HomeMy WebLinkAboutReso 1753-1952RESOLUTION NO. 175B C OND~2~NATI ON RESOLUTION RESOLVED by the City Council of the City of South San Francisco that sai~bity council finds and determines and hereby declares that: ~ Public interest and necessity required the construction of a sanitary sewer in and through the land next hereinafter described. RESOLVED FURTHER that said City of South San Francisco acquire the realProperty next hereinafter described by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain and prepare and prosecute iu the name of the People of the State of California such proceeding or proceedings in the Superior Court of the State of Calif~nia, in and for the County of San Mateo, as are necessary for such acquisition; the laud last hereinbefore referred to consists of all those certain tracts or parcels of land situate in the County of San Mateo, State of Califorula~ and described as follows: PABEEL I A strip of land 10 feet in width, lying 5 feet on either side of the following described center line: BEGINNING at the northerly corner of the parcel of land described in the deed from ~t~gney to Stolp, re- corded under File No. 31718G, San Mateo County Records, which corner bears South 58v 45' West 560 feet and North 31° l~.' West 280 feet from ~he southerly corner of Lo~ 2, Block H, as shown upon "Map No. l, Country ClubPark", filed in Book 23 of Maps at Pages 54, 55 and 56, San Mateo~County Records; thence South 23° 51' West 88.77 feet; thence South 54° 03' West 67.42 feet to the southwesterly line of said lands of Stolp. PARCEL II A strip of land 10 feet in width, lying 5 feet on either side of the following described center line: BEGINNING at a point on the northeasterly boundary of the parcel of land~ described in the deed from Belli to Stiremen, recorded under File No. 6829J, San M~teo County Records, which point bears South 58° 45' West 700 feet, and North 31° 15 West 223.69 feet from the southerly corner of Lot 2, Block "H", as shown upon "Map No. l, Country Club Park", filed in Book 23 of Maps at Pages 54, 55 and 56 in the Office of the Recorder of the County of San Mateo, State of California; thence South 54° 03' West 140.~7 feet to the southwesterly boundary of said lands of Sttremen. Also, an easement 5 feet in width, lying along the southwesterly boundary of said lands of Stiremeu, more particularly described as follows: BEGINNING at the southerly corner of said lands of Stiremen, which corner bears South 58o 45' West 840 feet from the southerly corner of Lot 2, Block "H", as shown upon "Map No. l, Country Club Park", filed in Book 23 of Maps at Pages 54, 55 and 56, in the Office of the Recorder of the County of San Mateo, State of California; thence North 31© 15' West 212.18 feet; thence North 58o 45' East 5 feet; thence South 31© 15' East 212.18 feet; thence South 58© 45' West 5 feet to the point of beginning. The City Attorney is hereby authorized and directed to prepare and file a complaint in eminent domain for the purpose of acquiring the land hereinbefore described, and to do .all such things as may be necessary to carry into effect the purposes of this resolution. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco, at a regular meeting of said City Council, this 5th day of May, 1952, by the following vote: Ayes, Councilmen John Noouau, Adolph Sani, Emilio Cortesi, Joseph Bracco Noes, Councilmen, None Absent, Councilmen Telford Smith Attest: Daniel J.
