HomeMy WebLinkAboutReso 1524-1950RF~OLUTION NO. 1524 A RESOLUTION ~DE~RING THE INSTALLATION OF A FLOOD LIGHTING SYSTEM AT MEMORIAL PARK IN THE CITY OF SOUTH SAN FRANCISCO. RESDLVED by the City Council of the City of South San Francisco that public interest and necessity require the following improvement work to be done in said city, to-wit: the installation of a flood lighting system for the soft-ball diamond at Memorial Park. All said work shall be done at the location shown upon the plans herein- after mentioned and strictly in accordance with the plans and specifications for said work sub- mitred by the works engineer of said city, and hereby adopted for said work. All said work and all the materials used in connection therewith shall be furnished under the direction and 'to the satisfaction of said works engineer. Said city council hereby ascertains the general prevailing rates for legal holiday and overtime work applicable to said work to be done are as follows: CLASSIFICATION HOURLY WAGE RATE Carpenter $ 2.16 Electrician 2.50 LABORERS GROUP NO. 1 Header Board, Cribber, Lagging Blasters-Powdermen Drillers, High Scalers, Sand Blasters, Wagon Drill, Jackhammer pipe layers, Banders GROUP NO. 3 General Laborers, landscape laborers and gardeners, Bridge laborers, construction laborers, all clean-up work of debris, grounds and buildings, watchman, flagmen, guards, wrecking laborers, maintenance and repair trackmen, street car and railroad construction laborers, asphalt shovelers, concrete laborers, (wet or dry) CLASSIFICATION HOURLY WAGE RATES Laborers Holidays Material Teamsters 1½ times regular rate except Saturday, Sunday 2 times regular rate 1½ times regular rate The rate for any classification not shown above shall be the established union rate for San Mateo County, California. The following are to be considered as holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays and Sundays. The city clerk is hereby directed to cause a notice inviting sealed propo- sals for doing said work and for the furnishing of all materials necessary therefore to be pub- lished by two (2) insertions, not less than five (5) days apart, in "The Enterprise", a news- paper of general circulation, published and circulated in the City of South San Francisco, which notice shall be substantially in the following form: NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE INSTALLATION OF A FLOOD LIGHTING SYSTEM AT MEMORIAL PARK IN THE CITY OF SOUTH SAN FRiNCISCO. Notice is hereby given that sealed proposals or bids will be received by the City Council of the City of South San Francisco on Monday, the 3rd day of April, 1950, at the hour of 8 o'clock p.m., for doing the following improvement work insaid city, to-wit: at ~nemorial Park. It shall be mandatory upon the contractor, to whom the contract is awarded, and upon any sub-contractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the execution~of the contract. The Contractor shall forfeit as a penalty to the City of South San Francisco T~ Dollars ($10.OO) for each laborer, workman or mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than said stipulated rates for any work done under said contract, by him, or by any sub-contractor under him. Such contract shall contain a stipulation to this effect, in accordance with theprovisions of Chapter 397 of the Statutes of California, 1931. No bid will be accepted from any contractor who has not been licensed in accordance with the provisions of an act of the legislature of the Stateof California entitled: "An act providing for the registration of contractors, and defining the term contractor, providing the method of obtaining licenses to engag~ in the business of con- tractin~, ~nd fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribin~ the punishment for violation of the pro- visions of this act". Chapter 791 ~f the Statutes and Amendments of 1929, as amended. Notice is further hereb~ ~iven that no contractor or subcontractor or agent or representative thereof shall knowingly emoloy or cause or allow to be employed, on the work herein provided for, any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or subcontractor to whom the contract for said work may be awarded shall forfeit as a penalty to the City of South San Francisco, Ten Dol- lars ($10.OO) for each alien knowingly employed in the execution of such contract, for each calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Article 4 of the Labor Code of the Stste of California. A provision to this effect shall be inserted in such contract. The contract must be enter- ed into in compliance with and subject to the conditions imposed by Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's work in the performance of the work herein provided for, and that no contractor or subcontractor who employs, directs or controls the work of any workman employed on public work, shall require or permit such workman to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emer- gency, caused by fire, flood or danger to life or property and shall contain the further stipulation, which shall provide that the contrsctor to whom the contract is awarded, shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each workman employed in the execution of such ~ntract by the contractor, or by any subcon- tractor, for each calendardayduring which any workman is required or permitted to labor more than eight (8) hours in violation of the provisions of said Article 3. The contract to be awarded shall contain a further stipulation that. t~e contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured materials, produced in the Unit ed States, or substantially from materials produced in the United States, excepting only where such articles, materials or supplies from which they are manufactured, are not mined, produced or manufactured, as the case may be, in the United States, as required by Chapter ~, Article i of the Government Code of the Stateof California. .456 Price, fitness and quality being equal, said contractor shall, in the perfor-~ mance of the contract, prefer supplies grown, manufactured, or produced in the Stateof California, and shall next prefer supplies partially manufactured, grown or produced in this state. The successful bidder shall, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. Ail sealed proposals or bids shall be accompanied bM a check payable to the City of South San Francisco, certified by a responsible bank, for anamount which shall not be less than ten (10) per cent of the aggregate of the proposal, or by a bond for the said amount and so pa]mble, signed by the bidder and two (2) sureties, who shall justify, before any officer competent to administer an oath, in double said amount, over and above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the prin- cipal sum of said bond, as the case may be, shall be liquidated damages for such failure and ne~- !ect and shall be forfeited to and paid into the treasury of the City of South ~San Francisco. The bidder, to whom the contract is awarded, will bewill be required to execute a bond for the faithful performance of his work in an amount equal to fifty per cent (50%) of the amount of the undertaking with at least two (2) responsible s~reties in the full amount of the bond each; and will also be re~ired before entering upon the work to furnish a .~qood and sufficient bond, as required by an act of the legislature of the State of California, approved May 10, 1919, en- titled: "An act to secure the payment of the claims of persons employed by contractors upon public worksand the claims of persons who furnish materials, supplies, teams, implements or machinery used or consumed by such contractor in the performance of such works, and prescribing the duties of certain public officers with respect thereto", Chapter 303, Statutes of Califor- nia, 1919. Plans, specifications and proposal sheets may be obtained at the office of the Works Engineer of the City of South San Francisco, in the city hall of said city, in South San Francisco, California. Sealed proposals or bids may be delivered to the city clerk on or before o'clock p.m., on Monday the 3rd day of April, 1950. Ail sealed proposals will be opened by said city council in public session, on Monday, the 3rd day of April, 1950, at 8 o'clock p.m., at the council chamber of said city council.
