A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO
~ORDERING THE VACATION OF A CERTAIN PUBLIC STREET OR THOROUGHFARE LYING
WITHIN SAID CITY, AND AUTHORIZING THE MAYOR AND THE CITY CLERK OF SAID
CITY TO EXECUTE A DEED CONVEYING SAID PUBLIC STREET OR THOROUGHFARE TO
SAFEWAY STORES, INCORPORATED, A CORPORATION.
WHEREAS; the City Council of the City of South San Francisco did, on the 15th day of August,
1955, adopt a resolution declaring its intention to order the vacation of certain public street
or thoroughfare lying within the City of South San Francisco, County of San Marco, State of
California, and described as follows:
BEGINNING at aha>angle point on the southwesterly'property line of that
certain parcel of land conveyed by Pacific Water Company, a copporation,
by deed dated February 1, 1931 and recorded July 17, 1931 in Volume 528
of Official Records at page 195, San Mateo County Records, said angle
point lying South 33° 52' 56" East, distant 213.20 feet from the easterly
property line intersection of Oak Avenue and Mission Road; thence South
9° 56' 26" East 112.16 feet; thence northwesterly along the arc of a curve
to the left tangent to the last said. course with. a radius of 529.00 feet
and subtending a central angle of 230 56' 30", an arc distance of 221.05
feet to a point; thence along a course tangent to the preceding curve at
the last said point, South 33° 52' 56" East, 112.16 feet to the aforesaid
point of beginning:
and
WHEREAS, said resolution of intention was published, and notice of the passage of said
resolution of intention was posted, in the manner and form required by law, reference being
hereby made to the affidavit of Jay Hammond, which affidavit is now on file in the office of
the City Clerk of said City; and
WHEREAS, a public hearing was held at a regular meeting in the City Hall of said City on
the 6th day of September, 1955, at the hour of 8:00 o'clock P.M.; and
WHEREAS, all protests made against the vacating of said public street or thoroughfare
have been overruled; and
WHEREAS, said City Council has determined, and does hereby determine, that said public
street or thoroughfare is unnecessary for present or prospective public purposes; and
WHEREAS Safeway Stores, Incorporated, a Maryland CorporatiOn, the owners of real property
immediately adjacent to the hereinabove described real property, have conveyed to said City
certain real property in exchange for the described real property,
NOW, THEREFORE, the City Council of the City of Soath San Francisco hereby orders that
said public street or. thoroughfare be,.and the same hereby is, vacated and abandoned.
Bg IT Fb~BTI~R R~8OLVED that said city execute its Deed transferring to Safeway Stores,
Incorporated, a Maryland corporation, all the real property hereinbefore described. In this
connection, the Mayor and the City Clerk of the City of South San Francisco are hereby
aUthorized to execute on behalf of said city a deed conve~ing to said Safeway Stores, Incorp-
orated, a Maryland corporation, said real property, and the City Clerk is also hereby directed
to affix to said deed the corporate seal of said city.
BE IT FURTHER RESOLVED that the City Clerk of said city shall cause a certified copy
of .this resolution to be recorded in the office of the Recorder of the County of San Mateo.
I hereby certify that ~he foregoing resolution was regularly introduced and adopted by
the City Council of the City of South San Francisco at a regular meeting held this 6th day
of September, 1955, by the following vote:
AYES, COUNCILMEN: Andrew Rocca, Francis Lucchio, Emilio Cortesi, Telford Smith.
