A RESOLUTION OPDERTNG THE CONSTRUCTION OF PA~T AND
STORM DRAINS IN THE PORTION OF SPRUCE AVENUE BE~EN COL~A CREEK
AND EL CAMYN0 R~AL.
ResolYed by the City Council of the City of South San Francisco that p~blic interest
and convenience require the following improvement work to be done in said City:
Improving Spruce Avenue between Colma Creek and E1 Casino Real by constructing
storm drains, grading, and by paving with three (3) inch crusher ren base and seal
coat surfacing.
Ail said work shall be done at the location shown upon the plans and specifications
submitted this day by the works engineer of the City of South San Francisco for said
work, which plans and specifications are hereby adopted for said worM.
Ail said work shall be done and the materials used in connection therewith shall
be furnished under the direction and to the satisfaction of tht ~ords engineer of said
city.
Said City COuncil of said City of South San Francisco hereby ascertains that the
general prevailing rates for legal holiday ~nd overtime work applicable to said work
to be done are as follows:

Mateo County shall apply.
It shall be mandatory upon the contractor to who~ the contract is awarded, and upon
any subcontractor under him,to pay not less than the specified rates to all laborers,
workmen and mechanics employed by them in the execution 9f the contract. The contractor
shall forfeit as a penalty to the City of South ~aa Francisco ten dollars ($10.O0) for
each laborer, workman or meChanic empolyed, for each calendar day, or portion thereof, such
laborer, workman or mechanic is paid less than the said stipulated rates for any work done under
said contract, by him, or byany subcontractor under him. Andsuch contract shall contain

No bid ~rlll be adcepted from any contractor who has not been licensed in accordance
w~th the provisions of an act ef the Legislature of the State of California entitles:
"An act providing for the registration Sf contractors, and defining the term contractm~, pro-
viding t~ne ~ethod of obtaining licenses to engage in the business of contracting, and fixing
the fees for such licenses; providing the method of suspension and cancellation of such
licenses; and prescribing the punishment for violation of the provisions of this act."
Chapter 791 of the Statutes and Amendments of 1929, as amended.
NOTICE IS FURTH~-iR HERE~Y GIVEN that no contractor or subcontractor or agent or re-
presentative thereof shall knowingly employ or cause or allow to be employed on the work
herein provided for any alien, except in cases of extraordinary emergency caused by fire,
flood or danger to life or property.
The c:~ntractor or subcontractor to whom the c ~ntract for said work may be awarded
shall forfeit as a penalty to the City of South San Francisco ten dollars ($10.00) for
each alien knowingly employed in the execution of such contract, for each calendar day,
or portion thereof, during which such alien is permitted or required to labor in violation
of the provisions of Division II, Part I, Chapter I, Article ~ of the Labor Code of the
State of California. A provision to this effect shall be inserted in such contract.
The contract must be entered into in compliance with and subject to~ the conditions
imposed by Division II, Part 7,Chapter I, Article 3 of the Labor Code $ff the State of
California.
Such contract shall contain a stipulation to the effect that eight (8) hours shall
constitute a legal day's work in the performance of the work herein provided for, and that
no contractor or subcontractor who employs, directs or controls the work of any workman
employed on public work shall require~ or permit such workman to labor more than eight (8)
hours during any one claendar day, except in cas~s of extroardioary emergency caused by
fire, flood or danger to life or property and shall contain the further stipulatio.,: which -
shall provided that the contractor to whom the ~ntract is awarded shall forfeit as a
penalty to the City of South San Francisco ten dollars ($10.00) for each workman employed in th~ execution
of such contract by the contractor or by any subcontractor for each calendar day during which!.
any workman is required or permitted to ls. bor more than eight (8) hours in violation of the
provisions of said Article 3-
The contract to be awarede shall contain a f~rther stiMllation that the contractor,
to whom the contracy maybe awarded, shall use or supply only such unmanufactured materials
produced in the United States, or substantially form materials produced in the United States,
excepting only where such articles, materials or supplies from which they a~emanufactured
are not mined, produced or m~nufactured, as the case may be, in the United States, in
accordance with the provisions of Title 1, Division 5, Chapter &, Article 1 of the Goverment
Code of the State of California.
Price, fitness and quality being equal, the successful bidder shall, in the performance
of his contract, prefer supplies grown, manufactured or produced inthe State Of California,
and shall next prefer supplies pratially manufactured, grown or produced in this state, as
required by Title 1, Diwision 5, Article 2 of the Government Code of the State of California.
The successful bidder shall, within ten (10) days after the award, enter into a contract
with the City of South San Francisco for the faithful performance of the work to be done under
said award. Ail sealed proposals or bids shall be accompanied by a check payable to the City
bf South San Fran~isc°, certified by a responsible bank for an.amount ~hich aha]/ not be less t~an
-ben percent (10%)' of the aggregate ~f the proposal, or by a bond for the said amount and so pay-
able, signed by the bidder and two (2) sureties who shall Justify before any officer competent
to administer an oath in double said amount over and above all statutory exemptions. If the
proposal be accepted and the contract awarded, and if the bidder shall fail and neglect to
execute a contract and ~ive the bonds required, the sum mentioned in said check, or the principal
s~a of said bond, as the case may be, shall be liquidated damages for such failure ~nd neglect
and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder
to whom the contract is awarded will be required to execute a bond for the faithful performance of
his work in an amount equal to fifty percent( 50%) of the amount of the undertaking with at least
two (2) responsiblesureties in the full amount of the bond each; and' will alse~e required before
intering upon the work to furnish a good and sufficient bond, a s required by Tittle l, Division 5,
Chapter 3 of the Government Code of the State of California.
Plans, specifications and proposal sheets may be obtained at the office of Charles E. Randlett,
said works engineer, City Hall, South San Francisco, Califoraia.
Sealed proposals or bids will be delivered to the City Clerk of the City of South San Francisco, in the
City Hall, South San Francisco, Califom~nia, on or before 8:00 p.m., on Monday, the ~l.~ay of
~embe~,1951.
All sealed proposals or bids will be opened by said city council on Monday, the 17th day of
De_c~b__er_A 1951 at 8:00 p.m.
Said city council hereby reserves the right, in its discretion, to reject any and all bids
and to award the contract for all said work, or for any portion or portions thereof.
