is any outdoor storage, it shall be confined and limited
to a location approved by the City Planner and sufficient measures
shall be given to reduce the height and buffer by landscaping."
COll@issioner Grimes moved the UP-79-5ll and Negative Declaration #230 be approved
subject to all the conditions and limitations to include amended Special Condition #4.

Staff indicated the long expressed concern from Planning COll@ission and City Council
for additional parking especially for mul tiple--family developments.
COll@ission and staff discussed the alternatives on l~ parking space to 1 unit and
2 parking spaces to 1 unit.
Therefore, staff recoll@ended that the Planning Commission set a public hearing date
to consider the parking standards by introducing Resolution #2259. COll@issioner
Bertucelli introduced Resolution #2259 to set a public hearing date of September 11,
1979, for adoption and recoll@endation of a Resolution on Parking Standards to the
City Council.
Resolution #2259 was introduced and adopted by the following roll call vote:

Secretary Christians noted:
1. That the League of California Cities was having. an Annual Conference in
San Francisco, and anyone wishing to atter~ is to contact Chairman Campre-
don who received the regist~ation forms.
2. That Chief Building Inspector, Roy Ghilardi, of the City of South San Fran-
cisco will be retiring as of September 4, 1979. A dinner in his honor will
be held on September 6, 1979, and reservation slips have been included in
your packets.
There being nothing to discuss under Good and Welfare, Chairman Campredon announced
that the next regular meeting of the Planning Commission would be held on September
11, 1979, (and reminded that meeting for August 28, 1979 had been cancelled), at
7:30 p.m. in the West Orange Library Auditorium,.
The meeting was adjourned at 12:00 Midnight.
