Presentation of Flag - Veterans of Foreign Wars Post 4103 South San Francisco Junior Vice Commander Patrick Rosenthal introduc1ed presenters South San Francisco police officers, Army Lt. Colonel Bill Carter and Major Howard Zimmerman; both officers were recognized for their heroism during their recent tours in Iraq; they thanked Council for their support by having previously adopted a military leave policy. (A flag flown over the 49th m~litary police brigade headquarters in Baghdad, on the occasion of the 5th anniversary of 9/11, and a certificate of authenticity were presented to Council.) AGENDA REVIEW -- No changes. Mayor Garbarino requested an update on concerns previously expressed by six residents of the First and Second lanes area on January 24th; Public Works Director White reported on staffs progress related to code enforcement and maintenance, and efforts the public works' staff have been making on a regular basis. He stated that input from more of the neighborhood's residents is needed before the City can implement any major changes to traffic patterns, street lighting, parking, etc., therefore, a community meeting has been scheduled for March 7, 6:00 p.m., at Magnolia Center. PUBLIC COMMENTS No comP.1ents. ITEMS FROM COUNCIL . Announcements · Committee Reports Councilmembers repOJied 011 attendance at community and regional events, announced upcoming events and fundraisers, and acknowledged members of the community for their contributions. Councilman Addiego asked that a discussion be agendized regarding the opposition to Virgin America Airlines coming to SFO. In reference to the Redevelopment Agency meeting, Councilwoman Matsumoto asked that staff provide Council with information on outstanding redevelopment bonds, the amount, purpose, age, and yearly interest, and a list ofprojects that might be put in abeyance due to funding the downtown garage structure. She reported CCAG approved $9 million to be applied to the South San Francisco Caltrain station, but there's still a $21 million deficit. She reported that there is a possibility the NPDES (stormwater) fees will double for the City and found that this fee increase is not subject to the Prop 218 process. She reported that C/CAG Congestion dues are being increased by $22,000 a year for the next four years. She stated concern that the City is losing revenue from the airport parking businesses and that information is being provided to Council late; she suggested stafflook at a better means of reporting rather than on a quarterly basis. She suggested staff contact Millbrae as to why the Virgin America Airlines item was pulled from its agenda last night and City Manager Nagel stated he would follow-up on the matter, and she further .~.sked for the status of the BART-MTC-SamTrans agreement. Councilman Fernckes askcd for the status of a meeting with Mr. Scanlon (Caltrain executive director) and staff reported it is still pending. Councilman Femekes stated a Terrabay committee (Fernekes/Matsumoto) meeting was held with staff to review the performing arts center proposal and it was once again referred back to staff for further work. The public places subcommittee (Fernekes/Matsumoto) met and areas to enhance are being prioritized. He requested the meeting be adjourned in memory of Mary Ferrari. Mayor Garbarino verified that a letter is being prepared for U.S. Senator Barbara Boxer soliciting hcr support related to local concerns which City Managcr Nagel confirmcd. CONSENT CALENDAR 1. Motion to approve the minutes of January 24, Fcbruary 3 and 5, 2007 2. Motion to confilID expense claims of February 14, 2007 in the amount of$1,843,084.75 3. Resolution No. 1)5-2007, authorizing reimbursement of the $9.6 million State Revolving Fund Loan for Phase II of the Wet Weather Program as required by tIle State Water Resources Cont"o] Board 4. Resolution awarding contract to Delta Bluegrass for the Orange Memorial Pad S0ccer field turf project in the amount of $26,320 REGULAR CITY COUNCIL MEETING MINUTES FEBRUARY 14,2007 PAGE 2 Item pulled from the agenda at the request of Councilman Addiego. 5. Resolution authorizing acceptance of funding from the State Department of Education to fund ongoing after school programs in the amount of $209,250 Item pulled from the agenda at the request of Councilman Fernekes. 6. Resolution authorizing the acceptance of funding from the Metropolitan Transportation Commission to support a Lifeline Transportation Program at the Community Lcarning Center in the amount of $54,052 Item pulled from the agenda at the request of Councilwoman Matsumoto. 7. Resolution No. 06-2007, approving and accepting an offer of dedication of the linear park and recreation parccl in connection with the final subdivision Im~p and the executed development ag:'eements pertaining to the parcels from Terrabay Partners, LLC Motion-Gonzalez/Second-Matsumoto: To approve Consent Calendar Item No:-. 1,2,3 and 7. Unanimously approved by voice vote. Item No.4: Councilman Addiego discussed the cost of installation of the sod and progress of the work with Parks Superintendent Bates and cost of installation. Councilman Gonzalez asked if artificial turf was being considercd and Superintendent Bates stated it is expensive and that she will be studying its feasibility in March. Item No.5: Councilman Fernekes complimented the departments on their grant writing efforts. Item No.6: Councilwoman Matsumoto asked that Council be kept informed with the progress and outcome of the transportation program. Motion-Fernekes/Second-Addiego: To approve Resolution No. 07-2007, awarding a bid to Delta Bluegrass of Stockton, California, for the purchase and installation of sod for the Orange Memorial Park Soccer Field - Project No. 51-13232-0733; Resolution No. 08-2007, authorizing the acceptance of $54,052 in fimding from the Metropolitan Transportation Co:nmission (MTC) to support a Lifeline Transportation Program at the Community Learning Center and amending the Library Depaliment's 2006-07 operating budget; and Resolution No. 09-2007, authorizing acceptance of$209,250 in gri.nt funding from the California Department ofPducation and amending the 2006-07 Recreation and Community Services and Library departments operating budgets. Unanimously approved by voice vote. ADMINISTRATIVE BUSINESS 8. Motion to approve the prohibition of parking on a portion of the west side ofEl Camino Real across from Kaiser Permanente Hospital Staff report presented by City Engineer Razavi. Motion-Matsumoto/Second-Fernekes: To approve the prohibition of parking on a portion of the west side ofEl Camino Real across from Kaiser Permanent Hospital. Unanimously approved by voice vote. COUNCIL COMMUNITY FORUM No report. CLOSED SESSION 9. Pursuant to Government Code section 54956.9(a), conference with legal counsel- existing litigation: Ayala v. City of South San Francisco, and Masaganda v. San Mateo County and City of South San Francisco; pursuant to Government Code section 54956.9(c), Initiation of Litigation - One Case* *Note: City Attorney Mattas did not participate in the Initiation of Litigation closed session item. Time entered into Closed Session: Time reconvened into Open Session: Report from Closed Session: 8:30 p.m. 10: 1 0 p.m., all Councilmembers present. Ayala v. City of South San Francisco: Direction given/no action taken; Masaganda v. San Mateo County et al: the City Council, by a vote of 5-0, authorized the filing of a cross-complaint against the County of San Mateo.
