OF LEASE WITH JOSEPH AND MARGARET
HEARNE
RESOLVED by the City Council of the City of Sou~h San Francisco that said
city enter into a~lease with Joseph Hearne and Margaret Hearne, his wife, for the
use of the land hereinafter described for the purpose of a playground for children,
and for no other purpose, at the annual rent of sixty dollars ($60.00) payable in
advsnce.
The land hereinbefore referred to consists of thcs certain lots or parcels
of land situate in the City Of South San Francisco, County of San Mateo, State of
California, and particularly described as follows, to-wit:
Lots numbered ten (10) and eleven (11) in block numbered one hundred and
thirty-five (135), as shown upon that certain map entitled: "South San Francisco, San
Mateo Co. Cal. Plat No. l", which map was filed in the office of the County Recorder
of the County of San Mateo, California, March l, 1892~ and recorded in Map Book No.
2 at page 52.
· Such lease shall also provide that, unless the lessors or the lessee shall
elect to terminate the same by giving to the lessee, or to the lessor, as the case
may be, sixty (60) days~ notice of such election prior to the end of the term of
the same, such lease shall be deemed to be renewed for the period of one (1) year
commencing upon the expiration of such term, and that said l~nd shall be deemed
to be leased to t he lessee from year to year, and subject to the right of the less-
ors or the lessee to terminate the same upon 'giving sixty (80) days~' written notice.
Such lease shall also provide that, at the termination of said term, or at
the expiration of the period of any renewal or extension of the same, the lessee shall
remove from said land any and all equipment, apparatus, structures and fixtures of
every character which the~le~see may have placed upon said lsnd or may have affixed
thereto.
Such lease shall also provide 'that it is made upon ~he express condition
that the lessors are to be free from all liability and claim for damages by reason
of any injury to any person or persons, ~ucluding the lessee or property of any kind
whatsoever and to whomsoever belonging, including lessee's, from any cause or causes
whatsoever while in, upon, or in any w ay connected with the said demised premises
or the sidewalks adjacent thereto during the term of such lease or any extension
thereof or any occupancy thereunder, and that the lessee shall covenant and agree to
defend, indemnify and gave harmless the lessors from all liability, loss, costs and
obligations on account of or arising out of any such injuries or losses however
occurring.
The mayor and the city clerk of said city are hereby authorized and directed,
in the name of said city of South San Francisco and under its seal, to execute the
lease hereby authorized.

I hereby certify that the foregoing resolution was regularly introduced and
adopted by the city council of the City of South San Francisco, this 18th day of
October, 193V, by the following vote:
