RESOLUTION OF THE REDEVELOPMENT AGENCY
OF THE CITY OF SOUTH SAN FRANCISCO
ADOPTING RULES FOR BUSINESS REENTRY
WITHIN THE GATEWAY REDEVELOPMENT PROJECT
RESOLVED BY THE MEMBERS OF THE REDEVELOPMENT
AGENCY OF THE CITY OF SOUTH SAN FRANCISCO:
WHEREAS, in furtherance of the objectives of
the Community Redevelopment Law, the Agency has undertaken
a program for the clearance and reconstruction or rehabilitation
of slum and blighted areas in the City and in this connection
is engaged in carrying out a redevelopment project known as
the Gateway Redevelopment Project (hereinafter referred to
as "Project"), in an area (hereinafter referred to as "Project
Ar~ea"), located in the City; and
WHEREAS, in furtherance of the implementation of
Project the Agency has undertaken various redevelopment
activities and contemplates further redevelopment activities
consisting of, inter alia, the adoption of a final Redevelopment
Plan; and
WHEREAS, the Community Redevelopment Law, Division
24 of the California Health and Safety Code, (Section 33339.5)
provides for reentry in a Redevelopment project by the persons
engaged in business within the Project Area subject to certain
conditions including compliance with the Redevelopment Plan; and
-- WHEREAS, the provisions pertaining to the aforesaid
owner participation are incorporated in the proposed Gateway
Redevelopment Plan which will be adopted by the legislative
body and the Agency of the City of South San Francisco; and
WHEREAS, the Redevelopment Agency of the City of
South San Francisco on this date had presented to it rules
for "Business Reentry'.' within the Gateway Redevelopment
Project, copies of which are on file at the Redevelopment
Agency office; and
WHEREAS, said Redevelopment Agency desires to
adopt said rules for reentry of persons engaged in business
in the Gateway Redevelopment Project in the form presented to
i~c on this date;
NOW~ THEREFORE, BE IT RESOLVED BY THE REDEVELOPMENT
AGENCY OF THE CITY OF SOUTH SAN FRANCISCO AS FOLLOWS:
THAT, the attached "Business Reentry Rules" has
been reviewed and is found to meet the requirements of the
Communi~cy Redevelopment Law, Division 24, Part 1, Chapter 4,
Article 4, Section 33339.5; and
THAT, the attached "Business Reentry Rules" for
the Gateway Redevelopment Project are hereby adopted.

· . RULES FOR BUSINESS REENTRY
IN'GATEWAY REDEVELOPMENT PROJECT
Business R~e'ntry
Pursuant to the Health and Safety Code, Section
33339.5 the Redevelopment Agency is required to prepare and
adopt rules for re-.entry of business entities situated within
the Gateway-Redevelopment Project Area. There are two privately
owned parcels within the Project Area, the Bethlehem Steel
plant site and the Edwards Wire Rope Company site. The
Bethlehem site is vacant and wholly owned by Agency's proposed
-- Project Developer. The Edwards Wire Rope Compaany site is
occupied by-two commercial tenants under one lease which
expires February 28, 1985. The proposed redevelopment would
permit these tenants to remain on the Edwards Wire Rope parcel
for the remainder of the lease term. Accordingly, there will
be no displacement of businesses and no re-entry involved in
the Gateway Redevelopment Project. In the event the Project
plans change and displacement does occur the following business
re-entry rules shall apply:
1. Purpose. These rules have been adopted by the Redevelopment
Agency of the City of South San Francisco (hereinafter called
"the Agency") pursuant to Section 33339.5 of the California
Community Redevelopment Law to implementing the operation of
business reentry in connection with the Gateway Redevelopment
Plan for the Project. It is the intention of the Agency to
extend, to the greatest extent practical, reasonable preferences
to persons engaged in business in the Project Area to reenter
within the Project Area if they otherwise meet the requirements
prescribed by the Redevelopment Rlan.
2. Applicability. These rules shall apply to all persons
engaged in business within the Project ARea.
3. Eligibility for Business Reentry. Eligibility of persons
or business for reentry under a Reentry Agreement shall be
determined solely by the Agency. In general, persons or
businesses in areas within the project scheduled for redevelop-
ment may be eligible for reasonable preference as to business
reentry, provided all the requirements of the Redevelopment
Plan are met.
4. Proposals. Each person or business desiring to reenter
in the Project shall submit a written proposal to the Agency
staff. The Business Reentry proposal shall include all con-
templated activity, along with the proposed time schedule for
completion and the manner in which the reentry conforms to the
Redevelopment Plan. The Agency shall then determine whether
the proposal conforms to the Redevelopment Plan and is accept-
able and so advise the person or business. Provided the pro-
posal is found acceptable to the Agency, each person or business
will be required to enter into a contract with the Agency in-
cluding but not limited to the following:
1. Proof of compliance with the standards
and uses to be in conformance with the
Redevelopment Plan.
2. The execution of a non-discrimination provision.
3. Proof of financial responsibility.
-- 5. Business Reentry Agreements. Each Business Reentry
Agreement shall set forth the terms and conditions by which
the owner may reenter the Project Area and comply with the
Redevelopment Plan. The time for beginning and completing
such entry shall be set forth in the Agreement to the extent
possible. The Agreement shall also contain such others considered
necessary by the Agency to effectuate the purposes of the

Redevelopment Plan.
6. Time for Exe'cut~i~on'of~Business'Reen~t~r~y Agreements. The
Agency shall stipulate the date by which such Agreement must
be executed by the person or business.
7. Amendment. These rules may be amended from time to time
by the Agency.
