RECOMMENDATION
It is recommended that the Council review and provide feedback on the information
provided as General Fund revenue options.
BACKGROUND/DISCUSSION
The General Fund Budget was approved on June 24, ?009, but no revenue/fee increases were
considered at that meeting. Several revenue raising ideas were discussed with the Budget
Subcommittee in May, and these provisions would augment the budget and provide more fiscal
stability over time. No formal action is being requested tonight. Staff will bring the Master Fee
Schedule changes, and any other item~~s directed by the Council, for formal approval on July 22"d.
The revenue items are as follows, with more detail outlined in the attachments to this staff report:
Possible tax increases. If t:he Council wishes to pursue these further, they would need
to be submitted to the County for inclusion on the November ballot no later than
August 7th. The two items suggested for consideration are raising the Transient
Occupancy Tax (TOT) from 9% to 10%, and consideration of a Billboard Tax.
Another consideration for future implementation could be a Storm Drain Fee, similar
to what the City of Burlingame implemented with its voters, and options for street
sweeping. These latter two items are not tied into the timing of the County election
cycle, but could be areas the Council wishes staff to continue to evaluate and report
back to the Budget Subcommittee.
II. Changes in several fee for service areas. While the Council traditionally considers
annual changes to the Master Fee Schedule, several fee categories stand out as
changes in methodology that. while recommended, staff wanted to bring to the
Council's attention. These fee areas are:

d. Code Enforcement Database Management Fee
III. Routine Master Fee Schedule changes, that is, minor changes to fees only.
CONCLUSION
All of the revenue raising ideas in this staff report are worthy of consideration for longer term
financial stability. Council feedback is requested.

Consider increasing the Transient Occupancy Tax (TOT) from the current 9% to
10%.
This would raise about $620,000 annually (assuming the current weak economy), and
upwards of $785,000 in a strong economy such as the one in 2006-07. (If approved by
Council and the voters, such a measure would take effect January 1, 2010. Therefore, the
first year's revenue would be half of the numbers above, or $310,000 in today's weak
economic climate).
The current rate of 9% was raised from 8'% in November 2004. Since then, several other
cities have raised their TOT, including the following cities taking a measure to their
voters this November:

A continuing advantage of this tax is that it generally is paid by out of town guests.
However, one argument against raising the tax is that with the $2.~0/night Conference
Center tax, South San Francisco's effective tax rate would be over 12°,% for budget hotels
under $100/night. Here are some examples of effective TOT rates now, and assuming an
increase to 10%:

The Council has, from time to time, expressed some interest in this type of tax. A
Billboard Tax was on the November 2004 ballot, and was threatened with challenges by a
large billboard operator, which also paid for advertising in opposition to this measure. As
a special tax (brought to the voters in anon-Council election), it required a 2/3 vote in
favor. It failed to reach the 2/3 vote threshold, but won significantly more than 50% of
the vote. Given the November 2009 election is also an election for City Councilmembers,
Proposition 218 would allow this measure to be passed as a general tax, requiring only a
majority vote.
The City Attorney's Office has indicated that such a tax, if applied broadly, would have a
good chance of passing legal or constitutional challenges on free speech grounds. If the
Council is interested, care must: be taken in defining this tax broadly. An example of
broadening the tax would. be a ta:Y on all outdoor advertising.
Staff is a~~~are of fewer than a dozen cities in California that have some type of a
Billboard Tax. Based on a previous suz~~ey, indications are the all of the revenues
received are fairly nominal. Some examples include:

grandfathers in all existing billboards. The City then negotiates a fee if a billboard
operator wishes to upgrade an existing billboard, and requires that the operator take down
two existing billboards for every one upgraded. This does not provide a reliable annual
revenue stream. The Oaklai~id Coliseum Authority receives billboard revenue for
advertisin~~ on its electronic billboard, but those revenues do not to go the City of
Oalaand.

Possible other Revenue aVleasures for Future Study: storm drain fee
and. street sweeping options
A. Storm Drainage 1~ ee-Ballot. Procedure
The City of Burlingame recently had a si.~ccessfiil snail ballot election (which is not timed
to the regular November election cycle j under the provisions of Proposition 218 to obtain
property-owner approval of fees to fund storm drain services. Those provisions have both
substantive and procedural requirements for so-called property-related fees.
Substantively, property-related fees have to be charged according to the proportional cost
of the service that property o:r property owners receive. That is, a cost analysis of
operating the storm drain system would need to be done, and the cost of serving the
different classes of property (single family, multi-family, small commercial, large
commercial) would need to be determined. To calculate the cost of providing storm drain
services to classes of property, other agencies have used runoff to quantify use of the
storm drain services and calculated each property's proportional cost of the services
based upon the amount of impervious surface area, such as:
-the average impervious area (driveways, sidewalks) on single family dwellings; and
-the average impervious areas for classes of commercial property, typically based on
parcel size and impervious area (such as on-site parking sq. footage, often
measured/supported by aerial mapping surveys).
Once costs are determined, outreach would need to be done to the community to educate
them about the need for this fee. Such a fee could be set at any amount up to and
including the full cost of providing drainage services. That is, the CoLU7cil could choose a
lower fee if doing ~o would make the fee more acceptable to the community; the
difference in total cost would still have to be funded from another source, such as Gas
Taxes or the General Fund. ~s additional runoff regulatory requirements are made in the
Bay Area, this fee will he more and more important, but also more and more expensive,
with each increase also requiring property owner or voter approval (unless the increase is
within a previously approved range j.
Proposition 218 requires an election process (many cities provide mail-in ballot
procedures). According to the City Attorney's Office, two steps are required to impose a
storm drainage fee. First, a majority protest procedure is required, similar to what the
Sewer Fund just underwent to increase its fees. However, an additional step is required
for storm drainage fees. Assuming no majority protest at a public hearing, the second step
is a ballot procedure. "I'wo options exist for that procedure. Ballots may be sent to
property owners, with each parcel getting an equal vote, and majority approval of
returned ballots required for the fee to pass. If the Council prefers to use a mail ballot
procedure, the next date allowed under the. Elections Code is March 2, 2010.

Alternatively, the Council could submit the measure to the voters, which would require a
2/3 vote of the electorate and co~_ild be se~heduled at a special election.
Current funding is the fixed county property tax fee, which generates about $415,000
annually, while operating e~:pei:~ses only (no capital improvements) costs over x$00,000
annually. Currently revenue from State Gas Taxes is used to supplement the shortfall, but
insufficient funding exists to fluid capital improvements. Staff has pointed out in the past
that a permanent funding solution for storm drains needs to be found.
B. Street Sweepin#; Costs
The General Fund ctu°rently spends about $00,000 annually on street sweeping, If the
Council was interested, staff could discuss with the South San Francisco Scavenger
Company the option of movzng street sweeping charges to the garbage bill. Many cities
that operate their own garbage aperatio~n charge for street sweeping as part of the garbage
bill. Staff and the City Attorney are evaluating the possibility and implications of
transferring the responsibility 'to the solid waste franchisee.. The City Attoi~zey will
provide a verbal presentation cn1 the issue following staff's presentation on this issue.
Assuming this transfer is able to occur, this would requu-e negotiations to the existing
fi~anchise agreement with the Scavengers. Staff has not yet discussed this potentiality
with the Scavengers.
if the Council is interested in pursuing either of these revenue options further, staff would
propose working with the r,inance Subconuz~ittee over the next year to study this more in
depth, with the involvement of Public Works, Finance, and the City Attorney's Office.

pages. Not more than ten pages per day per citizen may be waived under these circumstances. (Up to $2.50 per
day per person)

Fire Prevention Division Permits and Fees
A fee in accordance with the following schedule shall be paid to the Fire Prevention Division at the
time of application for: (1) Fire Construction Permit, (2) Inspections, (3) Renewable Permit,
(4) Special Activity Permit, (5) any other service. Such fee shall not be refunded upon failure of
the applicant to receive the permit. Failure to apply for the necessary permits or service may
result in an order from the fire marshal to obtain a permit or service. Such an order shall be
considered as application made for the necessary permit or service. Fees are payable upon
permit application. Failure to pay for a permit, plan review or inspection fees imposed by this fee
schedule, within the time period spe~:,ified, shall render such permit null and void. All terminology
not defined in this chapter shall be clefined as stated in the Uniform Fire Code as adopted by the
City of South San Francisco
Unless otherwise noted, all fees are based on the provisions of the Uniform Administrative
Code, adopted January 22, 2003 in Resolution No. 12-2003.

RE Transient Occupancy Tax (TOT) Exemption for
Federal and State Government Business
RECOMMENDATION
It is recommended to the City Council there be a discussion of adding Transient Occupancy
Tax Exemptions for Federal and Si:ate government business to the Municipal Code.
BACKGROUND/DISCUSSION
At a past Conference Center Authority meeting, Authority Member Rudy Ortiz, General
Manager of the Embassy Suites, asked that there be a discussion of the lack of TOT
exemptions for government businE~ss in South San Francisco and what might be done to have
these exemptions granted. He noted other cities with which we compete allow these
exemptions, and this has created a competitive disadvantage for South San Francisco hotels.
At the next Authority meeting, a TOT exemption survey was provided and reviewed. The
survey revealed South San Francisco to be the only city in the competitive set without an
exemption provision for Federal and State government business. At the conclusion of this
report, the survey results are included. The Authority requested information on the amount of
business lost to South San Francis>co due to the lack of this exemption.
When checking with South San Francisco's hotels to discuss the amount of potential business
lost due to the lack of a TOT exennption, it was found South San Francisco does, indeed, have
a mechanism for TOT exemptions for Federal government business. This exemption has been
provided for several years although the Municipal Code is silent on this. In order to be granted
this exemption, employees must produce government identification and pay for their room with
an employer-issued credit card or other form of payment from their employer. They must also
fill out an exemption form. However, in South San Francisco, there is no TOT exemption for
State government business. Tlnis information was discussed at a subsequent Authority
meeting.

For some of South San Francisco':s hotels, the lack of a State government TOT exemption is
putting them at a competitive disadvantage. This business is choosing to go to other cities that
offer the exemption. The amount of business lost varies between transient and group business
and also varies by hotel dependingi on the primary markets sought and hotel price points. For
those hotels where the lack of a State government exemption causes their loss of the business,
the City is receiving no tax impact whatsoever. With a State exemption, there would be sales
tax revenue realized from other ex~-enditures made over and above the guest room(s).
Given the practice of South San Francisco providing a TOT exemption for Federal government
business, it is recommended the City Council discuss providing the same TOT exemption for
State government business with the provision the same administrative requirements for
Federal government business TO~f exemptions apply to State exemptions. State employees
must produce a government identification and pay for their room with an employer-issued credit
card or other form of payment from their employer. They must also fill out an exemption form.
Providing a State TOT exemption will put South San Francisco in the same competitive
position in this market and assist i!n the securing of business we would not have otherwise. It
would also establish the same practices in South San Francisco as in our competitive cities.
The Conference Center Authority is prepared to make this recommendation to the City Council.
Authority Member Rudy Ortiz, ones of the hotel representatives on the Authority, will be at the
City Council meeting to answer any questions or provide additional information. The Municipal
Code would require an amendment adding the exemption language.
