Call to Order 6:30 p.m. 2. Roll Call Present: Councihnelnbers Addiego, Gonzalez and Matsumoto, Vice Mayor Garbarino and Mayor GFoon Fernekes (colTected at 3/8 Council meeting) Absent: None Staff present: City Manager Nagel, City Attorney Mattas, and Assistant City Manager Van Duyn; Departlnent heads: Valerie SOlnmer, Jiln Steele, Sharon Ranals, and Terry White; Staff members: Ray Razavi, Norma Fragoso, Bob Hahn, Colleen Tribby, and John Neal Others present: Rick Williams, Van Meter Williams Pollack; Heather Murtagh, Daily Journal; Christine Tejada, Genentech; John Rubin, Peninsula Coalition; Mary McMillan, San Mateo County Deputy Manager; and Kevin Griffith, BRIDGE Housing 3. Public COlnlnents Ms. McMillan, representing San Mateo County, objected to the City entering into an econOlnic incentive agreelnent with Northwest Airlines as there is a loss of approxilnately $500,000 in sales tax revenue to the County over a two-year period. (Fax from the County of San Mateo to the City of San Jose was distributed to Council.) 4. Study Session: a) Oak Avenue street ilnprovements Assistant City Manager Van Duyn gave a brief overview of the project and asked that Council provide direction on the proposal to allow street parking along Oak Avenue or to reconfirm its previous position to prohibit street parking in front of the Grand/Oak development. Mr. Rick Williams highlighted elelnents of the proposed street ilnprovelnents and expansion to include landscaping and a continuous paving on Oak Avenue between Grand Avenue and Mission Road. He stated that the Grand/Oak project does have sufficient on-site parking for its tenants and visitors, but the street will be wide enough to accolnlnodate street parking and that it was a better strategy to allow it. Councihnan Gonzalez stated concelll regarding the left turn onto Grand Avenue frOln Oak Avenue and that a stop sign Inay be warranted. Staff responded that it will be further evaluated. Councilwolnan MatsuInoto stated that it was the subcOlnInittee's recommendation to not allow street parking for the purpose of developing a neighborhood and not a thoroughfare. She questioned the process and why this issue was not brought up at the subcomlnittee Ineetings. Councihnan Addiego stated support for on-street parking, but expressed concern with the left turn onto Grand Avenue. Mr. Willimns explained that the current grading will be reconfigured (reverse slope) to allow a clearer view of oncOlning traffic in both directions. Vice Mayor Garbarino questioned the loss of the diagonal parking spaces in front of the Jehovah Witness's Church, but agreed that aesthetically it will ilnprove the street aligmnent. Mr. Williams stated on-street parallel parking is being substituted. Mr. Griffith substantiated Mr. Willimns's COInInents that the BRIDGE housing project has sufficient parking, but there was the concern of tenants parking in front of the Oak Fann developlnent that Inay lead to problems. Mayor Fernekes questioned if parking would be available at the courthouse site and staff indicated that access was not available but it could be looked into. Councihnan Addiego cOInInented that the street would look In ore like a neighborhood if it included curbside parking and an open boulevard looks In ore like a thoroughfare. He noted that the proposed landscaping benefits the entire neighborhood. The majority of Council (4-1) concurred to go with the option to prohibit street parking at this time, to evaluate any problelns froln overflow parking from the church, and to do a six-Inonth review. Mayor Fernekes announced that Item 4.c would be taken next for discussion. c) Presentation regarding draft Northwest Airlines/N orthwest fuel agreement Staff report presented by Assistant City Manager Van Duyn and City Attorney Mattas. Staff stated that if Council wished to pursue the agreeInent then discussions would continue, but if there was no interest then discussions would terminate. SPECIAL CITY COUNCIL MEETING MINUTES FEBRUARY 15,2006 PAGE 2 Mayor Fernekes requested that staff research the City's history related to the City receiving local sales tax on jet fuel before the tax moved frOln one county to another, and thought it might date back to the 1970' s. Councihnan Addiego spoke in opposition to the agreeInent. He stated that it was an attractive offer, but there was a financial iInpact on the County and the ultin1ate hann to the working relationship with the County may exceed the benefits. Vice Mayor Garbarino asked that the 65% rebate be negotiated to a lower amount. Staff stated the suggestion can be explored. Councilwolnan MatsuInoto requested a legislative counsel opinion be obtained. Council continued its discussion of the loss of revenue the County would sustain. Ms. McMillan explained the history of the local sales tax on jet fuel and how it was lost. Mayor Fernekes requested that staff put the infonnation into a doculnent and it be given to Council. Councilmembers Gonzalez, MatsuInoto and Mayor Fernekes concurred with Vice Mayor Garbarino's suggestion to negotiate a lower percentage and seek legislative counsel opinion. Councihnelnber Addiego stated he was not in favor of continuing negotiations. Mayor Fernekes also suggested that staff explore with the County the option of partnering with the City for assistance since the fuel tanks are being housed in South San Francisco. He asked that the requested infonnation be brought back to the Council as soon as possible. b) Mid-year financial update and resolution amending the 2005-06 General Fund Operating Budget to increase general fund revenues by a total of$1,812,406 and to decrease general fund expenditures by $50,000 Staff report presented by Finance Director Steele. 1'-J oting that the resolution was being approved at a speciallneeting, Councilwolnan Matsumoto asked staff to report-out on the item at the next regular meeting. Councihnan Gonzalez asked for clarification on the $4 vehicle license fee surcharge for San Mateo County and questioned how the funds can be used. Staff stated that it is being looked into and will be reported back to Council. SPECIAL CITY COUNCIL MEETING MINUTES FEBRUARY 15,2006 PAGE 3 Councilwoman MatsuInoto asked for a breakdown on the business to business sales tax dollars and if they can be associated with office-users as cOInpared to non-office users. Motion-Garbarino/Second-Addiego: To approve Resolution No.1 0-2006, amending 2005-06 General Fund Operating Budget to increase General Fund revenues by a total of $1,812,406 and to decrease general fund expenditures by $50,000.
