HomeMy WebLinkAboutReso 2183-1955RESOLUTION NO. 2183 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING THAT INVESTIGATION PROCEEDINGS ARE NOT REQUIRED IN CONNECTION WITH THE IMPROVEMENT OF MISSION ROAD AND CHESTNUT AVENUE BE IT RESOLVED by the City Council of the City of South San Francisco, Califonia, that: WHEREAS it is the intention of said City Council to make the following improvements in and for said city, to-wit: The improvement of Mission Road and Chestnut Avenue, as shown on that certai] map entitled "MISSION ROAD IMPROVE~NT", as follows: The bringing to grade and widening of Mission Road between Chestnut Avenue and the norther] limits of*Sbuth San Francisco so that there shall be a driving surface of forty-eight (48) feet in width; the installation of concrete curbs, gutters, and, on the northeasterly side of said street, a sidewalk five (5) feet wide-from the intersection of Evergreen DriVe.to 1 intersection of said road with Chestnut Avenue; surfacing of the street with a six (6) incl rock base, and paving the same with a one and one-half (1-½) inch black top over the exisl ing pavement, and a three (3) inch black top over the widened portions; the installation o~ all necessary catch basins; the installation of a bridge extension at the intersection of said road witk Oak Avenue; the construction of a six (6) inch concrete lining of the exist~ drainage ditch along the southwesterly side of Mission Road from Grand Avenue to the existJ Oak Avenue bridge. The bringing to grade and widening of Chestnut Avenue from Commercial Avenue to E1Camino Real So that there shall be a driving surface df forty-eight (48) feet in width; the installation of concrete curbs, gutters, and, on the northwesterly side of s~ street, a sidewalk five (5) feet wide; surfacing of the street with a six (6) inch crush-re base and paving the same with a one and one-half (1-½)-inch black top over the existing pa~ and a three (3)-inch black top over the widened portion; the installation of catch basins; installation of a bridge extension over the existing drainage canal, and the installation ¢ a fence along said canal bank. ' and the performing of all work auxiliary to the foregoing which may be necessary to carry out the san and, WHEREAS the owners of more than sixty percent (60%) of all the property within the proposed assessment district have signed and filed with this City Council a written petition for the doing of said work and waiver of proceedings under the "Special Assessment, Investigation, Limitation and Majc ity Protest Act of 1931", NOW, THEREFORE, IT IS ORDERED, FOUND, AND DETERMINED AS FOLLOWS: 1. That none of the owners of property within the area of the proposed assessment distric' demanded the making of the investigation proceedings provided in the Special Assessment Investigatiol Limitation and Majority Protest Act of 1931 for the work and improvement herein provided to be done. *City of 44O 2. That said City Council proceed under the provisiOnS of the Improvement Act of 1911 and the Improvement Bond Act of 1915 to carry through'the Contemplated proceedings without any further restrictions whatsoever by reason of the terms and provisions of said "Special Assessment Investiga~ tion, Limitation,land Majority Protest Act of 1931",. 3~ The boundaries of the lands and of the districts of lands proposed to be specially assessed to pay the cost and.expenses of such work. and proposed improvement are generally described as follows, to-wit: PARCEL I. All that certain land situate in the City o£ SOUth San Francisco, County of San Mateo, State of California, more particularly described as follows: ~ Beginning. at a point on the southeasterly line'of Evergreen Dr~ve, said.point being the intersection of the northerly property line of Lot 1, BloCk 1, with the southeasterly line of Evergreen , . '' a Drive as said Block is designated on the map entitled Sunshine G rdens No. 1, South San Francisco, California", which 'map was filed in the office' of the ReCorder of the County of San Mateo, State of California on October 31, 1952, in Book 35 of Maps at page 49; thence from said point of beginning southeasterly along the northerly property lines of Lots 1 through 6; thence southeasterly to the most northerly corner of that certain 0.092 acre Parcel of Umberto and Louise Capurro as designated by the Assessor's Map No. 5 of South San Francisco; thence along the northerly property line to the northeasterly corner of the last said parcel; thence southeasterly along a line, parallel to and 100.00 feet distant from the northeasterly line of Mission Road, to a point on the northwesterly property line of that certain parcel designated as "Lands of Uccelli" and shown' on the map entitled "Westview Terrace, South San Francisco, San Mateo County, california'', which map was filed in the office of the Recorder of the County of San Mateo, State of California on March 20, 1953 in Volu~e 36 of. Maps at Page 36; thence northeasterly to the southwesterly corner of Block 1, Westview Terrace; thence southeasterly along the southwesterly line of the aforesaid Block 1 and its prolongation to the southeasterly line of Holly Avenue; thence northeasterly along the southeasterly line of Holly Avenue to a .point 250.00 feet distant from the northeasterly property line of Mission Road; thence from said point along, a line at a right angle to the aforesaid Holly Avenue to a point on the northwesterly boundary of the "Regli Tract, South San Francisco, California", and which is shown on a map filed in the Office of the Recorder of the County of San Mateo, State of California on May 8, 1924 in Book 11 of Maps, Page 63; thence along the boundary of the aforesaid