RF~OLVED by the City Council of the City of South San Francisco that public interest and convenience require the following improvement work to be done in said city: , The construction of a sanitary sewer between Linden Avenue and Edison Avenue on Hillside Boulevard in the City of South San Francisco. Ail said work shall be done at the location shown uoon the plans and specifications hereinafter mentioned and strictly in accordance with the plans and specifications heretofore sub- mitted by the works engineer of said city, and hereby adopted for said work. Ail said work and all the materials used in connection therewith shall be furnished under the direction and to the satis- faction of said works engineer. The following are to be considered as holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmaa Day, Saturdays and Sundays. The city clerk is hereby directed to cause a notice inviting sealed proposals for doing s~i~ work and for the furnishing of all materials necessary therefor to be published by two (2) insertions thereof, not less than five (5) days apart, in the SOUTH S~ FRANCISCO ~T~PEISE-JOL~RNAL, a newspaper of general circulation, oublished and circulated in the City of South San Francisco, which notice shall be substantially in the following form: NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE CO?,~STRUCTION OF A S,INITARY S~ER Bi~ LI~HN AV~UE A~ EDISON AVEN~E ON HILLSIDE BOULEVARD IN THE CITY OF SOUTH SAN FR~'J~SCO. Notice is hereby Riven that sealed proposals or bids will be received by the City Council of the City of South San Francisco on Monday, the 2nd day of October, 1950, at the hour of 8 o'clock p.m. for doing the following public improvement work insaid city, to-wit: The construction of a sanitary sewer between Linden Avenue and Edison Avenue on Hillside Boulevard in the City of South San Francisco. All said work shall be done at the location shown upon the plans and specifications for said work and strictly in accordance with plans and specifications heretofore adopted for said work. All said work and the materials used in connection therewith shall be furnished under the direc- tion and to the satisfaction of the works engineer of s~id city. The following are to be considered as holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays and Sundays. It shall be mandatory upon the contractor, to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the e×ecution of the contra~t. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars (.$10.00) for each laborer, workman or mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is paid ]ess than said stipulated rates for any work done under said contract, by him, or by any subcontractor under him. Such contract shall contain a stipulation to this effect, in accordance with the provisions of Chap- ter 397 of the Statutes of California, 1931. No bid will be accepted from any contractor who has not been licensed in accordance with the provisions of an act of the legislature of the State of California entit~d: "An act pro- viding for the registration of contractors, and defining the term contractor, providing the method of obtaining licenses to engage in the business of contractdng, and fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribing the punishment for violation of the provisions of this act." Chapter 791 of the Statutes and Amendments of 1929, as amended. Notice is further hereby given that no contractor or subcontractor or agent or repre- sentative thereof shall knowing ly employ or cause or allow to be employed, on the work herein provided for, any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or subcontractorto whom the contract for said work may be awarded shall forfeit ~s a penalty to the City of South San Francisco, Ten Dollars ($10.O0) for each alien knowingly employed in the execution of such contract, for each calendar day, or portion thereof, during which such alien is ~ermitted or required to labor in violation of the provisions of Article d of the Labor Code of the State of California. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with and subject to the conditions imposed by Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall con- stitute a legal day's work in the performance of the work herein provided for, and that no contractor or subcontractor who employs, directs or controls the work of any workman employed on public work, shall require or permit such workman to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emergency, caused by fire, flood or danger to life or property and shall contain the further stipulation, whcih shall provide that the contractor, to whom the contract is awarded, shall forfeit as a penalty to said City of South San Francisco Ten Dollars (~10.OO) for each workman employed in the execution of such contract by the contractor, or by any subeontractor, for each ca] endar day during whihh any workman is required or permitted to labor more than eight (8) hours in vi~lation of the provisions of said Article 3. The contract to be awarded shall contain a further stipulation thatthe contractor, to whom such contract may be awarUed, shall ~se or supply only such unmanufactured materials, produced in the United States, or substantially from materials produced in t~e Unite~ States, excepting only where such articles, materials or supplies from which they are manufacture~, are not mined, produced, or manufactured, as the case may be, in the United States, as required by Chapter d, Article 1 of the Government Code of the State of California. Price, fitness and quality being equal, said contractor shall, in the oerfor~ance of the contract, prefer supplies grown, manufactured, or produced in the State of California, and shall next prefer supplies partially ~anufactured, ~rown or produced in this st~te. The successful bidder shall, within ten (10) days after the award, enter into a con- tract with the City of South San Francisco for the faithful performance of the work to be done under said award. Ail sealed proposals or bids shall be accompanied by a check payable to the City of South San Francisco~ certified by a responsible bank, for an amount which shall not be less than ten (10) percent of the a~regate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties, ~no shall justify, before any officer competent to administer an oath, in double said amount, over and above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contra~t and ~ive the bonds required, the sum mentioned in said check, or the principal sum of said bon~, as the case may be, shall be liquidate~ damages for such failure and neglect and shall be forfeited to andpaid ~nto the treasury of the City of South San Francisco. The bidder, to whom the contract is awarded, will be required to execute a bond for the faithful performance of his work in an amount equal to fifty percent (50~) of the amount of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be require~ before entering upon the work to furnish a good and sufficient bond, as required by an act of the legislature of the State of California, approved May 10, 1919, entitled: "An act to secure the payment of the claims of persons employed by contractors upon public work and the claims of persons who furnish material, supplies, teamz, implements or machinery used or consumed by such contractor in the r~erformance of such works, and prescribing the duties of cert~in public officers with respect thereto", Chapter 303, Statute~ of California, 1919. Plans, specifications and proposal sheets may be obtained at the office of the ~orks Engineer of the City of South San Francisco, in the City Hall of said city, in South San Francisco, California. Sealed proposals or bids may be delivered to the city clerk on or before 8:00 o'clock p. m. on Monday, the 2d day of October, 1950. All sealed proposals will be opened by said city council, in public session, on Monday, the 2d day of October, 1950, at 8:00 o'clock p. m., at the council chamber of ssid city council.
