A RESL~ION OF TEE CITY COUNCIL OF TEE CITY OF SOUTH
~ FRANCISCO DECLARING THAT INVESTIGATION PROC~W~INGS
ARE NOT REQUIRED IN CONNECTION WITN THE IM PROV~ OF
SOUTtt CANAL ST~ FROM LINDEN TO SPRUCE AVENUES AND
TEE IMPROVEMENT OF MAYFAXR AVENUE ~ROM ITS EASTEEEY
TERMINATION TO SPRUCE AVENUE IN TEE CITY OF SOUTH SAN
FRANCISCO
BE IT RESOL~ by the City Council of the City of South San Francisco, California, that:
WEEREAS it is the intention of said CSty Council to m~ke the following improvements in and for said city, to-wit,
the improvement of So~ Canal Street from Linden to Spruce Avenues and the improvement of Mayfair Avenue from its
easterly termination to Spruce Avenue, in accordance with plans and specifications to be hereafter prepared by
WILSEY & HAM, duly licensed civil engineers, subject to the approval of the Director of Public Works of said city,
said work and improvement to consist of the following:
Grading and paving of Mayfair Avenue from Mayfair Village Subdivision No. 3 East to South Spruce Avenue, grading and
paving of South Spruce iAvenue from the intersection thereof with MayTair Avenue North to the Co~1_ma C~eek Canal
drainage right-of-way~ .~aud the grading and paving of South Canal Street from the intersection thereof with South
S~ruce Avenue Eamterly~to Linden Avenue; the installation of curbs and gutters along said streets to be so graded
and paved; the installation of sidew~l~ ou both sides of the Mayfair Avenue portion, along the easterly side
only of the South Sprace Avenue portion, and along the south side only of the South Canal Street portion;
the installation of all necessary storm drainage facilities, including the installation of necessary culverts
under the Mayfair Avense Extension; the installation of a sanitary sewer, together with necessary appurtenances,
from the intersection of North Canal Street and Spruce Avenue southerly along Spruce Avenue to Mayfair Avenue
and thence along Mayfair Avenue to a point approximately one hundred (100) feet East of said Mayfair Village
S~bdiviston No. 3; the installation of a sanitary sewer, together with necessary appurtenances, from the
intersection of South Cana~ Street with South Spruce Avenue Easterly along South Canal Street to a point approximatel~
three hundred (300) feet distant from South Spruce Avenue; the stabilization of the South bank of the Colma Creek
Canal from South Spruce Avenue easterly to Linden Avenue, as required,
and the performing of ~11 work a~iliary to the foregoing which may be necessary to carry out the same, and
~ WEEREAS the owners of more than sixty percent (60~) of all the property wi~thin the proposed assessment
district have signed and filed with this City Council a written petition for the doing of said work and waiver of
proceedings under the "Special Assessment, Investigation, ~zimitation and Majority Protest Act of 1931",
NOW, 'J.'~'ORE, IT IS O~DERED, F(XIND, AND DETERMINED AS FOLLOWS:
1. That none of the owners of property within the area of the proposed assessment district demanded the
making of the investigation proceedings provided in the Special Assessment Investigation, Limitation and Majority
Protest Act of 1931 for the work and improvement herein provided to be done.
2. That said City Council proceed under the provisions of the Municipal Improvement Act of 191~, as
amended; and the Improvement Bond Act of 1915 to carry through the contemplated proceedings without any further
restrictions whatsoever by reason of the terms and p¥ovisions of said "Special Assessment Investigation, Lt~m~tation
and Majority Protest Act of 1931':
B. The boundaries of the lands and of the districts of lands proposed to be specially assessed to pay the
cost and expenses of sBch work and proposed impr~,ement are generally described as follows, to-wit:
All that certain land sit,ate within the City of South San Francisco, County of San Mateo, State of California
described as follows:
Beginning at the most easterly corner of Lot 10, Block 10, as said lot and block are shown on that subdivision
entitled '~AYFAIR Vi~.TJ~GE MAP NO. 3 SOUTH SAN FRANCISCO, CALIFC~NIA", filed in the office of the Recorder of San
Mateo County, California, in Book 26 of Maps at~x~ge $5; thence along the easterly boundary of said subdivision
S 15° 33~ W a distance of 440 feet; thence s 74~ 27! E a distance of 1176.08 feet to a line parallel to and 390
feet westerly of and measured at right angles to the westerly line of South Maple Avenue; thence along said last me~
tioned parallel line N15~ 3~' E a distance of 261.~1 feet; thence S 74° 27' E a distance of B90 feet to the
westerly line of South. Maple Avenue; thence along the westerly line of South Maple Avenue a distance of 44.23
feet; thence leaving said last mentioned westerly line S 74o 27' E a distance of 410 feet to the westerly line
of the Southern Pacific Railroad Company right-of-way; thence along said last memtioned westerly right of way
line N 15° 33' E 24.46 feet to a point; thence leaving said last mentioned westerlY line S 74 27' E 243 feet to
the westerly line of Linden Avenue; thence along the westerly line of Linden Avenue N 15° 33' E a distance of 210

said work and improvement to consist~of the following:

feet; thence leaving said last mentioned westerly line S 74° 27' E a distance of 410 feet to the westerly line
of the Southern Pacific Railroad Company right-of-way; thence along said last mentioned westeEly right of way
line N 15° 33' E 24.46 feet to a point; thence leaving said last mentioned westerly line S 74 27' E 243 feet to
the westerly line of Linden Avenue; thence along the westerly line of Linden Avenue N 15° 33' E a distance of 210
feet to the northerly ~ine of the Drainage Canal right of way; thence along said last mentioned northerly line
N 74° 27' W a distance, of 2219.08 feet to th~ northerly prolongation of the easterly line of the previously
mentioned Mayfair Village Map No. B; thence along said northerly prolongation and the said easterly lin~ S 15°
W a distance of 100 feet to the point of beginning.
Excepting all Public streets, avenues, thoroughfares, courts, lanes, and alleys included and contained in
said district.
All of said b0uudaries and limits are shown and set forth in a map~or plat to be filed in the office of
the City Clerk of said City of South San Francisco and to be entitled; "SOUTH CANAL STREET AND MAYFAIR AVENUE
IMPROVEMENT."
~. That the City of South San Francisco will contribute, from appropriate public funds~ fifty percent
(50~) of the cost of the work and improvements to be performed and installed along South Canal Street, excluding
that portion thereof pertaining to sanitary sewer and sidewalk installations; that said City will contribute,
from appropriate public funds, the entire cost of performing the necessary work to stabilize the south bank of
Colma Creek Canal, as ~ereinbefore described; and that said City will bear one-half the cost, also from appropriate
public funds, of installing necessary drainage culverts under the Mayfair Avenue Extension, as hereinbefore described.
5. The statute under which it is proposed to conduct proceedings for the proposed improvement is the
"Municipal Improvement Act of 1913', as amended, and it is proposed to pay for said improvements by special assessment
upon adjacent property~upon an area basis with bonds to be issued as authorized under the Improvement Bond Act of
1915 (Statutes 1915,-Page 14~l).
I hereby certifY that the foregoing resolution was regularly introduced and adopted by the City Council of
the City of South San Francisco at an adjourned regular meeting htereof held on the 29th day of August, 1955, by
the following vote:
