A RESOLUTION CALLING' FOR S7_ALED PROPOSALS AND
FIXING LIQUIDATED DAMAGES FOR FAILURE TO
COMPLETE THE WORK WITHIN TIME SPECIFIED
ARMOUR - LINDEN STORM DRAIN ASSESSMENT DISTRICT
RESOLVED,- by the City Council of the City of South San
Francisco, California, that
WHEREAS, the said Council did, on the 2nd day of September,
1969, adopt its Resolution of Intention No. 5156 , to order the
construction of storm drainage pipe and appurtenances in said
City, all as more particularly described and set forth in said
Resolution of Intention;
NOW, THEREFORE, the City Clerk of this City is hereby
directed to publish once a week for two weeks in the Enterprise-
Journal, a newspaper published and circulated in said City, a
notice inviting sealed proposals or bids for the construction of
said improvements, and referrin~ to the plans and specifications
on file in the office of said Clerk, the first publication of
which notice shall be at least fourteen days prior to the time
fixed for opening bids.
All proposals or bids shall be accompanied by cash, a
cashier's or certified check payable to the order of the City
Clerk, amounting to ten percent of the bid, or by a bond in said
amount and payable to said Clerk, signed by the bidder and a

corporate surety or by the bidder and two sureties who shall
justify before any officer competent to administer an oath, in
double said amount and over and above all statutory exemptions.
The amount so posted shall be forfeited to said City in case the
bidder depositing the same does not, within fifteen days after
written notice that the contract has been awarded to him, enter
into a contract with the City.
It is hereby determined that in the event the contractor,
contracting owners included, does not complete the work within
the time limit specified in the proposed contract or within such
further time as this Council shall have authorized, the contractor
or contracting owners, as the case may be, shall pay to the City
liquidated damages in the amount of Fifty Dollars
($ 50.00 ) per day for each and every day's delay in finishing the
work beyong the completion date specified in said contract. Addi-
tional provisions with regard to said time of completion and
liquidated damages are set forth in the specifications, which
provisions are hereby referred to and incorporated herein by
reference.
Said sealed proposals or bids shall be delivered to the City
Clerk of said City on or before 2:00 o'clock P.N. on the 1st day
of October, 1969, said time being not less than fourteen days
from the time of the first publication of said notice. Bids
will be publicly opened, examined and declared ~on said day and
hour and referred to and considered by the Council at its meeting
at 8:00 o'clock P.M. on October 6, 1969.
I hereby certify that the foregoing resolution ~'as regularly intro-
duced and adopted by the City Council of the City of South San Francisco
at a regular meeting held on the 2nd day of SePtember, 1969, by the

Item 5 - Adjust existing downs.~outs~ leaders and drains
Said work shall include the furnishing and supplying of all
necessary labor and materials,
It is requested that all bias be submitted on both a unit and
group basis because said city reserves the right to make award of
contract on eithe~ a unit or group basis,
All said work is to be done at the places and in the particular
locations, and in accordance with the forms, sizes, d~nensions, and
materials and to the lines and grades~ and in conformance to the
profiles, detailed drawings, and specifications therefor which have
heretofore been approved and adopted by said City Council and which
are presently on file in the off'-ce of the City Clerk of said city,
Reference is hereby made to said plans, profiles, detailed drawings~
and specifications for further particulars, copies of which may be
procured from said City Clerk Bpon the making of a deposit of
TEN DOLLA~ (~ 10,~0¢ ) per set, of which sum FIVE
DOLLARS (~ ~'~,0~ ' ) will be refunded upon the return of sa'~d
plans and sPecifica~ions In good condition within SEVENTY-TWO (72)
HOURS after the bid date,
All proposals or bids shall be accompanied by a cashier's or

Francisco~ in an amount equal to not less than ten percent (10%) of
the bid figure~ or by a bond in said amount drawn in favor of said
city and executed by a corporate surety, Said check shall be for-
feited by bidder, or said bond shall become payable to said City in
case the lowest responsible bidder (or bidders) depositing the same
does not, within the t~ne set forth in said plans and specifications~
enter into a contract with said City~ the faithful performance of
which shall be guaranteed by an ~ndertaking in the amount of one
hundred percent (100%) of the sun, bid~ said undertaking being that
of a corporate surety satisfactory to said City Council~ and which
contract shall be accompanied by a labor and materials bond o~ a
corporate surety, also in a sum equal to one hundred percent (100%)
of the amount of said bid, as required by the provisions of Title I,
Division 5~ Chapter 3, of the Government Code of the State of
