RESOLVED by the City Council of the City of South San Francisco that public in- terest and convenience require the following work to be done in said city: The construction and completion of a sewage disposal plant, including sewage treatment pla'at, digester, clarifiers, grit cbs.tubers, sludge and lift pumps, l~boratory and office building, together with out fall, intercepting, connect- ing and lateral sewers, pipes, pumping station, manholes, and other works or structures necessary or convenient for a complete sewage disposal plant of the City of South San Francisco. Ail said work shall be done at the location shown on the plans and specifications hereinafter mentioned and strictlM in accordance with the plans and specifications submitted by the works engineer of said city for said work, and hereby adopted for said work. All said work and all the materials used in connection therewith shall be furnished under the direction and to the satis- faction of said works engineer. The rate for any classification not shown above shall be the established union rate for San Mateo County, California. The following are to be considered as holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays and Sunday~. In the event that, after the expiration of one (1) year from the date of any contract which may be awarded hereunder, said ~eneral prevailing wage rates may be increased through collective bargainin~ and. such increase be made industry-wide in the San Francisco Bay Area, said City of South San Francisco agrees to pay to the contractor to whom any contract for said work may be awarded, S~JENTY-FIVE PERCE~r (75%) of such increase in waxes, determined by collective bargaining as aforesaid and as actually paid by said contractor. The works engineer of said city shall determine whether or not there has Seen any such increase in wages. The city clerk is hereby directed to cause a notice inviting sealed proposals for doing said work and for the furnishing of all materials necessary therefor to be published by two (2) insertions thereof, not less than five (5) days apart, in the SOUTH SAN FR_~}CISCO ~!TFRPRISE-JOURNAL, a newspaper of general circulation, published and circulated in the City of South San Francisco, which notice shall be substantially in the following form: NOTICE INVITING SEALHD PROPOSALS OR BIDS FOR THE CONSTRUCTION OF A S~AGE TREATMENT PLANT AND ALL OTHER STF~UCTU~?~3 NECESSARY FOR A COMPLETE SEWAGE DISPOSAL SYST~LM FOR THE CITY OF SOUTH SAN FRANCISGO. Notice is hereby given that sealed proposals or bids will be received by the City Council of the City of South San Francisco on Monday, the 16th day of October, 1950, at the hour of ~:00 o'clock p. m., for doing the following public improvement work in said city, to-wit: The construction and completion of a sewage disposal plant, including sewage treatment plant, digester, c]arifiers, grit chambers, sludge and lift pumps, laboratory and office build- ing, together with outfall, intercepting, connecting and lateral sewers, pipes, pumping station, manholes, and other works or structures necessary or convenient for a complete sewage disposal plant of the City of South San Francisco. All said work shall be done at the location shown upon the plans and specifications for said work and strictly in accordance with plans and specifications heretofore adopted for said work. All said work and the materials used in connection there~rith shall be furnished under the direction and to the satisfaction of the works engineer of said city. In the event that, after the e×pir~tion of one (1) year from the date of any contract whichmay be awarded hereunder, said ~eneral prevailing wage rates may be increased through collective bar~ining and such increase b~ made industry-wide in the San Francisco Bay area, said City of South San Franci~co agrees to pay to the contractor to whom any contract for said work may be awarded, SEVE~,:TY-FIVE PERC~,[T (?5%) of such inc?ease in wages, determined b~? collective bargaining as aforesaid and as actually paid by said contractor. The works engineer of said city shall determine whether or not there has been any such increase in wages. It shall be mandatory upon the contractor, to whom the contract is awarded, and upon any subcontractor under him, to oay not less than the specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. The contractor shall for~"~it a s a penalty to the City of South San Francisco TEN DOLLARS ($10.OO) for each laborer, wor~an or mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than said stipulated rates for any work done un~er said contract, by him, or by any subcontractor un- der him. Such contract shall contain a stipulation to this effect, in accordance with the provisions of Chap%er 397 of 'the Statutes of Catiforn~ 1931. In the event theft the market val~.~e of any concrete or any reinforcing steel, which may be required in the performance of any contract awarded for said work, may be increased after the expiration of six (6) months following the date of such contract, then the City of South San Francisco will pay to the contractor, to whom the contract may be awarded, S~¢ER~Y-FIVE PSRC~ (75%) of such increase in cost for such materials, as actually paid by said contractor. The works engineer of said city shall ~etermine whether or not there has been any such increase in the market value of con~rete or reinforcing steel. No bid will be accepted from any contractor who has not been licensed in accordance with the provisions of an act of the Legislature of the State of C.3lifornia entitled: "An act pro- viding for the registration of contractors, and defining the term contractor, providing the method of obtainin~ licenses to engage in the business of contracting, and fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribing the punishment for violation of the provisions of this act." Chapter 791 of the Statutes and lmendments of 1929, as amended. Notice is further hereby given that no contractor or subcontractor or agent or representative thereof shall knowing~ly employ or cause to allc~ to be employed, dn the work herein provided for, any alien, encept in cases of ~xtraordinary eme~'gency caused by fire, flood', or danger to life or property. The contractor or subcontractor to whom the contract for said work may be awarded shall forefeit as a penalty to the City of South San Francisco, TEN DOLLARS ($10.00) for each alien knowingly employed in the execution of such contract, for each calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Article ~ of the Labor Code of the State of California. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with and subject to the conditions imposed by Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's work in the performance of the work herein provided for, ~nd that no con- tractor or subcontractor who employs, directs or controls the work of any wor~nan to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emergency, caused by ~fire, flood or danger to life or property and shall cohtain the further stipulation, which shall oro- vide that the contractor, to whom the contract is awarded, shall forefeit as a penalty to s~id City of South San Francisco, THN DOLLARS ($10.00) for each workman employed in the execution of such contract by the contractor, or by any subcontractor, for each calendar day during which any workman is required or permitted to labor more than eight (8) hours in violation of the -orovisions~ of said Article 3. The contract to be awarded shall contain a further stipulations'that the contractor, to whom such contract may be awarded, shall %~se or supply only such unmanufactured materials, pro- duced in the United States, or substantially from materials produced in the United States, excepting only where such articles, materials or supplies from whibh they are manufactured, are not mined, produced or manufactured, as the case may be,in the United States, as required by Chapter A, Article I of the Government Code of the State of California. Price, fitness and. quality being equal, said contractor shall, in the performance of the contract, prefer supplies grown, manufacbured, or produced in the State of California, and shall next prefer supplies partially manufactured, ~rown or produced in this state. The successful bidder shall, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. All sealed proposals or bids shall be accomoanied by a check payable to the City of South San Francisco, certified by a responsible bank, for an amount ~.~hich shall not be less than TEN PERCENT (10%) of the aggregate of the proposal, or by a bond for the said amount and so payable, siqned by the bidder and two (2) sureties, who shall justify, before any officer competent to admin- ister an oath, in double said amount, over and above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall be liquidated damaqes for such failure an~ neglect and shall be forefeited to and paid [nto the treasury of the City of South SanFrancisco. The bidder, to whom the contract is awarded, will be required to execute a bond for the faithful performance of his work in an amount equal to FIFTY PERCENT (5~'~) of the amount of the undertaking with at least two (2) responsible sure- ties in the full amount of the bond each; and will also be required before entering upon the work to furnish a good and sufficient bond, as required by an act of the Legislature of the State of California, approved May 10, 1919, entitled: "An act to secure the payment of the claims of persons employed by contractors upon public works anf t}'.¢ claims of persons who furnish materials, supplies, teams, implements or machinery used or consumed by such contractor in the performance of such works, and prescribing the duties of certain public officers ~lth respect thereto", Chapter 303, Statutes of California, 19~9. Plans, specifications and proposal sheets may be obtained at the office of the ~Iorks Engineer of the City of South San Francisco, in the city hall of said city, in South San Francisco, California. 502 Sealed proposals or bids may be delivered to the city clerkon or before 8:00 o'clock p. m., on Monday, the 16th day of October, 1950. All sealed proposals will be opened by said city council, in public session, on Monday, the 16th day of October, 1950, at 8:00 o'clock p. m., at the council chamber of said city council.
