John Cantley, Grace Covenant Church PRESENTATIONS · Pacific Coast Farmers Market Association - Opening Day, May 12, 2007 · Proclamation: Teacher Appreciation Week, May 6-12,2007; Recipient: Tom Coddington, President South San Francisco California Teachers Association; Mari Avila-Suarez, President, South San Francisco PTA Council · Proclamation: Historic Preservation Month, May 2007; Recipient: Historic Preservation Commission Chair Cyrus Kon AGENDA REVIEW - City Manager Barry Nagle recommended that Item #13 be withheld from discussion until after the Closed Session, Item #14. PUBLIC COMMENTS George Bernal, Association of Community Organizations for Reform Now (ACORN), presented photographs to Council. He stated ACORN had addressed Council in January regarding concerns about police, maintenance and code enforcement issues, stating there has not been resolution or improvement. Kamala Silva Wolfe, citizen, acknowledged staff and Council for moving forward with consideration of the adoption of the U.S. Mayors Climate Protection Program. ITEMS FROM COUNCIL · Announcements . Committee Reports Councilman Addiego announced an E-Waste event to take place on Saturday, May 12, at the Boys and Girls Club. He said members of the Airport Roundtable were encouraged to tour the Control Tower at SFO, commenting on the success of the Noise Abatement Project in South San Francisco. He said he had attended a presentation at SMCCC (San Mateo County Council of Cities) meeting where there was a presentation of a simulation of an earthquake matching the magnitude of the 1906 Earthquake and how it might impact San Mateo County. Councilwoman Matsumoto met on the Improving Public Places Committee, and there will be a table at Day in the Park where people can get information about the program. She mentioned some discussion about meeting with the Salvation Army and staff concerning zoning requirements for a rehabilitation center, as well as stores. Councilwoman Matsumoto requested a monthly report from staff outlining what is happening in the Biotech. She also requested a similar report on retail. She also talked about the 5th grade biography project at Martin School, reading a portion of one book. Councilmember Fernekes attended the Employee Recognition Lunch, as well as an award ceremony where State Senator Yee presented a small business award to Royal Auto. He attended the Police Reserves and Volunteer dinner. He visited one site of Rebuilding, the Victorian Tea given by the Historical Society, the Downtown Merchants meeting, HOTHRA meeting where the Police Department talked about gangs and graffiti. He also attended the Centennial subcommittee meeting. He met with a community group (ACORN) and followed up by meeting with the City Manager and visiting some of the sites involved. Councilman Fernekes thanked many citizens for the Cinco de Mayo celebration recently held in South San Francisco. He spoke about three hybrid vehicles recently purchased for the City, thanking Mr. Van Duyn for the advance purchase process he had facilitated. Vice Mayor Gonzalez attended the Inter-Agency Council which oversees the agencies that work for the betterment of the homeless, housing and social issues. A report to be forthcoming will show a slight increase in homelessness in San Mateo County. An event has been scheduled to assist people in understanding what programs are available to assist them. Vice Mayor Gonzalez attended a Notre Dame University graduation honoring several South San Francisco students. He went to the Unite in Prayer event, encouraging sensitivity to the needs of people who are serving time injail and the needs of their families. He felt Youth Government Day was a success. He also attended the HOTHRA and ACORN meetings. He congratulated the owner of Royal Auto for his work with immigrants. Mayor Garbarino attended many of the same events already mentioned. He attended (along with three other council members) the Tree Planting honoring the 70th anniversary of the bombing of Grenega, a Basque city. He worked on Del Monte Avenue at the Rebuild America project, and thanked Tom Carney for coordinating these efforts, also stating how gratifying it is to do such work. He mentioned that in November, he and his wife expect their seventh grandchild. Councilwoman Matsumoto commented on her experience at Rebuild America. Vice Mayor Gonzalez said he had worked at the Hemlock address. . Consideration/discussion of a resolution endorsing the adoption of the U.S. Mayors Climate Protection Program Councilwoman Matsumoto stated her support for this, even though she will not be voting on it as a City Councilwoman. She felt many resolutions of this nature coming forward and she said REGULAR CITY COUNCIL MEETING MAY 9, 2007 MINUTES PAGE 2 the City is already involved in many efforts and programs already moving in this direction. She would like this to be discussed by Council in the future. Councilman Fernekes agreed about numerous resolutions. He stated his understanding of this resolution would authorize the Mayor to sign it. He would also like to see such a resolution as a councilmember. Councilman Addiego stated he would also sign a resolution where the entire Council would be signatory. Vice Mayor Gonzalez commented on the City's current efforts. Discussion followed about how to achieve 7% compliance by the year 2012. Mayor Garbarino stated that he would sign the