TO CONSTRUCT A PIPE LINE. ACROSS AND THROUGH ~RrE LAND
AND STREETS OF SAID CITY OF SOUTH SAN FRANCISCO.
RESOLVED Dy the City Council of the City of South San Francisco that said City Council
hereby grants, subject to the express conditions hereinafter set forth, to the City and County of
San Francisco, State of California, permission to construgt,~reconstruct, maintain, operate,
repair and remove a water pipe line, not exceedin~ sixt~ (60) inches in diameter, along, ~cross
and though the land and streets of said City of~outh Oan Francisco described as follows.
PARCEL I
(Third Street, Baden)
COM~NCING at a point on t he southwesterly line
of the Corporate Limits of the City of South San Fran-
cisco, said ~outhwesterly line being also the northeast-
erly line of the State Highway known as E1 Camino Real;
running thence from said point of commencement along a
line parallel to and distant V.00 feet measured at right
.angles southeasterly from the outer edge of curb on the
northerly side of Third Street of the Town of Baden north
63 degrees 36 minutes 10 seconds east 969.5V feet~more
or less to a point on the common boundary line between
the Town of Baden and the Market Street Railway right of
way.

from the intersection of the northeasterly line of
Railroad Avenue with the southeasterly line of Orange Ave-

35 degrees 59 minutes 10 seconds east 2.90 feet; thence
north 56 degrees 59 minutes 40 seconds east 29.29 feet; thence
north 15 degrees 30 minutes 40 seconds east 30.00 feet; thence
along a line parallel to and distant 7.00 feet measured at
right angles northwesterly from the outer edge of curb on t he

COMMENCING at a point on the northwesterly boundary
of Palm Avenue, said point being distant north 15 degrees
30 minutes 40 seconds east 137.02 feet from the southwest
corner of Lot 4 Block i Parkway Terrace, hereinabove mentioned
in t he description of Parcel 3; running thence from said
point of commencement along the southwesterly side of Palm
Avenue south 74 degrees 54 minutes l0 seconds east 552.37
feet; thence north 73 degrees 36 minutes 40 seconds east 109.22
feet; thence south 70 degrees §0 minutes 05 seconds east 4.84
feet to a point on the southeasterly line of Palm Avenue; said
southeasterly line of Palm Avenue being the northwesterly
boundary line of Lot 16, Block 2 of "Parkway Terrace Map No. 2"
as per map recorded June 2, 1931, in Volume 19 of Maps, page 58,
San Mateo County Records; said point being distant along said
northwesterly bou~dary line of Lot 16 on the arc of a curve to
the left with a radius of 150.00 feet through a central angle of
2 degrees, 32 minutes 52 seconds a distance of 6.67 feet from
themost westerly corner of said lot 16.

Avenue, said westerly line being the easterly boundary

and distant along said easterly boundary line on the arc of a
curve to the right with radius of 250.00 feet through a cen-
tral angle of 8 degrees ll minutes 36 seconds a distance of
35.V5 feet from the northeast corner of Lot 17; running thence
from said point of commencement along a line parallel to and
distant 5.40 feet measured at right angles nort~vesterly from
the outer edge of curb on the southeasterly side of School
Street north 58 degrees 46 minutes 50 seconds east 33V.32 feet
to a point on the northeasterly line of Olive Avenue distant

central angle of 0 degrees 03 minutes 45 seconds a distance
of 2.33 feet and north 26 degrees 41 minutes 45 seconds west
7.61 feet from the point of intersection of the southwesterly
boundary line of Hillside Boulevard with the northwesterly line
of the l0 foot right of way designated as Parcel No. 20 in
that certain deed to California Water Service Company from
Pacific Water Company, dated February l, 1931, recorded July
17, 1931, Book 528, page 195, Official Records of San Mateo
County; running thence from said point of commencement North

northeasterly line of said Hillside Boulevard, said point being
distant along said northeasterly line on the arc of a curve to
the right with a radius of 2065.00 feet through a central angle of

26 degrees 41 minutes 45 seconds west 15.32 feet f~m the in-
tersection of said northeasterly line with the westerly boundary

