A RESOLTUION APPOINTING SPECIAL COUNSEL IN RE PAP~ING DISTRICT NO. 1955-1
OF THE CITY OF SOUTH SAN FRANCISCO AND AUTHORIZING AGREEMENT.
WHEREAS, on the 25th day of April, 1955, the City Countil of the City Of South San
Francisco duly passed and adopted its Resolution No. 2140 for the formation of Parking District
No. 1955-1 in the City of South San Francisco; and,
WHEREAS, it is deemed advisable by the City Council that a special counsel be appointed in
said proceedings to supervise and perform all legal services in connection with the formation of
said parking district; and,
WHEREAS, A. J. SCA~INI, ESQ., a duly licensed and qualified attorney at law, deemed by
the City Council competent to perform said legal duties and services, has offered by letter dated
June 6, 1955, addressed to the City Council and on file in the office of the City Clerk, to act as
such special counsel under the terms and conditions in said letter proposal set forth, a copy of
which said letter proposal is attached to this resolution; and,
WHEREAS, it is deemed by the City Council to be in the public interest, convenience and
necessity that such special counsel be so appointed to attend to all legal matters and proceedings
in connection with the formation and creation of said Parking District No. 1955, and further deemed
to be in the best interest that the proposal of A. J. SCAMPINI, ESQ. be accepted,
NOW, THEREFORE, BE IT RESOLVED that A. J. SCAMPlNI, ESQ., attorney at law, be and he is
hereby appointed as special counsel in the matter of Parking District No. 1955-1 of the City of
South San Francisco. That as such special counsel said A. J. SCA~PINI, ESQ. shall perform all of
the legal services requisite for the formation of said Parking District No. 1955-1 to its completion
or earlier abandonment, including generally but not in limitation hereof the services outlined
in said letter proposal dated June 6, 1955.
FURTHER RESOLVED that as compensation f~r all legal Services to be rendered by said
A. J. SCAMPINI, ESQ. pursuant hereto, he shall receive and be paid by the City of South San
Francisco a sum equal to 2½% of the amount of bonds finally issued and sold in connection with
these proceedings, excepting therefrom such amount as shall represent the fees and costs of special
counsel and other out-of-pocket expenses, payable by the City upon the sale of said bonds; prov ded,
however, that in the event these proceedings be by the City Council at any time abandoned prior to
the issuance and sale of any bonds, said A. J. SCA~PlNI, ESQ. shall be deemed to have no claim of
any kind or character against the City of South San F~ancisco for any services rendered by him
pursuant hereto up to said time, or for any out-of-pocket expenses incurred by him in the premises.
FURTHER RESOLVED that any compensation or other remuneration payable to said A. J. SCAMPlNI
ESQ. pursuant to this resolution be deemed chargeable to said district as an incidental expense in
connection with this proceeding.
I hereby certify that the foregoing Resoltuion was regularly introduced and adopted by
the City Council of the City of South San F~ancisco at a regular meeting held on the 20th day of
June, 1955.