resolution with consensus of Council. He did express, however, his concern about just signing resolutions as Mayor. CONSENT CALENDAR 1. Motion to approve the minutes of April 19, 2007 2. Motion to confirm expense claims of May 9,2007 in the amount of$2,789,499.01 (Two million seven hundred eighty nine thousand four hundred ninety nine dollars and one cent) 3. Resolution No. 36-2007 authorizing execution of a loan agreement and related documents with HIP Housing for acquisition of residential apartment building located at 317-321 Commercial Avenue and adopting Relocation Plan 4. Motion to approve recommendation from Parking Place Commission to approve an application to grant petitions filed for annexation into Parking District No.1 by Louis Poletti for property at 515 Airport Boulevard (APN: 012-177-030) 5. Resolution No. 37-2007 authorizing execution of the Program Supplemental Agreement with the State of California tor the Grand Avenue Resurfacing Project 6. Resolution No. 38-2007 awarding construction contract to Mountain Cascade, Inc. for the Industrial Sewage Pumping Station No.4 Rehabilitation Project in the amount of $3,959,000 7. Resolution No. 39-2007 awarding construction management contract to Mendoza & Associates for Industrial Sewage Pumping Station No.4 in an amount not to exceed $400,000.00 Motion-Fernekes/Second-Addiego: To approve Consent Calendar; unanimously approved by voice vote (5-0). // / REGULAR CITY COUNCIL MEETING MINUTES MAY 9, 2007 PAGE 3 ADMINISTRATIVE BUSINESS 8. Motion to accept the Aircraft Noise Insulation Project Phase 18 (XVIII) as complete in accordance with the plans and specifications Construction Manager Jeff Baca presented the staff report, including sound effects. Discussion followed concerning policy and procedural issues and future expansion of the program as funds become available. Motion-Gonzalez/Second-Fernekes: To accept the Aircraft Noise Insulation Project Phase 18 (XVIII) as complete in accordance with the plans and specifications; unanimously approved by voice vote (5-0). 9. Resolution accepting an increase in refuse collection rates effective July 1, 2007 as submitted by the South San Francisco Scavenger Company and amending the franchise agreement to approve an increase in the franchise fee Finance Director Jim Steele presented the staff report. Councilman Addiego asked about the Scavenger Company's use ofbio-diesel and commented on the rate increase. Vice Mayor Gonzalez commented about the need to remind customers to remove their containers from the sidewalks following pickup, graffiti on trash cans and the increase in rates. He also expressed his interest in having the boxes back in the neighborhoods for disposal of furniture and large items not usually getting into the trash receptacles. Discussion followed concerning additional scheduled pickups for customers as part of their regular service and rate. Councilmember Addiego raised the issue of the costs for hauling wet sludge from the Water Quality Control Plant. Motion-Fernekes/Second-Addiego; To adopt Resolution No. 40-2007 accepting a 2.49% increase in refuse collection rates effective July I, 2007, and amending the franchise agreement to approve an increase in the franchise fee; unanimously approved by voice vote (5-0). 10. Report and Transmittal of various year end financial reports and audit findings for FY 2006/07. Finance Director Jim Steele presented the staff report. Resolution approving emergency sewer replacement at 945 Airport Boulevard by Pacific Liners in the amount of$27,9l5 from the Sewer Enterprise Fund. Director of Public Works Terry White presented the staff report. Staff recommended approval of this emergency repair as necessary to insure sewage flows properly to the Water Quality Control Plant and to avoid nearby utility and building damage. Motion-Addiego/Second-Gonzalez: To adopt Resolution #42-2007 approving emergency sewer replacement at 945 Airport Boulevard by Pacific Liners in the amount of$27,9l5 from the Sewer Enterprise Fund; unanimously approved by voice vote (5- 0). 12. Resolution adopting the awarding of the construction contract for the Orange Memorial Park Recreation Building, Electrical System package to ASF Electric of Daly City, in the amount of$557,289 City Engineer Ray Razavi presented the staff report. Councilwoman Matsumoto inquired about the costs of this project. Mr. Razavi discussed the bid process and modifications. Motion-Fernekes/Second-Gonzalez: To adopt Resolution #43-2007 awarding the construction contract for the Orange Memorial Park Recreation Building, Electrical System package to ASF Electric of Daly City in the amount of$557,289; Ayes, Fernekes, Gonzalez and Garbarino; Noes, Addiego and Matsumoto. Motion carried, 3-2. 13. Resolution approving an agreement with the City and County of San Francisco related to business license taxes - Item to be discussed follOWing Closed Session, Item 14. CLOSED SESSION 14. Pursuant to Government Code section 54956.9(c) - conference with legal counsel; pending litigation - one case. Time entered into Closed Session: Time reconvened into Open Session: Report from Closed Session: 9:25 p.m. 9:37 p.m. City Manager Nagle stated there is no action taken; Item #13 was removed from the Agenda for discussion at a future meeting. There being no further business, the City Council adjourned to the Reconvened Redevelopment Agency meeting at 9:40.