the hereinbefore mentioned deed to California Water Service Com-

( Randolph Avenue)
C0~,IENCING at a point on the co,non boundary line
between the lauds of the South San Francisco Land and Improve-
ment Company and the 31.V2 acre tract of land known as Peck's
Subdivision No. l, said common boundary line being also the
westerly boundary line of Randolph Avenue and said point being
distant south 13 degrees 24 minutes 05 seconds west 25.08
feet from the northwesterly corner of said 31.72 acre tract;
running thence from said point of comencement along a line
parallel to and distant 20 feet measured at right augles north-
erly from the outer edge of curb on the southerly side of
Randolph Avenue south 76 degrees 19 minutes 25 seconds east 227.06
feet; thence along a line parallel to and distant ~.00 feet
mesured at right angles easterly and northerly from the outer edge
of a curb on the westerly and southerly side of Randolph Avenue
south 13 degrees 39 minutes 20 seconds west ll2.13 feet and south
76 degrees 37 minutes 20 seconds east 1482.01 feet to a point on
the southeasterly line of s aid 31.V2 acre tract; said south-
easterly line being the common bouudary line between said 31.V2
acre tract and the State Highway known as Bayshore Highway and
said point being distant south 42 degrees 40 minutes 12 seconds
west 15V.29 feet fr~n a 6" x 6~ concrete highway monument on
the common boundary line between said 31.~21 acre tract and the
lands of the Crocker Estate Company.
. The permission granted to s aid City and County of San Francisco, hereinafter
designated as "grantee" in this resolution, is given upon the express conditions that
all excavation work necessary in laying the water pipe hereinbefore mentionr, and all
back filling and replacement of pavement shall be made in strict conformity with the
provisions of Ordinance No. 78 of said City of SoUth San Fr~cisco entitled: "An
ordinance regulating the digging up and disturbance of roadways and sidewalks in the
public streets, lanes, alleys and public places in ~ he City of South San Francisco;
regulating the refilling and repair of disturbed streets and roadway thereof; and
providing a penalty for the violation thereof", adopted the 14th day of May, 1914, as
amended by ordinance No. 140 of said City of South San Francisco entitled "An ordinance
amending ordinance #~8 entitled 'An ordinance regulating the digging up and disturbances
of Roadways and Sidewalks, in the Public Streets, Lanes, Alleys and Public Places in the
City of South San Francisco, Regulating the Refilling and Repair of Disturbed Streets
and Roadways Thereof'", adopted April §, 1928,~ and in accordance with tt~ following
regulations:
If it shall be necessary to cut or remove any main sewer, sewer lateral or storm
sewer conduit, it shall be the duty of the grantee to replace or repair such s ewer~
sewer lateral or storm water conduit, as the case may be, within a period of two hours
after cutting or removing the same. Under no circumstances shall any s ewer, sewer
lateral or storm water conduit be left disconnected betwee~ the hour of 5 o'clock p. m.
of any day and the hour of 8 o'clock a. m. of the day following.
Whenever it shall become necessary to replace or repair any sewer, sewer lateral,
or storm water conduit, the work of such replacement and repair shall be done in such a
manner as to maintain the official line and grade heretofore established for the same.
If it shall become necessary to remove or replace any existing manhole, a new
manhole must be rebuilt in place thereof and in conformity to the standard manhole
heretofore constructed in said City of South San Francisco. Under no circumstances shall
any manhole be relocated more than ten feet from the location of any existing manhole.
It shall be the duty of the grantee to avoid interruption of service of water
through water mains existing in any street or highways where any excavation is to be made
by said grantee. If it shall become necessary to remove any portion of any water main,
provision must first be made for-!-he.maintenance of the supply of water to those who are
dependent upon such water main. In no event shall there be a cessation of water service
for a greater period th~_n two hours. Before the interruption of any water service for
such period of two hours, it shall be the duty of the grantee to notify all water consumers
dependent upon such service through any main which it may become necessary to remove or
replace, prior to any interruption of service. At all times the fire hydrants of said city
shall be kept free and clear of all obstruction and the work shall be so performed that
access to such fire hydrants may be had at all times. It shall be the duty of the grantee
at all times to construct suitable bridges or other structures across the open ditch in
such a manner and at such places as to permit the occupants of private garages along the
line of the work to have uninterrupted and safe access thereto. Any gutter or curbing which
may be removed or displaced during the work herein contemplated, shall be replaced in
accordance with the official line ar~l grade at which such curb was originally constructed,
and the work of replacing the same shall be done to the satisfaction of the city engineer
of said city. Under no circumstances shall the grantee remove or obstruct the sidewalk
on either side of the street through which any excavation may be made.
At no time during the performance of t he work herein contemplated shall any trench~
be open for a distance in excess of 1000 feet ahead of where the pipe is laid.
Said g~antee shall repair or replace any building or buildings situated along the
side of said work which may be damaged by work to be performed hereunder. In every case
the extent of the d~mages or repairs or replacements made necessary thereby shall be
determined by arbitration in t he usual manner, that is to say: Said city shall select one
disinterested person, said grantee shall select one disinterested person, and the two persons
so selected shall select a third disinterested person. The determination of any two of such
three persons shall be conclusive upon said grantee and upon said city of South San Fra~ sco.
Said grantee shall hold said City of South San Francisco free and harmless fr~m and
against all claims for damages, liabilities, penalties and forfeitures of every kind and
character whatsoever which may arise directly or indirectly from the construction, install-
ation, operation, maintenance or repair of any water pipe which may be laid hereunder.

I hereby certify that the foregoing resolution was regularly introduced and adopted
by the City Council of the City of South San Francisco this 28th day of November, 19JO, by