Regli Tract to the northeasterly property line of Lot 3, Block 1; thence along the northeasterly property line of the aforesaid Lot 3 to the nOrtherly property line of Grand Avenue; thence southwesterly along the northerly line of Grand Avenue to a point of intersection with the prolongation of the northeasterly property line of Lot 2, Block 2, of the Regli Tract; thence along the aforesaid prolongation and property line of LOt 2, BlOck 2 to the northerly property line of Lot S, Block 2; thence northeasterly along the northerly line,Of the aforesaid Lot 8 to a point 100.00 feet distant from the'northeasterly property line of Mission Road; thence southeasterly along a line, parallel to and 100.00 feet distant from the northeasterly line of Mission Road, to a point 140.00 feet distant from the southeasterly line of Oak AVenue; thence northeasterlyalong a line parallel to and 140.00 feet distant from the south- easterly line of Oak Avenue to a point of intersection with the southerly boundary line of the Daly Subdivision, designated on a ~ap entitled "Daly Subdivision, South San Francisco, California", which ~ap was filed in the Office of the Recorder of the County of San Mateo, State of California, on May'8, 1924 in ¥olmae 11 of Maps at Page 63; thence along the southerly boundary of the Daly Subdivision to the southwesterly corner of the "Strawther Subdivision" designated on a map filed in the Office of the Recorder on January 22, 1951 in Volu~e 32 of Maps at Page 46; thence along the southerly boundary of the "Strather Subdivision" and its prolongation to the center line of Chestnut Avenue; thence north- erly along the center line of Chestnut Avenue to a point of intersection with the southerly line of Comercial Avenue; thence northeasterly along the southerly line of Commercial Avenue to a point 190.00 feet distant from the center line of Comercial Avenue;- thence southwesterly along a line, parallel to and 190.00 feet distant from the center line of Chestnut Avenue, to the northerly right-of-way line of the Southern Pacific Railroad;.thence westerly along the right-of-way line to the mo~theaster~y line of Chestnut Avenue; thence southwesterly along the southeasterly line of Chestnut Avenue to the southerly boundary of the City and County of San Francisco Water Department rig~t~of-way; thence westerly along the said right-.of-way line to the center line of Chestnut Avenue; thence southeasterly along the center line of Chestnut Avenue to the prolongation of the southerly boundary of the for~er Market Street Railway right-of-way; thence along the southerly boundary of the said right-of-way to a point 190.00 feet distant from the center line of Chestnut Avenue; thence from said point northeasterly along a course, parallel to and 190.00 feet distant from the centerline of Mission Road, to a point on the sOUthwesterly line of Mission Road, said point also lying on the northerly right of-way line of the Southern Pacific Railway; thence northwesterly along the said northerly right-of-way line, to the corporate limits line of the City of South San Francisco; thence continuing along the corporate 1,~sits line northeasterly to the southwesterly line of Mission Road, southwesterly along the boundary of Mission Road; thence northeasterly to a point on the corporate limits line 100.00 feet distant from the northeasterly line of Mission Road; thence frOm said point southeasterly along a line, parallel to and 100.00 feet distant from the .northeasterly line of Mission Road, to the northwesterly boundary of "Sunshine Gardens No. 1"; thence southeasterly to the aforesaid point of beginning. PARCEL II All that certain land situate in the County of San Mateo, State of California, more particularly described as follows: Beginning at a point on the southwesterly line of Mission Road, said point being a point of ~ntersection with the prolongation of the westerly line of that certain 13.215 acre parcel of land cOn~yed to Antoni° Scopesi and wife by deed recorded Januaryi~, 1936 in Book 673 of Official Records of San Mateo County at Page 61; thence southwesterly along theaforesaid prolongation to the northeasterly right-of-way line of the Southern Pacific Railroad; thence southeasterly along the said right-of-way line to the corporate limits line of the City of South San Francisco; theuce northeasterly along the corporate limits line to the southwesterly boundary of Mission Road; thence northwesterly along the aforesaid boundary of Mission Road to the said point of beginning. EXcepting all public streets, avenues, thoroughfares, courts, lanes, and alleys included and contained in said district. All of said boundaries and limits are shown and set forth in that certain map or plat now on file in the office of the City Clerk of said City of South San Francisco entitled: "MISSION ROAD ,, I~PROVE~NT . 4. That no portion of such proposed improvement is to be paid from any source other than special assessments upon said benefitted property. 5. The statute under which it is proposed to conduct proceedings for the proposed imporvement is the "Improvement Act of 1911" (statute 1911, Page 730, as amended) and it is proposed to pay for said ilprovements by special Issessment upon adjacent property upon an area basis with bonds to be issUedas authorized under the Improvement Bond Act of 1915 (Statutes 1915, Page 1441). I hereby certify that the foregoing resolution was regularly introduced and adopted bY the City COuncil of the City of South San Francisco at a regular meeting thereof held on the 1st day of August, 1955, by the following vote: AYES, Councilmen NOES, ABSENT, " Andrew Rocca, Francis Lucchio, Emilio Cortesi, Richard Gamlen, Telford Smith.
