A RESOLUTION ORDERING RECONSTRUCTION AND ~LARGEMENT OF EXISTING
SEWAGE PUMPING STATION IN THE CITY OF SOUTH SAN FRANCISCO AND
THE INSTALLATION OF S~VAGE PUMPS AND THE CONSTRUCTION OF APPURTt~NT
FAC ILITIE~.
.~SOL~FED by the City Co~n~cil of the City of South ,B~ Francisco that public interest and necessity
require th.e following improvement work to be done in said city: the ~econstruction and enlargement of existing
sewage pumping station in the City of South San Francisco, the installation of sewage pumps and the construction
of appurtenant facilities, in the City of South San Francisco.
Ail said work shall be done at the location shown upon the plans hereinafter mentioned and str.ictly
in accordance with the plans and specifications submitted for said work by the works engineer by said city, and
hereby adopted for said work. Ail said work and all the materials used in connection therewith shall be
furnished under the direction and to the satisfaction of said works engineer.
Said city council hereby ascertains that the general prevailing rates for legal holiday and overtime
work applicable to said work to be ~one are as follows:

The rate for any classification not shown above shall be the established union rate for San Mateo
County, California.
The following are to be considered as holidays: New Year's Day Decoration Day, Independence Day,
Labor Day, Adminssion Day, Thanksgiving Day, Christm~s Day, Saturdays and Sundays.
The city c!e~k is hereby directed to cause a notice inviting seal proposals for doing Said work an~
for the furnishing of all materials necessary therefor to be published by two (2) insertions, not less than
five (5) days apart, in "The Enterprise , a newspaper of general circulation, published and circulated in th.
City of South San Francisco, which notice shall be substantially in the following form:

Notice is hereby given that sealed proposals or bids will be received by the city council of the Citl
South San Francisco on ~onday, the 20th day of March 1950, at the hour of 8 o'clock p.m., for doing the follow~
improvement work in said city, to wit:
The construction and enlargement of existing sewage pumping station, t~e installation of sewage pump.
and the construction of a pertinent facilities in the City of South San Francisco.
All said work and the materials used in connection therewith shall be furnished under the direction
to the satisfaction of the works engineer of ssid city.
Said city council has ascertained that the general prevailing rates for hourly wages, and the geners
prevailing rates for legal holiday and overtime work applicable to said work to be done are as follows:

The rate for any classification not shown above shall be the established union rate for San Mateo County,
California.
The following are to be considered as holidays: New Year's Day, Decoration Day, Independence Day, Labor Day,
Admission Day, Thanksgiving Day,. Christmas Day, Saturdays and Sundays.
It shell be mandatory upon the contractor, to whom the contract is awarded, and upon any sub-contractor
under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the
execution of the contract. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars
($10~00) for each laborer, workman or mechanic employed for each calendar day, or portion thereof, such laborer, work-
man or mechanic is paid less than said stipulated rates for any work done under said contract, by him, or by any sub-
contractor under him. Such contract shall contain ~. stipulation to this effect, in accordance with the provisions of
Chapter 397 of the Statutes of California, 1931.
No bid will be accepted from any contractor who has not been licensed in accordance with the provisions of an
act of the legislature of the State of. California entitled: An act providing for the registration of contractors, and
defining the term contractor,, providing t~e method of obtaining licenses to engate in the business of contracting, and
fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses! and prescribing
the punishment for violation of the provisions of this act". Chapter 791 of the Statutes and Amendments of 1929, as
amended.
No~ice is further hereby given that no contractor or subcontractor or agent or representative thereof shall
tmowingly employ or cause or allow to be employed, on the work herein provided for, any alien, except in case of
extraordinary emergency caused by fire, flood, or danger to life or property.
The contractor or sub-contractor to whom the contract for said work may be awarded shall forfeit as a penalty
to'the City of South San Francisco, Ten Dollars ($10.00) for each alien knowingly employed in the execution of such
contract, for each calendary day, or portion thereof, during which such alien is permitted or required to labor in
violation of the provisions of Article 4 of the Labor Code of the State of California. A provision to this effect shall
be inserted in such contract. The contract must be entered into in compliance with and subject to the conditions
imposed by Article 3 of the Labor Code of the State of California.
Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's
work in the performance of the work herein provided for, and that no contractor or buscontracto~ who employs, dire6ts
or controls the work of any workman employed on publix work, shall require or permit such workm~n to labor more than
(8) hours during any one calendar day, except in cases of extraordinary emergency, caused by fire, flood or danger to
life or property and shall contain the further stipulation, which shall provide that the contractor, to whom the contract
is awarded, shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each workman employed
in the execution of such contract by the contractor, or by any subcontractor, for each calendary day during which any
workman is required or permitted to labor more than eight (8) hours in violation of the provisions of said Article 3.
The contract to be awarded shall contain a further stipulation that the contractor, to whom such contract may be
awarded, shall use or supply only such ummanufactured materials, produced in the United States, or substantially from
materials produced in the United States, excepting where such articles, materials or supplies from which they are manufactured,
are not mined, produced or manufactured, as the case may be, in the United States, as required by Chapter &, Article I of
the Cover~ent Code of the State of California.
Price, fitness and quality being equ~l, said contractor shall~ in the performance of the contract, prefer supplies
grown, manufactured, or produced in the State of California, and shall next prefer supplies partially manufactured, grown
or produced in this state.
The successful bidder shall, M~thin ten (10) days after the award, enter into a contract with the City of South
San Francisco for the faithful ~arformance of the work to be done under sai~award. All sealed propsoals or Hids shall be
accompanied by a check payable to the City of South San Francisco, certified by a responsible bank, for an amount which
shall not be less than ten (10) percent of the aggregate of the proposal, or by a bond for the said amount and so payable
signed by the bidder and two (2) sureties, who shall justify, before any officer competent to admio~ster an oath, in
double said amount, over and above all statutory exemptions. If the proposal he accepted and the contract awarded and if
the bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or
the principal sum of said bond, as the case may be, shall be liquidated damages for such failure and neglect and shall be
forfeited to and paid into the treasury of the City of South San Francisco. The bidder, to whom the contract is awarded,
will be required to execute a bond for the faithful performance of his work in an amount equal to fifty per cent (50%)
of the amount of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will
also be required before entering ~pon the work to furnish a good and sufficient bond, as required by an act of the
legislature of the State of California, approved May 10, 1919, entitled: "An act to secure the payment of the claims of
persons employed by contractors ugon public works and the claims of persons who furnish materials, supplies, teams,
implements or machinery used or consumed by such contractor in the performance of such works, and prescribing the duties
of certain public officers with respect thereto", Chapter 303, Statutes of California, 1919.
Plans, specifications and proposal sheets may be obtained at the office of the Works Engineer of
the City of South San Francisco, in the city hall of said city, in South San Francisco, California.
Sealed proposals or bids may be delivered to the city clerk on or before 8 o'clock p.m., on Monday, j
the 20tn day of March, 1950. ~
Ail sealed proposals will be opened by said city council in public session, on Monday, the 20th daY
of March, 1950, at 8. o'clock p.m., at the council chamber of said city council.
Said city council reserves the right to reject any and aH bids.
