A RESOLUTION ORDERING THE CONSTRUCTION OF A
SEWF~ ALONG AN EASEMENT AT THE REAR OF THE
PROPERTY OF THE ENTERPRISE FOUNDRY COMPANY.
RESOLVED by the City Council of the City of South San Francisco that oublic interest and con-
venience require the following improvement work to be done in said city:
The construction of a sewer along
an easement at the rear of the property
of the Enterprise Foundry Comoany.
All said work shall be done at the location shown upon the plans and specifications herein-
after mentioned and strictly in accordance with the plans and specifications heretofore submitted by the
city engineer of said city, and hereby adopted for said work. Ail said work and all the materials used
in connection therewith shall be furnished under the direction and to the satisfaction of said city engineer.
Said city council hereby ascertains that the general prevailing rates for legal holiday and
overtime work apnlicable to said work to be done are as follows:

The rate for any classification not shown above shall be the established union rate for San
Mateo County, California.
The following are .to be considered as holidays: New Year's Day, Decoration Day, Independence
Day, Labor Day, Admission Day, Thanksgivin~ Day, Christmas Day, Saturdays and Sundays.
The city clerk is hereby directed to cause a notice inviting sealed proposals for doing
said work and for the furnishing of all materials necessary therefor tobe published by two (2) insertions
thereof, not less than five (5) days apart, in the SOUTH SAN FRANCISCO ENTERPRISE-JOURNAL, a newspaper of
general circulation, published and circulated in the City of South. San Francisco, which notice shall be
substantially in the following form:
NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE
CONSTRUCTION OF A SEWEE ALONG AN EASEMENT AT THE
REAR OF THE PROPERTY OF THE ENTERPRISE FOUNDRY
COMPANY.
Notice is hereby given that sealed proposals or bids will be received by the City Council
of the City of South San Francisco on Monday, the 7th day of August, 1950, at the hour of 8 o'clock p. m.,
for doing the following public improvement work in said city, to wit:
The construction of a sewer along
an easement at the rear of the property of
the Enterprise Foundry Company.
All said work shall be done at the location shown upon the plans and specifications for said
work and strictly in accordance with plans and specifications heretofore adopted for said work.
All said work and the materials used in connection therewith shall be furnished under the
direction and to the satisfaction of the city engineer of said city.
Said city council has ascertained that the general prevailing rates for hourly wages,
and the general prevailing rates for legal holiday and overtime work applicable to said work to be
done as follows:

The rate for any classification-not shown above shall be the established union rate
for San Mateo County, California.
The following are to be considered as holidays: New Year's Day, Decoration Day,
Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays ami
Sundays.
It shall be mandatory upon the contractor, to whom the contract is awarded, and
upon any sub-contractor under him, to pay not less than the specified rates to all laborers, work-
men and mechanics employed by them in the execution of the,contract. The contractor shall forfeit
as a penalty to the City of South San Francisco Ten Dollars ($i0~00) for each laborer, workman or
mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is
paid less than said stipulated rates for any work done under said contract, by him, or by any
sub-contractor under him. Such contract shall contain a stipulation to this effect, in accordance
with ~he provisions of Chapter 397 of the Statutes of California, 1931.
No bid will be accepted from any contractor who has not been licensed in accordance
with the provisions of an act of the legislature of the State of California entitled: "An act
providing for the registration of contractors, and defining the term contractor, providing the
method of obtaining licenses to engage in the business of contracting, and fixing the fees for
such licenses; providing the method of suspension and cancellation of such licenses; and prescribing
the punishment for violation of the provisions of this act." Chapter 791 of the Statutes and Amend-
ments of 1929, as amended.
Notice is further hereby given that no contractor or sub-contractor or agent or rep-
resentative thereof shall knowingly employ or cause or allow to be employed, on the work herein oro-
vided for, any alien, except in cases of extraordinary emergency oaused by fire, flood, or danger to
life or property.
The contractor or sub-contractor to whom the contract for said work may be awarded
shall forfeit as a penalty to the City of South San Francisco, Ten Dollars ($10.00) for each alien
knowlingly employed in the execution of such contract, for each calendar day, or portion thereof,
during which such alien is permitted or required to labor in violation of the provisions of Article d
of the Labor Code of the State of California. A provision to this effect shall be inserted in such
contract. The contract must be entered into in compliance with and subject to the conditions imposed
by Article 3 of the Labor Code of the State of California.
Such contract shall contain a stipulation to the effect that eight (8) hours shall
constitute a 19gal day's work in the performance of the work herein provided for, and that no con-
tractor or subcontractor who employs, directs or controls the work of any workman employed on public
work, shall require or permit such workman to labor more than eight (8) hours during any one calendar
day, except in cases of extraordinary emergency, caused by fire, flood or danger to-life or property
and shall contain the further stipulation, which shall provide that the contractor, to whom the con-
tra.ct is awarded, shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00)
for each workman employed in the execution of such contract by the contractor, or by any subcontrac-
tor, for each calendar day during which any workman is required or permitted to labor more than
eight (8) hours in violation of the provisions of said Article 3.
The contract to be awarded shall contain a further stipulation that the contractor, to
whom such contract may be awarded, shall use or supply only such unmanufactured materials, produced
in the United States, or substantially from materials produced in the United States, excepting only where
such articles, materials or supplies from which they are manufactured, are not mined, produced or
manufactured, as the case may be, in the United States, as required by Chapter A, Article I of the
Government Code of the State of California.

Price, fitness and quality being equal, said Contractor shall, in the performance of
the contract, prefer supplies grown, manufactured, or produced in the State of California, and shall
next prefer supplies partially manufactured, grown or produced in this state.
The successful bidder shall, within ten (10) days after the award, enter into a con-
tract with the City of South San Francisco for the faithful performance of the work to be done under
ssaid award. All sealed proposals or bids shall be accompanied by a check oayable to the City of
South San Francisco, certified by a responsible bank, for an amount ~ch shall not be less than
ten (lC) percent of the aggregate of the proposal, or by a bond for the said ammlnt and so payable,
signed by the bidder and two (2) sureties, who ~hall justify, before any officer competent to administer
an oath, in double said amount, over and above all statutory exemptions. If the proposal be accepted
and the contract awarded and if the bidder shall fail and neglect to execute a contract and give the
bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may
be, shall be liquidated damages for such failure and neglect and shall be forfeited to and paid into
the treasury of the City of South San Francisco. The bidder, to whom the contract is awarded, will
be required to execute a bond for the faithful performance of his work in an amount equal to fifty
percent (50%) of the amount of the undertakkng with at least two (2) responsible sureties in the
~ll amount of the bond each; and will also be required before entering upon the work to furnish a
good and sufficient bond, as re~ired by an act of the legislature of the State of California, ap-
proved May lO, 1919, entitled: "An act to secure the payment of the claims of persons employed by
contractors upon public works and the claims of persons who furnish materials, supolies, teams, im-
plements or machinery used or consumed by such contractor in the performance of such works, and
prescribing the duties of certain public officers with respect thereto", Chapter 303, Statutes of
California, 1919.
Plans, specifications and proposal sheets may be obtained at the office of the City
Engineer of the City of South San Francisco, in the city hall of said city, in South San FranciscO,
California.
Sealed proposals or bids may be delivered to the city clerk on or before 8:00 o'clock
p. m., on Monday, the 7th day of August, 1950.
All sealed proposals will be opened by said city council, in public session, on Monday,
the 7th day of August, 1950, at 8:00 o'clock p. m., at the council chamber of said city council.
Said city co,mcil reserves the right to reject any and all bids.
