CITY COUNCIL, CITY OF SOUTH T SAN FRANCISCO, STATE OF CALIFORNIA
AN ORDINANCE REPEALING CHAPTER 8.58 OF THE SOUTH
SAN FRANCISCO MUNICIPAL CODE
HEREAS, in 1 999, the City of South San Francisco " -City" adopted Ordinance No.
1 249, making it unlawful for any person to solicit, or attempt to solicit, employment, business
or contributions of money within the public fight-of-way; and
WHEREAS, since the City's adoption of said ordinance, courts have recently
recognized that solicitation is a form of speech protected by the First Amendment; and
WHEREAS, although it is not clear that said ordinance is in violation of the First
Amendment,, in order to fully protect individuals' First Amendment rights, the City wishes to
repeal ordinance No. 1.249.
NOW THEREFORE, the City Council of the City of South San Francisco does hereby
ordain as follows:
SECTION 1. AMENDMENTS.
The City Council of the City of South San Francisco hereby makes the following
amendments to the South San Francisco Municipal Code. Sections that are not amended by this
Ordinance are not included below, and shall remain in full force and effect.
Repeal Chapter 8.58 of the South Saga Francisco Municipal Code in its entirety.
SECTION 2. SEVERABIL1TY.
If any provision of this ordinance or the application thereof to any person or circumstance is

Adopted as an Ordinance of the City of South Francisco at a regular meeting of the City
Council held the 23 d day of May, 2012 by the following vote:
AYES: Councilmembers Mark Addle o, KLryl Matsumoto, and Kevin Mullin,,
Vice Mayor Pedro Gonzalez and Mayor Richard Garha n'no
NOES: None
ABSTAIN: None
ABSENT: None
