RESOLVED by the City Council of the City of South San Francisco that oublic
interest and convenience require the~followinc public improvement work to be done in said
city, in the location shown upon the plans formin? a part of the plans and s~ecifications
entitle~"Plans and specifications for the construction of sanitary sewer in South

the City Council of the City of South San Francisco, on the 23rd day of September, 1936.
All Of said work shall be done to official grade and strictly in accordance with
said plans and specifications.
Said City Council hereby ascertains that the g~neral prevailing rates of per
diem waces and the 7eneral prevailing rate for leMal holiday and overtime work applicable
to the said work to be done are as follows:

newspaper of zeneral circulation published and circulated in the City of South San

NOTICE IS HEREB~ GIVEN that sealed proposals or bids will be received by the
City Council of the City of South San Francisco on the 19th day of October, 19~8, until
the hour of 8 o'clock p.m. for doinT the followin~ oublic work in said City, to,wit:
the construction of a sanitary sewer in the South Industrial Area of said City of
South San Francisco.
All work shall be done to official ~rade and at the places shown upon the plans'
and specifications for said work adopted by said City Council on the 25rd day of
September, 1~)~6, and strictly in accordance with said plans and specifications.
No bid will be accepted from a contractor who has not been licensed in
accordance with the provisions of an act of the Le~jislature of the State of California
entitled: "An act providing for the recistration of contractors, and definin? the term
contractor; providing the method of obtainiuC licenses to engage in the business of
contracting, and fixing the fees for such licenses; .providinc the method of suspension
and cancellation of such licenses; and prescribin~z the punishment for violation of the
provisions of this act." Chapter 791 of Statutes and amendments of 19~, as amended.

It shall be mandatory upon the contractor to whom the contract is awarded,
and upon any subcontractor under him, to pay not less than the said soecified rate to all
laborers, worl~en and mechanics e~ployed by them in the execution of the contract. The
contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars (~10.00)
for each laborer, wor~nan or mechanic employed, for each calendar day, or portion thereof,
such laborer, worlmuan or mechanic is paid less than the said stipulated rates for any work
done under said contract, by him, or by amy subcontractor under him. ~d such contract shall
conta~n a stipulation to that effect, in accordance with the provisions of Chapter 39~ of
the Statutes of California 1931.
NOTICE IS F-~TMER HEREBY CIVEN that no person, firm, partnership, association,
or corporation, or agent thereof, doing any of the work herein provided for, as a con-
tractor, or subcontractor, shall knowingly employ or cause or allow to be employed thereon,
a~ay alien, except in cases of extraordinary emergency caused by fire, flood or dan~er to life
or property. The contractor, to whom a contract for said work may be awarded, shall forfeit
as a penalty to said City of South San Francisco Ten Dollars (~10.00) for each alien
knowingly emDlbyed in the execution of such contract by him, or by any subcontractor under
him, for each'calendar day, or oortion thereof, durin~ which such alien is permitted or
required to labor in violation of an act of the Legislature of the State of California
entitled: "An act to prohibit the ~mlolo~uuent of aliens by contractors and subcontractors on
all public work, except in certain cases of extraordinary emergency and the keeping of
~records of the citiMenship of workers employed upo~ public work and the inspection of such
records by the p~oper officials, providing for a forfeiture for each calends, r day or portion
thereof, any aiien is knowingly permitted to work on oublic work and for a stipulation to
this effect in~the contract, and providing other penalties for violation of the provisions
thereof," approved Nay ~8, 1~331, Statutes of 1931, page 91~.
The contract must be entered into in compliance with and s~bject to the conditions
i~?~posed by Section G~Sc of the Penal Code of the State of California. Such contract shall
contain a stipulation which shall provide that the contracto to who~ said contract is awarded
shall forfeit as a penalty to said City of So~th San Francisco TenDollars ($10.00) for each
laborer, workman, or mechanic employed ~.n the execution of said contract, by him, or by any
subcontractor under him, upou any ~of the ~ork herein mentioned, for each calendar day during
which such laborer, workman or mechanic is required or permitted to labor more than eight (8)
hours in vi~lation of the provisions of Section GSSc of the Penal'Code of the State of
California.

The contract must be entered into in compliance with and subject to the conditions
imposed by Section 653c of the Penal Code of the State of California. Such contract shall
contain a stipulation which shall provide that the contracto to whom said contract is awarded
shall forfeit as a penalty to said City of So~th San Francisco TenDollars ($10.00) for each
laborer, workman, or mechanic e~ployed in the execution of said contract, by him, or by any
subcontractor under him, upon any of t~e ~ork herein mentioned, for each calendar day during
which such laborer, workman or mechanic is required or permitted to labor more than eight (8)
hours in vi~lation of the provisions of Section G53c of the Penal Code. of the State of
California.
The contract to be award,edshall contain a further stipulation that the contractor,
to whom such contract may be awarded, shall use or supply such unmanufactured articles,
materials, and supplies as may have been mined or produced in the United States and only such
manufactured articles, materials, and supplies as have been manufactured in the United States,
substantially from all articles, materials or supplies mined, produced, or so manuzact~red,
as the case may be, in the United States, excepting only where such articles, materials, or
supplies of the class or kind to be used, or the articles, ~aterials or supplies from which
they are manufactured are not mined, produced or manufactured, as the case may be in United
States, as required by an act of the Legislature of the State of California entitled: "An
act to require the use of ~aterials and supplies substantially produced in the United States,
in public works and for public purposes"; Chapter ~2~ of the Statutes of California,
The successful bidder shall, within ten (10) days, after the award, enter into a
contract with the City of South San Francisco for the faithful performance of the work to
be done under said award. Ail proposals must be accompanied by a certified check upon a
solvent bar~ in the State of California, payable to the City of South San Franbisco in an
at. cunt not less than ten(lC) per cent of the aggregate of the bid upon the condition that, if
the p~oposA1 be accepted and the contract awarded and if the bidder shall fail and neglect to
execute a contract and ~give the bonds required, the sum mentioned in said check shall
be liquidated damazes for such failure and neglect and shall be forfeited to and paid
into the treasure of the City of South San FranciscO. The bidder to whom the contract
is awarded, will be require~, to execute~a bond for the faithful perfomance of his work
in an amount e$1al to ~i~ty ($0) per cent of the amount of the undert~in~ with at
least two responsible sureties in the full amount of the bid each; and will also be required
by an act of the Legislature of the State of California, approved ~'~a~? 10, 1313,
entitled: "An act to secure the payment of the claims of persons employed by contractors
upon public works, and the claims of persons who furnish materials, supplies, teams,
i~plements or machinery used or consumed by such contract, ors in the performance of such
works, and prescribing the duties of certain public officers with respect thereto",
Chapter S0Z of the Statutes of California, l~l~.
Plans, specifications and proposal sheets may be obtained at the office of
George A. Kneese, City Engineer of said City of South San Francisco, at No. ~8~ Broadway,
Redwood City, California.
Sealed proposals or bids will be delivered to the City Clerk on or before
8:00 o'clock p.m. on Nonday, the 19th day of October , 19S8. All sealed proposals
will be opened by said City Council in public session on ~onday, the 19th day of 0ctober.

Said City Council reserves the rizht to reject any and all bids.
