HomeMy WebLinkAboutReso 2192-1955RESOLUTION OF INTENTION NO. 2192 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS INTENTION TO DO CERTAIN PUBLIC IMPROVEMENT WORK BY THE INSTALLATION OF STORM DRAINS ON MISSION 'ROAD FROM THE INTERSECTION OF SAID MISSION ROAD AND EVER- GREEN DRtYEEI~'T~E['~I~I'E~S~L'T~ONYOF!~SXlD~M~8$~0~. ROAD AND GRAND AVENUE IN THE CITY OF SOUTH SAN FRANCISCO. WHEREAS public inte~est'and'co~venience'require ~at work and improvements hereinafter describe~ should be done; and WHEREAS, in the opinion of the City Council of the City of South San Francisco, said contemplat~ work and improvement are, and are hereby declared to be, of more than local or ordinary public benefit; WHEREAS an estimate of the cost and expense of said work has been filed with the City Clerk of said City, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that it the intention of said City Council to order the following work and improvements to be done in said City, to-wit: The furnishing and installing of fifteen inch (15"), twenty-four inch (24"), and twenty- seven inch (27") storm drain lines to provide for the drainage of that portion of Mission Road lying between Evergreen Drive and Grand Avenue, i~cluding the installation of manholes, the excavation and backfill of trenches, making connections to existing storm drains and catch basins, and all other item incidental to said improvements. All the work provided for shall be done in accOrdance with the speeial plans, profiles, and specifications for said work, and at the locations and to the grades shown upon said plans, which plans, profiles, and specifications were adopted by said City Council on the 1st day of August, 1955, and are now on file in the office of the City Clerk of said City. Reference is hereby made to said plans, profiles, and specifications for a full description of Said work and for the location and the extent of the work to be done hereunder and for the grades at ~which said work is to be done, and for a particular descr~ption of the boundaries of the district herein "mentioned. Said City Council does hereby determine and declare that said proposed work and improvement are of more than local or ordinary public benefit and will affect and benefit the lands and district hereinafter described, which said district is hereby declared to be the district benefited by said work and improvement, and that, therefore, the entire cost and expense of said work and improvement shall be, and hereby are, made chargeable against, and shall be assessed upon, said lands and district, except as hereinafter expressly provided, which district is particularly described as follows, to-wit: All that certain land situate in the City of South San Francisco, County of San Mateo, State of California, more particularly' described as follows: Beginning at a point of ~ntersection of the Northwesterly line of Evergreen Drive with the centerline of Baywood Avenue, as said streets are designated upon a map entitled "Sunshine Gardens Subdivision No. 1, South San Fr~mcisco", which map was filed in the office of the Recorder ~f the County of San Mateo, State of California, on October 31, 19'52 in Book 35 of Maps at Page 49 and 50; thence from said point South 46o 44' 19" East, 529 feet to the centerline of Gardenside Avenue; thenc, North 43° 15' 41" East, 858 feet to the centerline of Miller Avenue; thence South 46° 44' 19" East alo. ng the centerline of Xiller Avenue to its intersection with the centerline of Holly Avenue, as said streets are designated upon a map entitled "Sunshine Gardens, SubdiVision No. 4, South San Francisco", which map was filed tn the office of the Recorder of the County of San Marco, State of California, on June 23, 1953 in Volume 37 of Maps at Pages 12 and 13; thence from last said point of intersection Southwesterly along the centerline of Holly Avenue to its intersection with the centerli of 8unnyside Drive; thence Southeasterly along the centerline of Sunnyside Drive to a point of intersection with theprolongation of the Westerly line of Lot 1, Block 17; 'thence Southwesterly along the aforesaid Westerly line to the Southwesterly corner of Lot 1, Block 17; thence along the Southerly line of Block 17 to its intersection with the Northerly line of Grand Avenue; thence South- westerly along the Northerly line of Grand Avenue and its prolongation to the Southwesterly line of Mission Road, as said streets are designated upon a map entitled "Reglt Tract, SoUth San' Francisco, CaliforBia" wh~ah map was filed in the office of the Recorder of the County of San Mateo on MayS, 1924, in Volume 11 of Maps at Page 63; thence Northwesterly along the Southwesterly line of Mimion Road to a point of intersection with the prolongation of the Northwesterly line of Evergreen Drive of .said Sunshine Gardens No. 1; thence Northeasterly along the Northwesterly line of Evergreen Drive to said point of beginning. Excepting all public streets, avenues, thoroughfares, courts, lanes, and alleys included and contained tnsaid district. Notice is hereby given that serial bonds to represent un~p~d assessments, and to bear interest at the rate of five percent (5%) per annum, will be issued hereunder in the manner provided by DiviSion 10 of the Streets and Highways Code, in the. Improvement Bond Act of 1915, and the last installment of such bonds shall mature fourteen (14) years from the 2d day of July next succeeding ten (10) months from their date. The South San Francisco Enterprlse-Journal, a newspaper of general circulation, printed and published in said City ~f South Ban Frsncimco, is hereby designated as the newspaper in which this resolution of intention shall be published, and the City Clerk is hereby directed to cause this reso~ution to be published by two (2) insertions in the manner and form required by law. Said City Clerk is also directed to mail a notice of the adoption of said resolution of intention, postage:prepaid, to all persons owning property which is proposed to be assessed to pay any part ~f the cost of said work, whose names and addresses appear on the last equalized assessment roll, or as known to said City Clerk. The Director of Public Works, as ex-officio Superintendent of Streets, shall cause to be conspicuously posted along the line of said contemplated work of improvement, and not more than thr~ hundred (300) feet in distance apart, but not less .than three (3) in all, and along 'all the open streets within said district at not more than three hundred (800) feet in distance apart on each said Street, notices of the passage of this resolution of intention, in the manner and form require, by the Improvement Act of 1911. Notice is hereby given that on Tuesday, the 6th day of September, 1955, at the hour of 8:00 o'clock P.M., in the Council Chambers of said City Council of City of South San Francisco, any and all persons having any objections to the propssed work and and improvement may appear befor, said City Council and show cause why said proposed work and improvements should not be carried out in accordance with this resolution. Except as hereinbefore provided, all the herein proposed work shall be done pursuant to a Act of the Legislature of the State of California designated as the "Improvement Act of 1911". I hereby certify that the foregoing Resolution was regularly introduced and adopted by th City Council of the City of South San Francisco at a regular meeting thereof held on the 1st day of August, 1955, by the following vote: AYES, 'COUNCILMEN: NOES, " ABSENT, " Andrew Rocca, Francis Lucchio, Emilio Cortes1, Rlchard Gamlen, Telford Smith.
