DISCUSSION: The attached resolutions declare the date of the general municipal election; state the hours during which the polls shall be open; contain the notice to be published of the subject election; and authorize a service agreement with the County Clerk to perform certain functions for the city in preparing for the election, i.e., consolidation of precincts, group purchase of supplies, and the processing of absentee ballots. The following time table will apply: Monday, July 12, 1993 - first day to issue nomination papers; Friday, August 6, 1993 - close of nomination, and last day to request by resolution consolidation for a ballot measure; Wednesday, August 11, 1993 - five day extension of nomination period if an incumbent does not file; Thursday, August 12, 1993 - random alphabet to be drawn by the Secretary of State. Appointment to each elective office will be made pursuant to Election Code 23520 in the event there are no nominees or an insufficient number of nominees for such office. "They created quite a scam," said longtime City Hall observer Jim Clam'. "It sounds like a little skullduggery to me." But to others, it was merely an example of public service on the part of the two councilmen. "The reaction I'm getting, what people are saying to me is, 'Well, good for them,'" said Mayor Roberta Teglia. At issue is a provision of the State Election Code that gives nonincumbents five extra days to file their election papers when an office-holder decides not to run for re-election. But to Drago and Penna, the issue was whether four candi-' dates who expressed interest in their seats were 'really that interested in serving. "No one had filed and there was no indication that anyone was going to file," said Penna. So, somebody had to run, said Drago. "Normally, when people run for office, they go around asking for support. I had seen none of that," Penna said. "At least, nobody had ever spoken to me." To be certain, though, Drago and Penna said they asked City Clerk Barbara Battaya on Friday to contact the other candidates, tell them what the incumbents were doing and put them on notice that they had better have their papers in by 5 o'clock or they were out of luck. DeZordo was unavailable for ·comment. But two other candidates said they were serious and were counting on the extra time to file. Frank D'Alessandro told The Times that he mistakenly thought the incumbents could be held to their word that they were not going to run. He said he was notified by Bill at 2 p.m. Friday of Penna's and Drago's intentions, but it was not enough time for him to act. "It caught me by surprise," he said. "The city clerk called, but, in the spur of the moment, I can't just drop everything and run over to City Hall. I'm busy. I have to run my business. "They didn't do anything ille- gal,'' he concluded. "This is not the end of the world. I'm just disappointed." It meant that, with no open seats, he would be pitted as a challenger against his friend, Councilman Yee. He said he didn't want that. "It caught all the challengers, including myself, flatfooted. I think (Drago and Penna) saw an easy opportunity and took advantage of it," he said. "I wouldn't accuse them of being underhanded. I do think they will have to square things with those who they tell what they are going ~o do and what they aren't going to do." But Drago said the onus is on those who took out the papers and didn't return them. "I think the burden is on them to answer the question, 'Why didn't you file?'" he said. "If you're serious about running, get your papers in." Had any one of the candidates met the 5 p.m. deadline, Drago and Penn agreed they would have bowed out. "If they'd walked in, I'd have walked out," Drago said. O'Toole, City Attorney RECOMMENDATION: i~ - ~ ~ Adopt the Resolution cancelling the November 2, 3 General Municipal Election and adopt each of the Appointment Resolutions separately. BACKGROUND/DISCUSSION: Elections Code §22843.5, as amended July 30, 1993, allows a City Council to cancel a general municipal election and appoint those persons who have filed nomination papers if by 5:00 p.m. on the 88th day prior to the day of the scheduled election the number of persons who have been nominated does not exceed the number of offices to be filled. In the instant case, the November 1993 South San Francisco General Election is scheduled to fill five offices, three City Council positions, the City Clerk and City Treasurer. As of 5:00 p.m. on August 6th, the 88th day prior to the election, the following nomination papers had been filed with the City Clerk: Nominee Position/Office Robert Yee Jack Drago John R. Penna Barbara A. Battaya Beverly Bonalanza Ford City Council City Council City Council City Clerk City Treasurer Since the number of nominees did not exceed the number of offices to be filled, the Elections Code provides two options for the Council. You may appoint to office the person who has been nominated or hold an election. CENTRAL RECORD~ 7 The Honorable Mayor & city Council August 25, 1993 Page 2 Time Limitation For Action Pursuant to the Elections Code, the City Clerk is required to publish a notice of facts describing the contents of Elections Code §22843.5 and the options available to the Council. Such notice was posted, Friday, August 13th and will be published Saturday, August 14th. After the fifth day following the date of posting, the Council may make the appointment or direct an election to be held. If by the 75th day prior to the election, August 19th, the Council has not made an appointment to office, the election must be held. Thus, if the Council does not make the appointments at its meeting of August 19, 1993 an election is required. Cost Savings To City By Cancelling Election I have been advised by the City Clerk that the cancellation of the election will result in an approximate savings of $16,000 to the City. Nature and Consequences of Appointment A person appointed to office pursuant to Elections Code §22843.5(a) qualifies to take office and serves exactly as if elected at a municipal election for the office. In addition, once the appointments are made, the City Clerk is prohibited from accepting for filing any statements of write-in candidacy. ACTION If the Council chooses to cancel the election and appoint the nominated persons it should take action as follows: Adopt the Resolution cancelling the November 2, 1993 election. Barbara A. T This alphabet applies throughout the entire name of the candidate. If the names of two or more candidates begin with the same letter, their order is determined by applying this alphabet to the next letters of the name. Names of candidates for the statewide office rotate by Assembly district, starting with AD 1. The order determined by this alphabet applies in AD 1, but in AD 2 the candidate who topped the ballot in the first district drops to the bottom of the list and the others move up one notch. This allows each candidate a number of opportunities to appear first, considered by many to be an advantageous position for receiving votes. Congressional candidates rotate within their districts by Assembly district, with the lowest-numbered district starting the rotation order. In single-county legislative districts candidate names follow this random alphabet, but do not rotate. Each county creates its own randomized alphabet to determine candidate order in legislative districts that encompass more than one county. The random alphabet technique was established by legislation in 1975 in response to court ru_lings declaring ncumbent first or standard alphabetical order unconstitutional. -CENTRAL. RECORD~
