ROLL CALL: PRESENT: Councilmembers Garbariro, Gonzalez, Matsumoto, Vice l~iayor Mullin and Mayor Addiego. ABSENT: None. PLEDGE OF ALLEGIANCE: Cultural Arts Commissioner Shane Looper. PRESENTATION • Presentation honoring 2010 Jack Drago Youth Art Scholarship Winner -Kevin Longboy of El Camino High School. Cultural Art Commissioner Looper presented the Youth Art Scholarship award to El Camino High School Senior Kevin Longboy. She explained the scholarship was established for the purpose of providing recipients with continued education in the visual arts. Kevin planned to attend San Francisco State University or the University of San Francisco and continue his studies in graphic design, ceramics, advertising, architecture or fashion. Mr. Longboy thanked the Cultural Arts Commission and Council for the opportunity and recognition. • Certificate of Recognition honoring Marta Bookbinder recipient of the San Mateo County Hispanic Chamber of Commerce Mayors' Diversity Celebration Award. Mayor Addiego presented Marta Bookbinder with the Hispanic Chamber of Commerce Mayors' Diversity Celebration Award. He described Ms. Bookbinder as a fearless promoter of what she believes in who had given much to the City, particularly in the Downtown Area and at the Community Learning Center. • City Net Intranet presented by Director of Information Technology Hollis. Director Hollis demonstrated the newly enhanced City Intranet for Council. Council complemented the new program and questioned who had authority to post news and announcements. Director Hollis advised key City staff, IT Managers, administrators and those with emergency response roles would have such authority. GENDA REVIEW None. PUBLIC COMMENTS Renee Sharp of the California Office of the Environmental Working Group presented Council with a proposal to phase out public spending on non emergency use of bottled water. She noted such programs would save money and make the City greener. She stated that bottled waster is less regulated than tap water. Mayor Addiego thanked Ms. Sharp for her presentation and the information she provided. He noted that Council had taken the first step by removing the provision of bottled water to Councilmembers and staff at City Council Meetings and replacing this service with water pitchers. ITEMS FROM COUNCIL • Announcements. • Committee Reports. Councilmembers reported on attendance at community meetings and events including, the Asian Pacific Islanders Heritage Club Event, the League of California Cities' Legislative Day, a League of Women Voters Meeting and a WETA event. Council thanked staff for its excellent work putting together the City Service at the Memorial Flame Sculpture at Orange Park on Memorial Day and congratulated Police Sergeant Mike Riordon on his retirement. An announcement regarding a High Speed Rail Community Meeting at 7:00 p.m. on Tuesday June 15th at the Municipal Services Building was also made. Council further informed the public that the June 10th SSFUSD Board of Trustees meeting would be televised and available on the City's website. Specific items for further action and/or consideration were set forth as follows: Mayor Addiego requested that the meeting be adjourned in honor of former South San Francisco Unified School District Teacher and Administrator Thomas Gaffney. REGULAR CITY COUNCIL MEETING JUNE 9, 2010 MINUTES - 2 - • Discussion related to cancellation of August 11, 2010 Regular City Council Meeting. Councilmembers decided to consult their respective schedules and consider the item again at an upcoming meeting. CONSENT CALENDAR Motion to approve the minutes of meetings of May 26, 2010. 2. Motion to approve expense claims of June 9, 201 G. 3. Motion to continue action on the following Public Hearing of May 12, 2010 to July 14, 2010: LEE, ALFRED TR ET AL -Applicant LEE, ALFRED TR ET AL -Owner 465 GRAND AVE APN - 012305450 P08-0065: SA08-0001, UP08-0010, DR08- 0031 & AHA08-0001 Tentative Subdivision Map, Use Permit and Design Review applications to establish a mixed-use condominium project comprised of six residential dwellings, a 5,442 square foot ground floor commercial unit, common area and a residential parking garage, with an Affordable Housing Agreement ensuring twenty percent of the dwellings are restricted to lower income households, at 465 Grand Avenue, in the Downtown Commercial (D-C-L) Zone District in accordance with SSFMC Title 19 and Chapters 20.26, 20.81 ~ 20.85. 4. Resolution No. 48-2010 accepting a grant in the amount of $100,000 from the Bay Area Suburban Area Security Initiative (SUASI) to purchase Urban Search and Rescue (USAR) training site and tools and equipment; and amending the 2009-10 Operating Budget and authorizing the City Manager to sign a Memorandum of Understanding. 5. Resolution awarding a Consulting Services Agreement to Noll & Tam Architects and Planners for design services of the Fire Station 63 Upgrade Project in an amount not to exceed $168,557. 6. Resolution No. 49-2010 awarding the construction contract to Gallagher & Burke, Inc. for the Utah Avenue and Grand Avenue Resurfacing Project in an amount not to exceed $609,609. Motion- Councilman Gonzalez/Second- Councilman Garbarino: to approve Consent Calendar Items Nos. 1-4. Unanimously approved by voice vote. Item No. 5: Councilman Garbarino commented that he had concerns regarding the amount of funds available given the size of the tasks. Councilwoman Matsumoto noted she intended to vote no on the item due to concerns over due diligence related to the selection process. After discussion with City Manager Nagel and Public Works Manager White, Council decided to bring the item back for vote at a later date. REGULAR CITY COUNCIL MEETING JUNE 9, 2010 MINUTES - 3 - Item No. 6: Vice Mayor Mullin questioned whether there was a means by which competing bidders could be notified of low bids particularly in circumstances where South San Francisco Companies had a bid at stake. City Attorney Mattas advised the process was regulated by the state and the City was required to award the contract to the