HomeMy WebLinkAboutReso 2118-1955RESO LUT I Gq NO. 2118 A RESOLUTION OF THE CITY COUNCIL OF TRE CITY OF SOUTH SAN FRANCISCO DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR THE ISSUANCE OF BONDS. WHEREAS the City Council of the City of South San Francisco did, on the 15th day of March, 1954, pass and adopt its Resolutic~ of IntentIe~ No. 1~87 and thereafter did, on the Vth day of Juue, 1954 and on the 6th day of July, 1954, pass and adopt its Resolution No, 2017 snd Resolution No. 2026 respectively, ordering changes and modifications in the proceedings under said Resolution of Intention, all relating to the construction of Public improvements in said city under and pursuant to the provisi~s of the Municipal Improvement Act of 1913, as~i'amended, and did therein provide that serial bonds would be issued thereunder pursuant to the provisi~ns of the Refunding Assessment Bond Act of 1935, as modified in the Municipal Improvement Act of lol3, reference to said Resolution of Intention, as so modified, being hereby expressly rode for further details and particulars; and W~REAS notice of the recordation of the assessments, and of the time within which the assessments may be paid in cash has been duly published and mailed in the manner provided by law, and whereas the ti~e so provided for receivln~ the payment of assessments in cash has expired; and whereas, on January 5, 1055, the City Engineer of said city did file with the City Treastt~er of said city a list of all assessn~nts which now rennin unpaid; and WHEREAS said City Council has duly considered said list and has determined that the same is an accurate statement thereof, NOW, THEREFORE, BE IT RESOLVED By said City Council, as follows: 1. That the assessments in said unpaid list which now re~ain unpaid, and the aggregate thereof, are as shown on Exhibit "A", attached hereto and by this reference made a part hereof. 2. That reference is hereby made to the assessment and to the diagram recorded in the office of the Superintendent o~ Streets of said city, as the same have been con~iEn- ~d'~ by said City Council, for a particular description of the lots bearing the respective assessment~numbers upon which assessments remain unpaid, severally and respectively. 3. That said bonds shall be issued in series, and the unpaid assessments as shown on said list as filed with the .City Treasurer of said city and determined by said city council, together with the intenest .thereon, shall remain and consistute a trust fund for the redemption audp~m~ent of said .bonds and of the interest which may become due thereon, which unpaidassessme~ts shall be payable in annual series corresponding in number to the number of series of bonds issued, and an even arnual proportion of each assessment shall be payable in each year .preceding the date of the maturity for each of the several series of bonds issued, and such proportion of each assess~ent coming due in any year, together with the annual interest thereon, shall in turn be payable in installments in the same manner as a~e the general real property taxes levied by said city, and shall become delinquent at .the same time and in the same p~oporttonate amounts and bear the same proportionate penalties for delinquency~ 5. That said bonds shall be signed by the Mayor and City Treasurer of said city or, in lieu thereof, bear their .engraved, printed, or lighographed signatures, and shall be attested by the City Clerk, .who shall affix thereto the official seal of said city. The interest coupons affixed thereto shall be signed by said City Treasurer or, in lieu t~reof, bear his engraved, printed, or ltthographed signature; and such signing*of said coupons by said City.Treasurer shall constitute, and be, a sufficient and binding execution of each aD~ every one of said bonds and all the coupons thereof, respectively. Said bonds shall be substantially iu the form as set forth in the Refund- ing Assessment Bond Act of 1935, as modified in the Municipal Improve~:ent Act of 1913. Said Mayor, City Treasurer, arzl City.Clerk of said city are hereby respectively authorized and directed so to sign and attest said bonds and interest coupons. 8.
