CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AMENDING THE PERMIT TO
GRADE A PORTION OF THE- PARCEL DESIG-
NATED AS PARCEL 16 IN WESTBOROUGH.
BE IT RESOLVED by the City Council of the City of South
San Francisco that:
1. The permit heretofore authorized by Resolution 4752
passed the 24th day of October, 1967, and Resolution 4779,
passed the 18th day of December, 1967, entitled "Permit
to Grade a Portion of the Parcel Designated as Parcel 16
in Westborough and to Remove Surplus Material from Said
Area", is hereby amended to add GMT Investors, a California
limited partnership, as additional Permittees, as said
additional Permittees have contracted to acquire the interest
of Caesar Callan Homes, Inc., in said designated parcel,
subject to the rights and interests of the City of South
San Francisco.
2. This amendment shall become effective upon the execution
of said permit by the Permittees prev%ously named and the
additional Permittees hereby added.
3. Caesar Callan Homes, Inc., shall not be relieved or released
from any of the obligations set forth in said permit by reason
of the amendment herein provided for.
4. Upon the fulfillment of the provisions of Paragraph 7 of
the permit and the compliance with the terms and conditions
of the Agreement entitled "Agreement Securing Performance
of Agreement of October 24, 1963, Re: Park-Recreation, Fire
Station and Public Library Sites in Westborough", entered
into between Caesar Callan Homes, Inc., et al, and the City
of South San Francisco, on the 5th day of June, 1967 (recorded
in the office of the County Recorder, Volume 5322, pages
132 through 200), or such portions thereof as the City
Council may designate, the City Council will approve an
assignment of the interest in said grading permit held by
Caesar Callan Homes, Inc., to GMT Investors, a California
limited partnership, or in lieu thereof the issuance of a
new permit to GMT Investors, a California limited partner-
ship, and Piombo Construction Company, a California corpora-
tion, as Permittees.
5. Should the provisions of this resolution not be complied
with or the interest in said Parcel 16 be reconveyed to
Caesar Callan Homes, Inc., by GMT Investors, a California
limited partnership, or its successors in interest or assigns,
then City may amend said permit and at its option delete
GMT Investors, a California limited partnership, as a
Permittee.
