A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO
DETERMINING AND DECLARING THE NECESSITY OF REQUESTING AID FROM THE
UNITED STATES OF AMERICA IN DREDGINGPORTIONS OF COLMACREEKAND
SPRUCE AVENUE CREEK IN ORDER TO ELIMINATE A SERIOUS FLOOD HAZARD,
AND INSTRUCTING THE CITY MANAGER TO EXECUTE A FORMAL WRITTEN REQUEST
IN THAT REGARD.
WHEREAS, due to silting caused by the run-off of storm waters resulting from recent heavy
railfall, large portions of the channel of Colma Creek and of Spruce Avenue Creek, within the confines of the
City of South San Francisco, have become filled with sand, dirt, and various kinds of debris, thus resulting in
a very serious flood hazard in the event of further heavy railfall; and
WHEREAS the annual rainy season has just begun and there is therefore great likelihood of
considerable more rainfall within the next several weeks, rendering it imperative that the filled portions of
the above-designated creeks be dredged so that there will be adequate capacity to carry aw~y any and all run-
off storm waters; and
~ the city is without adequate funds to finance the necessary dredging operations to
eliminate the flood hazard above referred to; and
WHEREAS it has been learned by the Director of Public Works of said city that, under
appropriate provisions of Federal law, the San Francisco District of the United States Corps of Engineers may,
upon proper application being made and upon the giving of certain assurances, render emergency assistance to
the City of South San Francisco in the emergency hereinabove recited by dredging portions of the aforementioned
creeks, ..
NOW, ~RE, BE IT RESOLVED by the City Council of the City of South San Francisco that
said City Council does find and determine, and does therefore dedlare, that, upon the basis of the premises
hereto and for other good and sufficient reason, an emergency does exist in said city due to a very serious
flood hazard and that said city does not have sufficient funds to eliminate such hazard. Said City Council does
further find and determine that it is necessary to make application to the San Francisco District of the United
States Army Corps of Engineers for assistance in dredging portions of the channels of Colma Creek and Spruce
Avenue Creek, within said city, in particular said portions being in the case of (a) ColmaCreek -- from a point
approximately five hundred (500) feet west of the intersection thereof with Orange Avenue to the intersection
thereof with Harbor Road, and (b) Spruce Avenue Creek -- from the intersection thereof with E1 Camino Real to
the juncture thereofwith Colma Creek.
BE IT FURTHER RESOLVED that the City Manager of said c~ty be, and he hereby is, authorized
and instructed to execute, without delay, and immediately file with the San Francisco District of the United
States Army Corps of Engineers a written request for assistance to perform the dredging operations defined in
the paragraph immediately precediug.
BE IT FURTHER RESOLVED by said City Council that, in connection with such request for
assistance, said City shall, and it hereby does, give assurance of its cooperation in the obtaining of all
required right-of-way easements, rights of entry, or suitable trespass agreements so that said emergency work
may be performed. Further, said city shall, and it hereby does, give assurance that the United States of
America, its servants, agents, and employees, will be saved harmless from any and all manner of actions,
liability, and claims to persons or property by reason of any assistance given, or ~rk performed, by the United
States of America, its servants, agents, or employees, pursuant to said request for assistance.
I hereby certify that the foregoing resolution was regularly introduced and adopted by the
City council of the City of South San Francisco at ~ special meeting held on the ~9th day of December 1955, by
the following vote:
