A RESOLI~TION OF THE CITY COUNCIL OF THE CITY OF
SOUTH SAN FRANCISCO ESTABLISHING A SPECIAL BANK
ACCOUNT FOR THE PURPOSE OF PAYING THE COST OF
IMPROVING SOUTH CANAL STREET AND MAYFAIR AVENUE
EXTENSION, AS DESCRIBED IN RESOLUTION OF INTENTION
NO. 2207, DESIGNATING THE MAYOR AND- DIHECTOR OF
PUBLIC WORKS AS OFFICIALS TO SIGN ALL CHECKS DRAWN
ON SAID ACCOUNT, PROVIDING FOR THE TEMPORARY
TRANSFER OF MONEYS FROM THE GENERAL FUND INTO SAID
ACCOUNT, AND PROVIDING FOR REIMBURSEMENT OF THE
GENERAL FUND.
WHEREAS the City Council of the City of South San Francisco did, on
the 29th day of August 1955, adopt its Resolution of Intention No. 2207 providing
for the performance of certain public improvement work on South Canal Street and
Mayfair Avenue Extension, and whereas said City Council did thereafter adopt its
res$1ution ordering the performance of said work; and
WHEREAS, because of uncertainty as to the proper location for a
culvert to be installed in Mayfair Avenue Extension, as provided for in said Resolution
of Intention and said resolution ordering the performance of the work of improvement,
and there being, as a consequence thereof, an uncertainty as to the total cost of the
enti~e public improvement project, no improvement bonds have been sold for the
purpose of raising funds to finance said public improvement project; and
WHEREAS a contract was heretofore let to The Lowrie Paving Co., Inc.,
a corporation, to perform the major part of said public improvement work, and whereas
said Lowrie Paving Co., Inc., has, as of the date hereof, performed part of the work
called for by its contract and, as a result of such performance, has become entitled
to progress payments; and
WHEREAS there are sufficient moneys in the General Fund of said city
to satisfy the ~aims for progress payments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco that there be established a special bank account out of which
payment of all claims for the performance of the improvement of South Canal Street
and Mayfair Aven~e Extension shall be made. Ail drafts on said account shall be
drawn by the Mayor and Director of Public Works of said city.
BE IT FURTHER RESOLVED that because, as stated in the premises hereto,
there are no funds'available from the sale of bonds at this time and because claims
as presented should be paid, and, because there are sufficient moneys in the General
Fund of said city to satisfy said claims, a transfer of moneys from the General Fund
up to a maximum of Eighty-eight Thousand Eight Hundred Thirty Dollars ($88,830.00),
the estimated cost of said public improvement project, is hereby authorized and
ordered, with the proviso that the improvement bonds to finance said public improve-
ment project shall be ordered sold at the earliest feasible date so that said General
Fund may be fully reimbursed from the proceeds thereof.
BE IT STILL FURTHER RESOLVED that at such time as the improvement bonds
hereinbefore mentioned shall be sold, the appropriate city officials shall cause a
sufficient sum of money to be taken from the proceeds thereof and deposited in the
General Fund of said city so that it may be fully reimbursed for the advancements
hereinbefore ordered to be made from said General Fund.
I hereby certify that the foregoing resolution was regularly
introduced and adopted by the City Council of the City of South San Francisco at a
regular meeting held on the 20th day of February 1956, by the following vote:
