· he hour of 8 o'clock p. m. for doing the following street work in said City of South

Repairing pavement on ~ra~l Avenue, between Mission Road and Lindea Avenue,
on Linden Avenue between Armour Avenue and Railroad Avenue, and on Railroad Avenue
ween Lindea Avenue and a point 500 feet westerly therefrom,
All said work shall be done to official grade and at the places show~ upon
~he pla~s and speoifiaations heretofore adopted by said City Contrail for doing said
work, and strictly in accordance with the plans and specifications.
No bid will be accepted from a contractor who has not been licensed in
accordance with the.provisisions of an act of the Legislature of the State of Calif-
ornia, entitled~ "An Act providing for the registration of cc~t~actors, and ~fining
~he term contractor; providing the method of obtaining licenses to engage in the
~usines, of contracting, an~ fixing the fees for such lice~ses; providing the method
of suspension and cancellation of suah licenses= and prescribing the punishment for

It shall be mandatory upon the contractor to ~hom the contraet is awarded,
and upon any sub-contractor u~ler him, to pay ~not less than the said specifie~ rates to
all laborers, workmen and mechanics employed by them in the execution of the .contract,
The contractor shall forfeit as a penalty to the City of South San Francisco ~
Dollars ~$10.00} for each laborer, workman or mechanic, employed for each calendar day,
or portion thereof, such laborer, workman or mechanic is paid less tha~ the saiA
stipulated rates for any work done under said contract, by him, or by any sub-con-
tractor u~ler him. Aml such contract shall contain' a stipulation to this effect, in
accordance with the prov~isio~ of Chapter 39? of the Statutes of Califoxnia 19Z1,
~0TICE IS F~RTHER HERE~ GI~F~, that no person, firm, partne, rship,
association, ~r corporation, or agent thereof, doing any of the work herein pr. critical
for, as a contractor, or sub-contractor, shall knowi~ngly employ,, or cause or allow to
be employed thereon, any alien, except in eases of extraordinary ~nergency caused by
fire, flood or danger to life or property.
The contraetor, to wh~m a contract for said work'ma2 be awa~de~, shall

The time of service of any laborer, workman or mechanic emploFed on any
of said work is hereby limited to thirty ~ hours during any one calendar week.
The contract to be awarded shall contain a provision e~b0~ving the
foregoing limitations with respect to the time of service of any such laborer, work-
man or mechanic who may be employed upon any of said work and the further stipulation
that,~ for every such person emp!oye~ in the execution of such contract, whether such

The contract must be entered into in compliance with and subject to
the conditious imposed by Section $53c of the Penal Code of the State of California.
Such contract sha..ll contain a stipulation which shall provide that the contractor
to whom said contract is awarded shall forfeit as a penalty to enid City of South San

The contract to be awarded shall contain a further stipulation that the
contractor, to whom such contract, may be aearded, shall use or supply only such
m~uufaotured articles, materials, and supplies as may have been mined or l~roduced ia
the United States and only such m~nufactured articles, materials, and supplies as
have been manufactured in the United States, substantially from all articles, materials
or supplies mined, produced, or so manufactured, as tbs case _m_~y be, in United States,
exeeptiz~ only where such articles, materials, or supplies of the class or kin~ to be
used, or the articles, materials or supplies from which the2 are m~nufaotured are not
mined, produced or ~ufactured, as the case may be in United States, as required by an
act of tbs Legislature of the State of California entitled: "An act to require the use
of materials and supplies substantially produced in the U~ed States, in pub lie works
and for public purposes"; Chapter 226 of the .Statutes of Californ~&, 1933.
The contractor to whom the contract may be awarded will be required
comply with the terms of that certain act of the Leg~lature of the State of California
know~ as the "California Industrial Recovery Act", Chapter 1039 Statutes of California
1933. Such contract shall contain a clause providing that the contractor shall give
preferaace of fifteen (15) per cent to supplies, articles and materials mined, pro-
duced, manufactured or supplied in:observanse of aT code of fair competition,
approved, prescribed or issued under Title I of the l~ational Industrial Recovery
Act, or under any similar law of the State of California, or in pursuance of any
agreement entered into or approved ~mAer said laws, or in ~'onformity with the
terms prescribed'in any licenses taa~d un, er said laws as the ease may be, and
which concerns such trade or imtustry and subdivision thereof as may be involved,
and, in the purchasing of materials, or supplies for public u~e, shall give a
preferanse of ten (10) per cent to a~y bidder who expressly agrees to furnish
only suah materi~'ls or supplies so mined, pro~uced, manufaetured or supplied,
The successful bidder shall, within ten days, after the ward, enter into
a contract with t~e City of South S~u Fra~isco for the faithful performance of the
work to be done under said award. All proposals must be aecoml~nied by a certified
check upon a solvent bank of the State of California, payable to the City of South
San Francisco in an a~ount not less than ten per cent of the a~gregate of the bid
upon the condition that, if the proposal be accepted and the contrast awarded and if
the bidder shall fail and neglect ~o execute a contract and give the bond~ required, the
sum mentioned in said check shall be liquidated' damages for such failure a~l neglect
and shall be forfeited to and paid into the treasury of the City of South Sas Francisco.
The bidder to whom the contrast is awarded, will be required to execute a bond for the
faithi~-I performance of his work in an amount equal to fifty (~) per sent of the amount
of the Undertaking with at least two responsible sureties in the full amount of the
bid eaeh; and will also be required before entering upon the work, to furnish a good
and sufficient bend, as required by an act of the Legie~lature of the State Of California,
approved May 10, 1919, entitled~ "An act to secure the paymant of the claims of ~er~one
employed by contractors upon public works and the claims of persons~who furnish materials,
supplies, teams, implements or machinery used or consumed by such c~ntraetorin the per-
romance of such works, and prescribing the duties of certain publis-oi~icers with rea-
peet thereto", Chapter ZOZ of the Statutes of California, 1919.

All sealed proposals will be opened by said City Council in public session
on Monday, the 3rd day of June, 1935, at 8 o'clock p. m. at the council ~hamber of
sai~ City Council. ~
Said City Council reserves the right to reject any and all bids.
