A RESOLUTION OF THE CITY OF SOUTH SAN
FRANCISCO DECLARING THAT INVESTIGATION
PROCEEDINGS ARE NOT REQUIRED IN CONNECTION
WITH THE IMPROVEMENT OF VICTORY AVENUE.
RESOLVED by the City Council of the City of South San Francisco, California,
that:
WHEREAS tt is the intention of said City Council to make the following
improvements in and for said city, to-wit: The i~provement of Victory Avenue,~as
show on that certain map entitled -STREET IMPROVEMENTS - VICTORY AVENUE", by bring-
ing to grade and widening of Victory Avenue between Linden Avenue and Maple Avenue
so that there shall be a driving surface of 40 feet in width; the installation of
concrete curbs, gutters, and a side walk 5 feet wide; surfacing of ~he street with a
6 inch rock base, and paving the same with a 2 1/2 inch black top; the installation
of~ a storm drainage system with necessary catch basins, and an 18 inch pipe running
up Victory Avenue to the low point, to be followed by 30 inch pipe line to the east
side of the Southern Pacific railroad tracks, and the performing of all work auxiliary
to the foregoing which may be necessary to carry out the same, and
WHEREAS the owners of more than 60% of all the property within the proposed
assessment district have signed and filed with this City Council a written petition for
the doing of said work and waiver of proceedings under the "Special Assessment, In-
vestigation, Limitation and Majority Protest Act of 1931",
NOW, THEREFORE, IT IS ORDERED, FOUND AND DETE~IINED AS FOLLOWS:
1. That none of the owners of property within the area of the proposed
assessment district demanded the making-of the investigation ~roceedings provided
in the Special Assessment Investigation, Limitation and Majority Protest Act ef
1931 for the work and improvement herein provided to be done.
2. That said City Council proceed under t he provisions of the Improve-
ment Act of 1911 and the Improvement Bond Act of 1915 to carry through the contemplated
proceedings without any further restrictions whatsoever by reason of the terms and pro-
~isions of said "Special Assessment Investigation, Limitation and Majority Protest Act
of 1931".
3. The boundaries of the lands and of the districts of lands proposed to
be specially assessed to pay the cost and expenses of such work and proposed improve-
ment are generally described as follows, to-wit:
All that certain real property situate in the City of South San Francisco,
County of San Mateo, State of California, and more p~rticularly described as follows:
BEGINNING at the point of intersection of
the southerly line of the San Francisco Drive-In
Theatres Corporation property with the easterly
line of Spruce Avenue, which point is the south-
easterly corner of the parcel of land described in the
deed to the City of South San Francisco recorded
under file number 93754J in the San Mateo County
recorders office; thence along said southerly lira
of the San Francisco Drive-In Theatres Corporation
property South 74° 27'-East 656.08 feet; thence
North 15° 33' East 329.85 feet to the northwesterly
corner of the lands of Hawley; thence south 7~°
27' East 450 feet to the easterly line of South
Maple Avenue; thence South 15° 33' West 37.56 feet
to the northwesterly corner of the lands~of Saracce
described in the deed recorded under file No. 474311

~feet to the northeasterly corner of Zand~ of Holmes

boundary of the Lindenville War Housing Project which

thence North 15e 33' East 600 feet, more or less,
to the point of beginning.
Excepting ail public streets, avenues, thoroughfares, courts, lanes,
and alleys included and contained in said district.
All of said boundaries and limits are shown and set forth in that certain
map or plat now on file in the office of the city clerk of said City of South San
Francisco entitled: ."STREET IMPROVEMENTS - VICTORY AVENUE".

source other tha~ special assessments upon said benefited property.
5.' The statute under which it is proposed to .conduct proceedings for the
proposed improVement is the "Improvement Act of 1911" (Statute 1911, page 730, as
amended) and is proposed to pay for said improvements by special' assessment upon
adjacent property upon an area basis with bonds te be issued as authorized under the
Improvement Bond Act of 1915 (Statutes 1915, page 1441).
I hereby certify that the foregoing resolution was duly and regularly
adopted by the City Council of the City of South San Francisco at a special meeting
thereof held on the llth day of January, 1954, by the following vote:
Ayes, Councilmen Adolph Sani, Emilio Cortesi, Joseph Bracco.
Noes, Councilmen John Noonan, Telford Smith.
Absent, Councilmen None.
