That there were Twenty two thousand and seventy nine (22,079) registered voters in the City of South San Francisco and that three thousand eight hundred and eighty four (3,884) votes were cast in the City of South San Francisco; 2. For the past 18 years I have been involved in every level of government, local, county, state, and federal. Donaldson CERTIFICATE OF PUBLICATION December 11, 1~85 TO: SUBJECT: ACTION: The Honorable City Council Filling the vacancy in the office of City Treasurer Resolution RECOMMENDATION: It is recommended that the City Council should review the scope of duties of the treasurer and determining whether the position should be filled by appointment or election. DISCUSSION: Government COde Section 36512 states that a vacancy must be fill'ed within thirty (30) days by appointment or by'calling a~special~election. The election, if selected, must beheld "on the next regularly established election date, not less than ninety (90) days from the call of the special election. The County Clerk advises that such an election would be in April 1986, (when some other municipal elections are scheduled). The person appointed or elected would fill out the remaining term of the office, (approximately four (4) years). The stat'uatoryduties of'a General Law City Treasurer primarily involves: (1) The receipt and custody of fUnds, and (2) The investment of such funds. The City Council transferred other financial duties (collection and accounting) to the office of Finance Director by Ordinance in 1972. The duties of paying agent on municipal indebtedness have, in recent years, been allocated by the City Council to private financial institutions, although the late City Treasurer, Mr. John Bonalanza, remained paying agent for a series of older indebtedness issues such as the 1977 Sewer Revenue Bonds, Industrial Districts, and the Gellert Boulevard and downtown Revitalization Assessment Bonds. His unique expertise and time availability allowed him to perform the statuatOry and paying agent duties in an exemplary manner. He was compensated at roughly a half-time rate even though he devoted more time to his responsibilities. It is suggested that Council also allocate remaining paying agent duties to private financial institutions leaving the statuatory duties to the treasurer. This will, if accepted, require the adoption of a new job description and setting of a new compensation rate subs- tantially below the prevailing rate. If Council should determine to appoint existing City personnel to carry out the duties of the office, only minor salary adjustments might be considered. Under the appointment option the Council may appoint any person to f~ll the vacancy although they would want to satisfy themselves that such person (city employee or non-city employee) was properly qualified to fulfill the functions of the office. In either event, Council has the authority to review invest- ment policy and performance on the basis of monthly reports. If Council were dissatisfied with performance they would find it easier to reconcile differences with a treasurer who was also a city staff member, even though Councilprobably has the authority to divest an elected treasurer of his investment responsibilities. .Under the election option, the Council must appoint an interim tr'easurer who could, again, be a city employee or a non-city employee, who met the ~Councils standards of qualification, This appointment would expire at time of election. The cost of a special election would be approximately $25,000. If Council wished to consider the possibility of a longer term appointment, they could make an appointment now and submit to the voters at the next municipal election the proposition for a continuing appointive position. Although a majority of all California General Law Cities now have elective treasurer, approximately 63% of all cities over 25,000 population have appointive positions and 65% of the members of the California Municipal Treasurers AssociatiOns are.indicated to be appointive. ..
