A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING
THAT INVESTIGATION PROCEEDINGS ARE NOT REQUIRED IN CONNECTION WITH THE INSTALLATIO',
OF STORl/ DRAINS ON MISSION ROAD FROM THE INTERSECTION OF SAID MISSION ROAD AND
EVERGREEN DRIVE TO THE INTERSECTION OF SAID MISSION ROAD AND GRAND AVENUE IN
THE CITY OF SOUTH SAN FRANCISCO.
BE IT RESOLVED by the City Council of the City of South San Francisco, California, that:
WHEREAS it is the intention of said City Council to make the following improvements in an,
for said city, to-wit: The installation of storm drains on Mission Road from the intersection of s~
Mission Road and Evergreeen Drive to the intersection of said Mission Road and Grand Avenue, as
shown on that certain map entitled "MISSION ROAD STORM DRAIN", as follows:
The furnishing 'and installing of fifteen inch (15"), twenty-four inch (24"), and
twenty-seven inch (27") storm drain lines to provide'for the drainage of that portion
of Mission~Road lying between Evergreen Drive and Grand Avenue, including the install-
ation of manholes, the excavation and backfull of trenches, making connections to
existing storm drains and catch basins, and all other items incidental to said improvemenl
and
WHEREAS the owners of more than sixty percent (60~) of all the p~operty within the propos~
assessment district have signed and filed with this City Council a written petition for the doing
said work and waiver of proceedings under the "Spechl Assessment, Investigation, Limitation and
Majority Protest Act of 1931",
NOW, THEREFORE, IT IS ORDERED, FOUND, AND DETERMINED AS FOLLOWS:
1. That none of the owners of property within the area of the proposed assessment distri¢
demanded the makingof the investigatiOn proceedings provided in the Special Assessment Investigati¢
Limitation and ~ajority P~otest Act of 1931 for the work and improvement herein provided to be done.
2. That said City Council proceed under the provisions of the Improvement Act of 1911 and
the Improvement Bond Act of 1915 to carry through the contemplated proceedings without any further
restrictions whatsoever by reason of the terms and provisions of said "Special ASsessment Investigat
Limitation and Majority Protest Act of 1931".
3. The boundaries of the.lands and of the districts of lands proposed to be specially
assessed to pay the'cost and expenses of such work and proposed improvement are generally described
as follows, to-wit:
All that certain land situate in the City of South San Fraacisco, County of San Mateo,
State of Cali~ornia, more particUlarly described as follows:
Beginning at a point of intersection of the Northwesterly line of Evergreen Drive with the
centerline of BaywOod Avenue, as said streets are designated upon a map entitled "Sunshine Gardems
Subdivision No. 1, South 8an Francisco", which map was filed in the office of the Recorder of the County
of San Mates, State of C~lifornia, on October 31, 1953 in Book 35 of Maps at Page 49 and 50; thence
from said point South 46v 44' 19" East, 529 feet to the centerline of Gardenside Avenue; thence North
43~ 15' 41" East, 858 feet to tho centerline of Miller Avenue; thence South 46° 44' 19" East along the
centerline of Miller Avenue to its intersection with the centerline of Holly Avenue, as said streets
are designated upon a map entitled "Sunshine Gardens, Subdivision No. 4, South San Francisco", which
map was filed in the office of the Recorder of the County of San Mates, State of California, on June
23, 1953, in Volume 37, of Maps.'at pages 13 and 13; thence from last 8aid point of intersection South-
westerly along the centerline of Holly Avenue to its intersection with the Centerline of Sunnyside
Drive; thence Southeasterly along the centerline of Sunnyside Drive to a point of intersection with the
prolongation of the Westerly line of Lot 1, Block 17; thence Southwesterly along the aforesaid westerly
line to the Southwesterly corner of Lot 1, Block 17; thence along the Southerly line of Block 17 to its
intdrsection with the Northerly line of Grand Avenue; thence Southwesterly along the Northerly line of
Grand Avenue and its prolongation to the Southwesterly line of Mission Road, .as said streets are
designated upon a map entitled "Regli Tract, South San Francisco, California" which map was filed in
the office of the Recorder of the County of San Mates on May 8, 1924, in Volume 11 of Maps at Page 63;
thence Northwesterly along the Southwesterly line of Mission Road to a point of intersection with the
prolongation of the Northwesterly line of Evergreen Drive of said Sunshine Gardens No. 1; thence North-
eeaterly along t~e Northwesterly line of Evergreen Drive to said point of beginning.
Excepting all public streets, avenues, thoroughfares, courts, lanes, and all,rs included and
contained in said district.
' All of said boundaries and limits are shown and set forth in that certain map or plat ~n0~ on
file in the office of the City Clerk of said 'City of South San Francisco entitled: "MISSION ROAD STORM
4. That no portion of such proposed improvement is to be paid from any source other than
special assessments upon said benefited property.
5. The statute under which it is proposed to conduct proceedings for the proposed improvement
is the "Improvement Act of 1911" (Statute 1911, Page 730, as amended) and it is proposed to pay for said
improvements bY special assessment upon adjacent property upon an area basis with bonds to be issued as
authorized under the Improvement Bond Act of 1915 (Statutes 1915, Page 1441).
I hereby certify that the foregoing resolution was regularly introduced and adopted by the
City Council of the City of South San Francisco at a regular meeting thereof held on the 1st day of
August, 1955, by the following vote:
