A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN
FRANCISCO REQUESTING THE LEAGUE OF CALIFORNIA CIT~ AND
TEE LEGISLATIVE INTERIM COMMi~V~EE ON MUNICIPALITIES TO
STUDY THE PROI~JW4 CAUSED BY TEE GREAT ~ FOR ADDITIONAL
SCHOOL FACILITIES RESULTING FROM TEE RAPID INCREASE IN
~GPULATION OF THE STATE OF CALIFORNIA AND TO REC~
APPROPRIATE LEGISLATION TO SOLVE SAID PROBLEM.
WHEREAS for the past several years the population of the State of California has
been, and still' is, increasing at a very rapid rate, which has caused au acute pro~lem with respect to
the providing of adequate school facilities in numerous areas throughout said State; and
WNEREAS the present trend indicates that the growth of population of said State
will continue at a very rapid rate for many years to come, which will, in the future, cause more very
burdensome schooling problems, render¢fig it necessary to provide additional school accommodations to
serve the newly developed areas, in some instances consisting of the enlargement of facilities already
in existence in older areas, and,' in many others, involving the acquisition of entirely new sites and
the erection thereon of, and the providing of new equipment for, new school buildings, all of which,
under present procedure, will be accomplished at tremendous expense to the taxpayers owning property
outside the axea benefited as well as to those owning property within such area; and
WHEREAS in innumerable cases the taxpayers owning property in older areas where
adequate school facilities have heretofore been constructed, which faailities are still sufficient to
serve the needs of such areas, are being taxed to pay a portion of the cost of the new or additional
facilities required forths newly developed areas, but w~i~h confer no direct benefit upon the older
areas; and
WHEREAS it appears that to require taxpayers to pay for school facilities outside
their own i~zediate areas, and which are not directly beneficial to them. places upon such taxpayers au
uufalr burden, which, iu equity, should be borne, at least for the major part. solely by the taxpaFers
owning property within the areas requiring, and benefiting by. such new or additional school facilities;
and
WHEREAS there is at present uo legislation providing for the imposition of the
cost of acquiring new or additional school facilities, or the major portion of such cost. upon the tax-
payers within those particular areas causi~ the need for such new or additional school facilities to
arise, and w~ich directly beuefit thereby; and
WNMREAS. because the City Council of the City of South San Francisco is. by law.
vested with the right and authority top ass upon. and make final decisions with respect to. proposals for
annexation of new territories to the city and is also vested with the final authority concerning the
approval or disapproval of proposed maps for the subdivision of developed areas lying within said city.
said City Council has been requested byrepresentatives of the ~SouthSan~Fraucisco Unified School
District and by citizens and taxpayers of said city to lend its assistance and support to the Board of
Trustees of said school district iu an effort to pro~.lde an equitable and workable solution to the
problem hereiuabove defined; and
WHEREAS the members of the City Council of the City of South San Francisco.
recognizing that the aforementioned problem is a serious one and one which willprobablybecome more
aggravated iu the future, deem that it is bu~ fair and equitable that the property within areas directly
affected and benefiting by the providing of new or additional school facilities should bear the major
portion of the cost thereof and that. towards that end. it maybe advisable for the Legislature of the
State of California t~ enact enabling legislation permitting the governing bodies of school districts
to conduct special assessment proceedings, or similar undertakings, so that adequate funds may be raised
by assessing only the property in the benefited areas; and
WHEREAS it appears to the City Council that this problem so arising is one which
should be studied by the League of California Cities, as the official representative of the municipalities
organized in the State of California; and
WNEHEAS it is also deemed advisable that the State of California Legialative Interim
Cow~ttee on Municipalities should give consideration to the aforementioned problem; and
WMEREAS insofar as concerns the South San Francisco Unified School District and the
surrounding area, said problem is one which directly affects the functions of the Board of Supervisors
of the County of San Mateo with respect to the matter of taxation for the support of the schools under
the Jurisdiction of said district,
NOW, TMEREFORE, BE IT RESOLVED by the City Council of the City of South San Fran-
cisco that it lend its support and assistance to the Board of Trustees of the South San Francisco
Unified School District and, in that regard, request the League of California Cities, the State of
California Legislative Interim Ccm~mittee on Municipalities, and the Board of Supervisors of the County
of San Mateo to investigate and study the aforementioned problem so that an equitable amd workable
solution may be arrived at within the near future. In this connection, the City Clerk is hereby requested
to forward to said League of California Cities, the State of California LegiSlative Interim Committee on
Municipalities, the Board of Supervisors of the County of San Mateo, and the Board of TrusteesJ~of~.the
South San Francisco Unified School District, certified copies of this resolution.
