Recommended Approach&Language for Direction and Motion
Staff is recommending "Alternative A", which amends the use classifications definition section of the
ordinance to differentiate between "Large Format Retail", "Membership Warehouse Clubs", and
"Superstores". All three of these terms are currently in the ordinance, but at this time, membership
warehouse clubs and superstores are only used as example uses within the definition for"Large Format
Retail".
To implement this change staff recommends that Council:
1. Direct staff to amend Zoning Code Chapter 20.620("Use Classifications")to better define and
separate the "Large Format Retail", "Membership Warehouse Clubs",and "Superstores" uses,
and to implement those definitions in the appropriate Land Use Regulation tables, including
Table 20.090.002 ("Land Use Regulations—Commercial, Office,and Mixed-Use Districts"), and
Table 20.110.002 ("Land Use Regulations—Employment Districts")to ensure that grocery uses
are appropriately addressed in the City's land use regulations.
2. Make a motion to authorize the City Manager to enter into a contract, not to exceed $50,000,
for the purpose of hiring consultants to assist with the preparation of the environmental review
and economic analysis related to the Zoning Code amendments.
Should Council direct staff to execute "Alternative B", which would impose a limitation on the land use
regulations for"Large Format Retail" in the FC district and would likely impose a Conditional Use Permit
for any"Large Format Retail" that includes grocery uses,the following direction and motion would be
appropriate:
1. Direct staff to amend Zoning Code Table 20.110.002 ("Land Use Regulations—Employment
Districts")to differentiate the review and approval process required for"Large Format Retail"
uses that include grocery uses and those that do not include grocery uses; and
2. Make a motion to authorize the City Manager to enter into a contract, not to exceed $50,000,
for the purpose of hiring consultants to assist with the preparation of the environmental review
and economic analysis related to the Zoning Code amendments.
