CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING APPROVAL
AND EXECUTION FOR THE BUS ROUTE
REHABILITATION PROGRAM - PHASE II
BE IT RESOLVED by the City Council of the City of South San Francisco
that:
1. A~proval of Agreement.
Tie Agreement entitled "Agreement Between the County of San Mateo
and City of South San Francisco Bus Route Rehabilitation Program - Phase II"
is hereby approved, and a copy of the Agreement is attached.
2. Execution of Agreement.
Tie Mayor is hereby authorized to execute the Agreement.
I hereby certify that the foregoing Resolution was regularly introduced
and adopted by the City Council of the City of South San Francisco at a
regular meeting held on the 23rd day of March , 1988, by

AGREEMENT BETWEEN THE COUNTY OF SAN MATEO
AND THE CITY OF SOUTH SAN FRANCISCO
BUS ROUTE REHABILITATION PROGPAM - PHASE II
THIS AGREEMENT, entered into this 23rd day of March
1988, by and between the COUNTY OF SAN MATEO, a political subdi-
vision of the State of California, hereinafter called "County",
and the CITY OF SOUTH SAN FRANCISCO, a general law city of the
County of San Marco, State of California, hereinafter called
"City";
W I TNESSETH:
WHEREAS, as provided in the document entitled "Program for
Rehabilitation of Streets Utilized by Transit Vehicles" adopted
by the San Mateo County Board of Supervisors on April 24, 1984,
by Resolution No. 45633, funds have been made available for the
repair of streets used by transit vehicles; and
WHEREAS, City intends to repair certain bus routes within its
jurisdiction; and
WHEREAS, City desires program aid to finance said street
work:

NOW, THEREFORE, IT IS HEREBY AGPEED by the parties hereto, as
follows:
1. County agrees to allocate to City from monies of
its road fund an amount not to exceed $200,000.
2. County agrees to make payment hereinabove provided
for upon receipt of billing for said amount from City and upon
availability of program funds.
3. City agrees to submit to the State Controller of
the State of California all notices and reports required for the
legal expenditure of program funds.
4. City agrees that said funds as herein provided
shall be used only as permitted by law.
5. City agrees to furnish such reports and accounts of
the expenditure of program funds as County deems necessary and
convenient.
6. City agrees that project shall be advertised for
bid by June 30, 1988.
7. Attachment "A" incorporated by reference lists the
eligible City streets and various eligible roadway items of work
within the City limits of City.
8. City agrees to make all payments to contractor for
work completed in the construction of said improvements.
9. City shall furnish County with all documents
requested by County in order to verify quantity calculations
prior to City's seeking reimbursement for such costs under
Paragraph 2 of this Agreement.

10. City will furnish the design engineering necessary
for pre_Daration of plans, specifications, and engineer's estimate
for the entire project.
11. City will furnish construction engineering, includ-
ing surveying, necessary for the construction of the improvement
for the entire project.
12. County agrees to make payments hereinabove provided
for upon completion of the project. The County will repay the
City for County's pro-rata share of City's disbursement for elig-
ible items after receipt from City of a certification of payment
made by City to the contractor.
13. City agrees that said County aid, as herein
provided, shall be used solely for design engineering, con-
struction inspection and construction of said improvements
hereinabove mentioned.
14. City agrees to furnish such reports and accounts of
the expenditure of program funds as County reasonably deems
necessary and convenient.
15. City warrants that it will comply with all rules,
regulations and laws of the State and Federal Governments,
including but not limited to Section 7260 et seq. of the Govern-
ment Co~e and Public Law 91-646, and that County shall not be
responsible for City's failure to so comply. Further, City shall
hold County harmless from any failure by City to comply with all
rules, regulations and laws of the State and Federal Governments.

16. Said County being deemed a responsible agency shall
be included in the environmental review process as discussed in
the Guidelines for Implementation of the California Environmental
Quality Act (CEQA) of 1970, as amended.
17. The City shall indemnify and save harmless the
County, its officers, agents and employees from all claims, suits
or actions of every name, kind and description brought for, or on
account of, injuries to or death of any person or damage to prop-
erty resulting from the negligent acts or omissions of the City,
its officers, employees or agents in the performance of this
Agreement or work funded by the "Bus Route Rehabilitation
Program".
IN WITNESS WHEREOF, the parties hereto have caused this
Agreement to be executed by their duly authorized officers on the
day and year first above written.