lowest bidder regardless of whether the Company was local or not. In response to a question from Mayor Addiego, City Engineer Razavi advised certain issues on East Grand were not the result of work done by Gallagher & Burke. Motion- Vice Mayor Mullin/Second- Councilman Garbarino: to approve Resolution 49- 2010. Unanimously approved by voice vote. LEGISLATIVE BUSINESS 7. Waive reading and introduce an ordinance updating Chapter 6.48 of the South San Francisco Municipal Code, related to Special Event Permits. Chief of Police Massoni presented the staff report introducing the ordinance. He explained that staff had participated in meetings with stakeholders including owners and operators of Intramuros Restaurant. He noted the ordinance included a list of events that would be exempt and stated the words "funeral procession" should read "funeral reception." Vice Mayor Mullin questioned whether the 15 day advance application requirement was calendar or business days. Chief Massoni responded: calendar days. Vice Mayor Mullin and Councilman Garbarino disclosed they met with representatives of Intramuros. Mayor Addiego disclosed he met with members of Intramuros separately. Mark De Leon the Managing Director of Intramuros thanked Council for its careful attention to the issues the restaurant raised. He mentioned the restaurant had started community outreach to neighbors to address noise, parking and related concerns. He expressed the restaurants' desire to be a partner with the community. Sonia Delen a Senior Vice President of Bank of America Leasing and a Co-owner of Intramuros thanked staff and Council for some of the changes to the ordinance, but requested that the length of the application requirement be shortened from 15 days. She expressed concern the 15 day requirement would hurt business at Itnramuros due to cultural mores related to planning gatherings. Jamil Rey a resident of South San Francisco for 27 years and owner of Intramuros expressed concern over the challenges the business would face due to the 15 day application requirement. He noted the restaurant had a niche clientele, representing 30- REGULAR CITY COUNCIL MEETING JUNE 9, 2010 MINUTES - 4 - 40% of the restaurant's business, that planned parties on short notice. He urged Council to reconsider the 15 day application requirement. Barry Picazo thanked Council for lowering the application requirement from 30 to 15 days but noted Intramuros restaurant would still experience business difficulties under this guideline. He stated the restaurant's business was barely surviving under the current 10 business day requirement and urged Council to consider lowering the requirement from 15 days. Resident Mark Nagales thanked Council for working with Intramuros restaurant and the Pilipino community to address concerns related to the ordinance. He noted that due to the pending application requirement, the restaurant had turned away several special events. Valerie De Leon thanked Council for adjusting the proposed application requirement from 30 to 15 days. She expressed concern however, that the 15 day requirement would still hurt small businesses in the community. Al Perez a Board Member of the Professional Pilipino Business Network noted his group enjoyed holding its events at Intramuros. He expressed concern the 15 day application requirement would limit his group's ability to hold events there, however. Laurel Enders, a resident and employee at Intramuros urged Council to reconsider the 15 day application requirement. She noted it might hurt business at Intramuros because the clientele often plans parties on short notice. She opined the ordinance would hurt small businesses. Community Leader Alice Buios thanked Council for the work it had done to meet with and listen to Intramuros. She acknowledged the revised ordinance addressed some of the restaurant's concerns. She expressed admiration for Council, the City and Council's responsiveness to the Pilipino community. Hanley Chan urged Council to reconsider the 15 day application requirement as he believed it would hurt small businesses in the city. He requested more dialogue between the Police Department and the Asian American community. Councilman Gonzalez thanked the public for its discussion of the issues. He noted however, the ordinance was necessary in the City generally to address problems experienced with large parties and other gatherings at various locations throughout the City. He urged residents to plan parties sooner and use social network sites to get the word out about such parties. Vice Mayor Mullin thanked the community members that spoke on the issue. He noted that the change from the current 10 business day application requirement to a 15 calendar day requirement likely wouldn't cause much of an impact to the status quo. He questioned whether a late breaking event could be accommodated. Chief Massoni responded that a late breaking event could be accommodated with an application under the 15 day requirement as long as a late fee was paid. REGULAR CITY COUNCIL MEETING JUNE 9, 2010 MINUTES - 5 - Councilman Garbarino believed the ordinance would allow for flexibility while still accomplishing the level of regulation needed throughout the City. He was pleased the ordinance was close to something that might work for everyone. Councilwoman Matsumoto stated that the current version of the ordinance please her because it addressed concerns of various groups and represented an acceptable compromise. Mayor Addiego appreciated that the ordinance would allow flexibility to address extraordinary circumstances where late breaking events might be accommodated. He stated his belief the ordinance would be applied fairly and in a manor that would permit the success of small businesses in South San Francisco. Motion- Councilman Gonzalez/Second- Councilman Garbarino: to waive reading and introduce an ordinance updating Chapter 6.48 of the South San Francisco Municipal Code, related to Special Event Permits, including modifications. Unanimously approved by voice vote. COMMUNITY FORUM None.
